The Application provides adequate assurance that the discharge of fill material into the waters of New Port River in conjunction with the proposed development in Carteret County will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate the applicable portions of Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. This approval is only valid for the purpose and design that you submitted in your application or as described in the Public Notice. If you change your project, you must notify us and you may be required to send a revised application. For this approval to be valid, you must follow the conditions listed below. In addition, you should get any other federal, state or local permits before you go ahead with your project. Condition(s) of Certification: 1. That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction related discharge (50 NTUs in streams and rivers not designated as trout waters by DEM; 25 NTUs in all saltwater classes, and all lakes and reservoirs; 10 NTUs in trout waters). 2. That the fill material be from a clean upland source free of toxic materials. 3. That the riprap material used for toe protection be of such size so as not able to be carried off by wave action and consist of clean rock or masonry material free of toxic pollutants. 4. That silt curtains and other erosion controls be in place prior to any earthen movement in the area. 5. That measures will be taken to prevent live or fresh concrete from coming in contact with surface waters until the concrete has hardened. V Violations of any condition herein set forth shall result in revocation of this Certification. This Certification shall become null and void unless the above conditions are made conditions of the Federal 404 and/or Coastal Area Management Act Permit. This Certification shall expire upon expiration of the 404 or CAMA permit. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within sixty (60) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. A response to these concerns was received on December 13, 1995 by fax and is also attached. Although this project will result in a substantial amount of intertidal area being filled, the fact that this project was previously approved in 1988, and the fact that mitigation for these impacts has already been completed by the NC State Ports Authority, this Office has no major objections to the proposal. Conversations with the Groundwater Section indicate that there is an area of groundwater contamination at the old storage tank site at Berth No. 1. Migration of this contaminant plume is not expected due to the nature (#6 fuel oil) and location of the material and the fact that the area will be completely covered with asphalt paving. It is also felt that construction of the berm should further insure that the contaminant plume does not reach surface waters. The 401 Certification should contain the following conditions for the filling of waters and wetlands of the Newport River. 1. That the fill material be from a clean upland source free of toxic materials. 2. That silt curtains and other erosion controls be in place prior to any earthen movement in the area. 3. That the riprap material used for toe protection be of such size so as not able to be carried off by wave action and consist of clean rock or masonry material free of toxic pollutants. 4. That measures will be taken to prevent live or fresh concrete from coming in contact with surface waters until the concrete has hardened. 5. DEM Project No. 951203 A preliminary review of the subject indicates the following additional information is needed in order for this Office to provide final comments on the CAMA Permit Application. 1. An explanation of why an earthen berm was selected for containment of the backfill material instead of a concrete sheet pile bulkhead. This Office has concerns over the placement of unconsolidated fill material in the surface waters. 2. A detailed narrative of the construction sequence indicating the manner in which the earthen berm will be constructed. This should include all measures that will be employed to prevent turbidity standard violations 3. BOX 1890 WILMINGTON, NORTH CAROLINA 28402-1890 REPLY TO ATTENTION OF December 8, 1995 Regulatory Branch Action ID No. 199602501 Mr. John Parker Division of Coastal Management North Carolina Department of Environment, Health, and Natural Resources Post Office Box 27687 Raleigh, North Carolina 27611-7687 Dear Mr. Parker: OF RF06,?Fo 1995 Reference the application of Morehead City Terminals, Inc. for a Department of the Army permit to expand Berth 1 at the Morehead City State Ports facility by filling approximately 200 square feet of vegetated wetlands and approximately 14,000 square feet of non-vegetated shallow bottom open water for the purpose of constructing a bulk storage and transfer operation on the Newport River, in Morehead City, Carteret County, North Carolina. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following condition(s) be included in the State authorization: All work authorized by this permit must be performed in strict compliance with the permit plans. No vegetated wetlands other than the 200 square feet identified in the permit drawings will be excavated or filled. The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. The fill material will be clean and free of any pollutants except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage or injury to the authorized structure or work which may be caused from existing or future operations undertaken by the United States in the public interest. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. It is possible that the authorized structure may be damaged by wavewash from passing vessels. The issuance of this permit does not relieve the permittee from taking all proper steps to ensure the integrity of the Printed on ® Recyebd Paper permitted structure and the safety of moored boats. The permittee will not hold the United States liable for any such damage. The permitter will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. The authorized structure and associated activity will not cause an unacceptable interference with navigation. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. Increases such that the turbidity in the waterbody is 50 NTU'¦ or lose in all rivers not designated as trout waters by the North Carolina Division of Environmental Management (NCDNM), 25 NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not considered significant. If the permittee discovers any previously unknown historic or archeological remains while accomplishing the authorized work, he will immediately notify the Wilmington District Engineer who will initiate the required State/Federal coordination. If possible, under applicable law, the permittee will incorporate this permit as part of the documents reflecting title to or interest in the real property affected. This Department of the Army permit does not obviate the need to obtain other Federal, State, or local authorizations required by law. PROJECT SUMMARY: The applicant is proposing to expand Berth No. 1 into the Newport River and to construct a bulk storage and transfer operation on adjacent properties. This facility will be first be used for the storage of woodchips. FIELD INVESTIGATION REPORT: MOREHEAD CITY TERMINALS, INC. PAGE #2 9. NARRATIVE DESCRIPTION: Morehead City Terminal, Inc. is an authorized agent for the NC State Ports Authority and is requesting a major modification of CAMA Permit No. 78-95. This permit was issued to the SPA and authorized the completion of Berth No. 1 at the Morehead City Terminal. The modification being proposed will allow for the establishment of a bulk storage area with associated equipment to transfer the product to waiting ships. The facility will first be used for wood chips but could be modified in the future for other bulk cargo. The project can be divided into two components: the expansion of Berth No. 1 into the Newport River and the modification of uplands to provide a suitable staging area for the bulk cargo. In 1987, a portion of Berth 1 suddenly collapsed into the Newport River jeopardizing a fuel tank farm. After an analysis of future needs, The SPA prepared an Environmental Assessment, as required under the NC State Environmental Policy Act, (SEPA) and applied for a CAMA permit to reconfigure and expand Berth 1. CAMA Permit No. 182-88 was issued to the SPA and authorized the excavation of approx. 5.7 acres of the Newport River, the bulkheading and filling of approx. 2.1 acres of the Newport River and approx..12 acres of wetlands, the establishment of a paved hardstand area and the extension of a stormwater outlet pipe. Mitigation was required and included the creation of approx. 2.2 acres of spartina alterniflora wetlands on a dredged spoil island and the creation of a hard rock habitat area along the slope of the dredged area. Shortly after construction began, the lease holder of the railroad trestle and track initiated legal proceedings to halt the construction and excavation activities: A compromised was ultimately reach which reduced the size of the excavation and fill areas. The excavation was completed, a grouted mattress was installed for slope protection and a portion of Berth 1 was bulkheaded. The paved hardstand area was eliminated in order to comply with stormwater rules. Additionally, the mitigation requirements of establishing wetlands on the spoil disposal island were completed. The SPA recently receive CAMA Permit No. 78-95 which authorizes the completion of Berth 1. The applicant is now requesting a permit to fill an additional area of the Newport River which was not authorized under CAMA Permit No. 78-95 but within the boundaries originally permitted by CAMA Permit No. 182-88 before legal proceedings were initiated by the railroad tenant. The area to be filled below the mean high water line is up to approx. 100' long x 150' wide and is mostly intertidal or shallow water habitat areas. Also located within this fill area is approx. 200 ft.2 of spartina altemiflora vegetation and scattered amounts of oysters. The present shoreline of the area is stabilized with varying amounts of stone riprap. The toe of the proposed fill is to be stabilized with an approx. 25' wide grouted mattress cover similar to the design used for the basin slope protection except at the railroad trestle where a timber retaining wall is proposed. The berth expansion would be accomplished by first placing a floating silt curtain immediately waterward of the proposed fill and then constructing an earthen dike inside the silt curtain. The grouted mattress would then be placed on the waterward slope of the dike and the area inside would then be filled. FIELD INVESTIGATION REPORT: MOREHEAD CITY TERMINALS, INC. PAGE #3 The purpose of increasing the size of the Berth is to provide an expanded area which would be suitable for the establishment of a bulk handling storage area with the area initially being used for the storage and transfer of woodchips. The majority of the storage and transfer area will be located within the confines of the old fuel tank farm which was, until recently, located immediately to the west of Berth 1. The tanks have been torn down and are in the process of being transported off the site as scrap. This, combined with an adjacent undeveloped piece of property and Berth No. 1, will result in approx 5 acres of land area being disturbed. Of that total, approx. 4.5 acres will be asphalt hardstand with the remaining areas either gravel or grass. The applicant has calculated that approx. 65% of the area within the Estuarine Shoreline Area of Environmental Concern will be impervious and approx. 90% of the entire site will be built upon. A Stormwater Management Plan for this development has been approved by the Division of Environmental Management. This plan will utilize a collection system and an existing wastewater monitoring station and discharge system. An existing underground 42" stormwater pipe will be extended through the project area and will continue to discharge stormwater from other areas of the State Ports into the Newport River. Besides the asphalt hardstand, the upland development will include a truck dump hopper, a reclaim conveyor, retaining wall, sloped transfer conveyor and an elevated stacking conveyor. 10. ANTICIPATED IMPACTS: The project as proposed will result in the filling of approx. 14,000 ft.2 of intertidal and shallow water habitat areas of the Newport River. Include within the fill area is approx. 200 ft.2 of spartina alterniora and scattered amounts of oysters. It is not know if clam resources are present in the sandy/silt substrate. The proposed fill area represents an expansion of Berth 1 as permitted by CAMA Permit No. 78-95 but would be less than the fill footprint authorized by CAMA Permit No. 182-88. CAMA Permit No. 182-88 was subject to the requirements of SEPA and mitigation was required and subsequently completed by the SPA. The filling of the area beyond the mean high water line is proposed to be accomplished by first installing a floating silt curtain and then creating an earthen dike around its perimeter. The grouted mattress would then be installed. The floating silt curtain may not, however, be suitable in preventing dike erosion from occurring during tidal and wind fluctuations. The upland development will cause approx. 5 acres of land disturbance with approx. 4.5 acres of asphalt hardstand and other built upon surfaces being placed on the site. The applicant has calculated that approx. 65% of the Estuarine Shoreline AEC will be covered with impervious surfaces and that approx. 90% of the site will be built upon. A Stormwater Management Plan has been developed and approved by the Division of Environmental Management. An existing stormwater discharge pipe will be extended through the project and will continue to discharge into the Newport River. This project will not be tied into this discharge point but rather an existing one located south of the project site. PROJECT SUMMARY: The applicant is proposing to expand Berth No. 1 into the Newport River and to construct a bulk storage and transfer operation on adjacent properties. This facility will be first be used for the storage of woodchips. FIELD INVESTIGATION REPORT: MOREHEAD CITY TERMINAIS, INC. PAGE #3 The purpose of increasing the size of the Berth is to provide an expanded area which would be suitable for the establishment of a bulk handling storage area with the area initially being used for the storage and transfer of woodchips. The majority of the storage and transfer area will be located within the confines of the old fuel tank farm which was, until recently, located immediately to the west of Berth 1. The tanks have been torn down and are in the process of being transported off the site as scrap. This, combined with an adjacent undeveloped piece of property and Berth No. 1, will result in approx 5 acres of land area being disturbed. Of that total, approx. 4.5 acres will be asphalt hardstand with the remaining areas either gravel or grass. The applicant has calculated that approx. 65% of the area within the Estuarine Shoreline Area of Environmental Concern will be impervious and approx. 90% of the entire site will be built upon. A Stormwater Management Plan for this development has been approved by the Division of Environmental Management. This plan will utilize a collection system and an existing wastewater monitoring station and discharge system. An existing underground 42" stormwater pipe will be extended through the project area and will continue to discharge stormwater from other areas of the State Ports into the Newport River. Besides the asphalt hardstand, the upland development will include a truck dump hopper, a reclaim conveyor, retaining wall, sloped transfer conveyor and an elevated stacking conveyor. 10. ANTICIPATED DIPACTS: The project as proposed will result in the filling of approx. 14,000 ft.2 of intertidal and shallow water habitat areas of the Newport River. Include within the fill area is approx. 200 ft.2 of spartina alterniflora and scattered amounts of oysters. It is not know if clam resources are present in the sandy/silt substrate. The proposed fill area represents an expansion of Berth 1 as permitted by CAMA Permit No. 78-95 but would be less than the fill footprint authorized by CAMA Permit No. 182-88. CAMA Permit No. 182-88 was subject to the requirements of SEPA and mitigation was required and subsequently completed by the SPA. The filling of the area beyond the mean high water line is proposed to be accomplished by first installing a floating silt curtain and then creating an earthen dike around its perimeter. The grouted mattress would then be installed. The floating silt curtain may not, however, be suitable in preventing dike erosion from occurring during tidal and wind fluctuations. The upland development will cause approx. 5 acres of land disturbance with approx. 4.5 acres of asphalt hardstand and other built upon surfaces being placed on the site. The applicant has calculated that approx. 65% of the Estuarine Shoreline AEC will be covered with impervious surfaces and that approx. 90% of the site will be built upon. A Stormwater Management Plan has been developed and approved by the Division of Environmental Management. An existing stormwater discharge pipe will be extended through the project and will continue to discharge into the Newport River. This project will not be tied into this discharge point but rather an existing one located south of the project site. The bulk storage area will initially be used for the storage and transfer of woodchips but in the future may be used for other FIELD INVESTIGATION REPORT: MOREHEAD CITY TERMINAIS, INC. PAGE #2 9. NARRATIVE DESCRIPTION: Morehead City Terminal, Inc. is an authorized agent for the NC State Ports Authority and is requesting a major modification of CAMA Permit No. 78-95. This permit was issued to the SPA and authorized the completion of Berth No. 1 at the Morehead City Terminal. The modification being proposed will allow for the establishment of a bulk storage area with associated equipment to transfer the product to waiting ships. The facility will first be used for wood chips but could be modified in the future for other bulk cargo. The project can be divided into two components: the expansion of Berth No. 1 into the Newport River and the modification of uplands to provide a suitable staging area for the bulk cargo. In 1987, a portion of Berth 1 suddenly collapsed into the Newport River jeopardizing a fuel tank farm. After an analysis of future needs, The SPA prepared an Environmental Assessment, as required under the NC State Environmental Policy Act, (SEPA) and applied for a CAMA permit to reconfigure and expand Berth 1. CAMA Permit No. 182-88 was issued to the SPA and authorized the excavation of approx. 5.7 acres of the Newport River, the bulkheading and filling of approx. 2.1 acres of the Newport River and approx..12 acres of wetlands, the establishment of a paved hardstand area and the extension of a stormwater outlet pipe. Mitigation was required and included the creation of approx. 2.2 acres of spartina alterniflora wetlands on a dredged spoil island and the creation of a hard rock habitat area along the slope of the dredged area. Shortly after construction began, the lease holder of the railroad trestle and track initiated legal proceedings to halt the construction and excavation activities. A compromised was ultimately reach which reduced the size of the excavation and fill areas. The excavation was completed, a grouted mattress was installed for slope protection and a portion of Berth 1 was bulkheaded. The paved hardstand area was eliminated in order to comply with stormwater rules. Additionally, the mitigation requirements of establishing wetlands on the spoil disposal island were completed. The SPA recently receive CAMA Permit No. 78-95 which authorizes the completion of Berth 1. The applicant is now requesting a permit to fill an additional area of the Newport River which was not authorized under CAMA Permit No. 78-95 but within the boundaries originally permitted by CAMA Permit No. 182-88 before legal proceedings were initiated by the railroad tenant. The area to be filled below the mean high water line is up to approx. 100' long x 150' wide and is mostly intertidal or shallow water habitat areas. Also located within this fill area is approx. 200 ft.2 of spartina alterniflora vegetation and scattered amounts of oysters. The present shoreline of the area is stabilized with varying amounts of stone riprap. The toe of the proposed fill is to be stabilized with an approx. 25' wide grouted mattress cover similar to the design used for the basin slope protection except at the railroad trestle where a timber retaining wall is proposed. The berth expansion would be accomplished by first placing a floating silt curtain immediately waterward of the proposed fill and then constructing an earthen dike inside the silt curtain. A review of your application received November 13, 1995, for Department of the Army authorization to place fill material in approximately 200 square feet of vegetated wetlands and 14,000 square feet of open water, for the construction of a bulk cargo storage facility on the Newport River, in the State Port at Morehead City, Carteret County, North Carolina, indicates it to be a candidate for Federal authorization under this general permit. Accordingly, the administrative processing of your application will be accomplished by the North Carolina Division of Coastal Management. Comments from Federal review agencies will be furnished to the State. If your application must be withdrawn from this general permit process for any reason, you will be informed regarding its further management. If there are no unresolved differences in State-Federal positions or policies, the final action taken on your application by the State will result in your receiving written notice from us that your application is consistent with the general permit and you may commence your activity. Only after receiving such confirmation should you begin work. On February 6, 1990, the DA and the U.S. Environmental Protection Agency (EPA) signed a memorandum of agreement (MOA) establishing procedures to determine the type and level of mitigation necessary to comply with the Clean Water Act Section 404(b)(1) Guidelines. This MOA provides for first, avoiding impacts to waters and wetlands through the selection of the least damaging, practical alternative; second, taking appropriate and practical steps to minimize impacts on waters and wetlands; and finally, compensating for any remaining unavoidable impacts to the extent appropriate and practical. To enable us to process your application in full compliance with this MOA, we request that you provide the following additional information: a. Permits for work within wetlands or other special aquatic sites are available only if the proposed work is the least environmentally damaging, practicable alternative. Please furnish information regarding any other alternatives, including upland alternatives, to the work for which you have applied and provide justification that your selected plan is the least damaging to water or wetland areas.
