8. PROJECT SUMMARY: The applicant is proposing to construct a dock with finger piers to
accommodate 10 boats at a site within a man-made canal adjacent to the Showboat Motel located on
Morehead Avenue, in the Town of Atlantic Beach.

9. NARRATIVE DESCRIPTION: The applicant owns the Showboat Motel which is a
44 unit motel located on an approximately 1 acre tract of land on the east side of
Morehead Avenue, in the Town of Atlantic Beach, Carteret County. The property is
situated at the intersection of Bogue Sound and a man-made canal and is bordered on
the north by the Channel Marker Restaurant and on the south by a jet-ski rental
business. In February of 1995, the applicant requested a CAMA Permit to construct a
replacement bulkhead, a boat ramp, a parallel dock with finger piers and perform
maintenance excavation- within the man-made canal adjacent to the motel property.
During the processing of the permit application, numerous objections were received
from the public concerning the impacts of the proposed piers with navigation into the
canal. The applicant withdrew the piers from permit consideration and later received a
Major CAMA Permit (62-95) for the remainder of the project. Work, however, has
not begun on those permitted activities. The waters adjacent to the project site have
been classified as SA and are closed to the harvesting of shellfish.
The applicant has redesigned the docking facilities and is now requesting a major
modification of the CAMA Permit. The redesign has eliminated the "fishing pier" and
has reduced the waterward extension of 7 out of the 10 slips into the channel. The
largest slips (#1 & 2) are located on the southern end of the property and the
waterward extension of these slips, as well as #3, remained in the same location as
originally proposed. The other slips have been reduced in length from approx. V to
12' (at the northern end of the project site). Additionally, the deck platform proposed
at the northern property line has been reduced from a width of 28' to 14'. The
applicant is also requesting two (2) approx. 21' long x 3' wide floating docks which
are to be located on both sides of the previously permitted boat ramp.
10. ANTICIPATED IMPACT: The project as proposed will result in approx. 13, 720
ft.2 f of canal bottom being occupied by either docks, slips or deck area. During the
review of the original application, the public expressed concerns over the project's
impacts on navigation and the applicant has attempted to redesign the docking
arrangements to lessen those impacts. The largest slips (#1 and 2) and slip #3 extend
approx. one-third the width of the canal. On the opposite shoreline, in front of the
applicant's property, a residential pier also extends into the canal for a distance of
approx. one-third the width of the water body. The proposed dock would be within the
mandatory 15' setback and the applicant has not provided a waiver from the adjacent
property owners for encroachment within that area.

on the proposed project to the Division of Coastal
Management. Upon signing this form, the applicant
further certifies that such notice has been provided.

Dear Mr. Parker:
Reference the application of Ms. Joyce DeMichelle and the Showboat
Motel for a Department of the Army permit to construct a dock with finger
piers to allow the docking of 10 boats. The proposed work will cover
approximately 13,720 square feet of unvegetated shallow bottom with either
docks, slips, or deck area. The proposed work will be located at the Showboat
Motel, on a canal off of Bogue Sound, on Morehead Avenue, in Atlantic Beach,
Carteret County, North Carolina.
The Federal agencies have completed review of the proposal as presented
by the application and your field investigation report.
We recommend that the following condition(s) be included in the State
authorization:
All work authorized by this permit must be performed in strict
compliance with the permit plans.
No excavated or fill materials will be placed at any time in any
vegetated wetlands or waters.
This permit does not authorize the interference with any existing or
proposed Federal project, and the permittee will not be entitled to
compensation for damage or injury to the authorized structure or work which
may be caused from existing or future operations undertaken by the United
States in the public interest.
No attempt will be made by the permittee to prevent the full and free
use by the public of all navigable waters at or adjacent to the authorized
work. Use of the permitted activity must not interfere with the public's
right to free navigation on all navigable waters of the United States.
It is possible that the authorized structure may be damaged by wavewash
from passing vessels. The issuance of this permit does not relieve the
permittee from taking all proper steps to ensure the integrity of the
permitted structure and the safety of moored boats. The permittee will not
hold the United States liable for any such damage.
The permittee will maintain the authorized work in good condition and in
conformance with the terms and conditions of this permit. The permittee is
not relieved of this requirement if he abandons the permitted activity without

having it transferred to a third party.
The authorized structure and associated activity will not cause an
unacceptable interference with navigation.
If possible, under applicable law, the permittee will incorporate this
permit as part of the documents reflecting title to or interest in the real
property affected.
This Department of the Army permit does not obviate the need to obtain
other Federal, State, or local authorizations required by law.
This permit does not grant any property rights or exclusive privileges.
In issuing this permit, the Federal Government does not assume any
liability for:
a. Damages to the permitted project or uses thereof as a result of
other permitted or unpermitted activities or from natural causes.
b. Damages to the permitted project or uses thereof as a result of
current or future Federal activities initiated on behalf of the general
public.
C. Damages to other permitted or unpermitted activities or structures
caused by the authorized activity.
d. Design and construction deficiencies associated with the permitted
work.
e. Damage claims associated with any future modification, suspension,
or revocation of this permit.
