CERTIFICATION
THIS CERTIFICATION is issued in conformity with the requirements of Section 401 Public Laws
92-500 and 95-217 of the United States and subject to the North Carolina Division of Environmental
Management Regulations in 15 NCAC 21-1, Section .0500 to Glenwood Garner and Leslie Bercegcay resulting in
0.12 acres of water impact in Carteret County pursuant to an application filed on the 25th day of August of 1995
to bulkhead and fill the end of a canal, conduct maintenance dredging of the canal and install a boat lift on a
pier.
The Application provides adequate assurance that the discharge of fill material into the waters of Bogue
Sound in conjunction with the proposed development in Carteret County will not result in a violation of
applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies
that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in
accordance with the application and conditions hereinafter set forth.
Condition(s) of Certification:
1. That the activity be conducted in such a manner as to prevent significant increase in
turbidity outside the area of construction or construction related discharge (50 NTUs in
streams and rivers not designated as trout waters by DEM; 25 NTUs in all saltwater
classes, and all lakes and reservoirs; 10 NTUs in trout waters).
2. A small check dam shall be installed at the end of the existing ditch at the start of the
buried pipe to temporarily retain stormwater before it enters Bogue Sound.
Violations of any condition herein set forth shall result in revocation of this Certification. This
Certification shall become null and void unless the above conditions are made conditions of the Federal 404
and/or Coastal Area Management Act Permit. This Certification shall expire upon expiration of the 404 or
CAMA permit.
If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written
request within sixty (60) days following receipt of this Certification. This request must be in the form of a
written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. If modifications are made to an original
Certification, you have the right to an adjudicatory hearing on the modifications upon written request within sixty
(60) days following receipt of the Certification. Unless such demands are made, this Certification shall be final
and binding.

9. NARRATIVE DESCRIPTION: Messrs. Glenwood Garner & Leslie Bercegeay own
adjoining properties located off NC Hwy 24 and on SR 1215 near the community of
Ocean, Carteret County. Mr. Garner's property is approximately 260' deep x 100'
and Mr. Bercegeay property is 260' deep x 115'. Both properties border Bogue
Sound. A single family residence has been built on each of the properties with a small
drainage ditch separating the two properties. In the early 70's the two owners
received Dredge and Fill Permit #425 to excavate a canal into their properties and a
boat basin area in Bogue Sound. The canal and the basin were excavated to a depth of
-4' mean low water (MLW) deep and the canal sides were bulkheaded. A pier and
boat ramp have been constructed on each property. The existing ditch discharges into
the head of the canal via an 18" concrete culvert pipe. The canal and basin areas have
been maintained excavated several times over the last twenty years.
The applicants now wish to bulkhead and fill in the head of the existing canal. An
approximately 45' long x 16' wide area x .5' MLW deep area would be bulkhead and
filled with an approx. 5' wide area of riprap placed waterward of the bulkhead. The
existing drainage would be maintained by installing additional 18" diameter pipe(s)
through the fill and bulkhead area. The remainder of the canal, measuring
approximately 30' long x 16' wide x -1' MLW deep would be excavated by a dragline
to -4' MLW deep. The approx. 55' long x 75' wide x -2' MLW deep basin area in
Bogue Sound is proposed to be maintained to -4 MLW deep. A portion of the spoil
material from the excavation project would be used as backfill for the canal filling with
the remainder spread in the applicant's yards. A 20' long x 14' uncovered boat lift
would also be installed at the end of Mr. Bercegeay's existing dock. Waters at the
project site have been classified as SA ORW and are open to the harvesting shellfish.
10. ANTICIPATED IMPACTS: The project as proposed will result in the filling in of
approx. 720 ft.2 of a man-made canal at its upper end. An additional 80 ft.2 of canal
would be filled by riprap placed on the waterward side of the proposed bulkhead. It is
estimated that these activities would result in approx. 13 cubic yards of material being
placed below the mean high water (MHW) line and another approx. 80 cubic yards of
material used to bring the grade of filled area level with the applicants yard. The
applicants are also proposing to excavate approx. 480 ft.2 of area in the remaining
portion of the canal and approx. 4,125 ft.2 of area in Bogue Sound. All excavation
would be accomplished by the use of a dragline with the approx. 355 cubic yds. of
sandy mud material being removed and either placed in the applicants yards or used as
backfill material for the canal filling. Increases in short term turbidity levels can be
expected during the excavation portion of this project. The installation of the bulkhead
prior to canal backfilling could minimize sedimentation and turbidity impacts to Bogue
Sound. A 20' long x 14' wide uncovered boat lift would be placed at the end of the
pier on Mr. Bercegeay's property. This would result in shading approximately 280 sq.
ft of Public Trust Area.

9. NARRATIVE DESCRIPTION: Messrs. Glenwood Garner & Leslie Bercegeay own
adjoining properties located off NC Hwy 24 and on SR 1215 near the community of
Ocean, Carteret County. Mr. Garner's property is approximately 260' deep x 100'
and Mr. Bercegeay property is 260' deep x 115'. Both properties border Bogue
Sound. A single family residence has been built on each of the properties with a small
drainage ditch separating the two properties. In the early 70's the two owners
received Dredge and Fill Permit #425 to excavate a canal into their properties and a
boat basin area in Bogue Sound. The canal and the basin were excavated to a depth of
-4' mean low water (MLW) deep and the canal sides were bulkheaded. A pier and
boat ramp have been constructed on each property. The existing ditch discharges into
the head of the canal via an 18" concrete culvert pipe. The canal and basin areas have
been maintained excavated several times over the last twenty years.
The applicants now wish to bulkhead and fill in the head of the existing canal. An
approximately 45' long x 16' wide area x .5' MLW deep area would be bulkhead and
filled with an approx. 5' wide area of riprap placed waterward of the bulkhead. The
existing drainage would be maintained by installing additional 18" diameter pipe(s)
through the fill and bulkhead area. The remainder of the canal, measuring
approximately 30' long x 16' wide x -1' MLW deep would be excavated by a dragline
to -4' MLW deep. The approx. 55' long x 75' wide x -2' MLW deep basin area in
Bogue Sound is proposed to be maintained to -4 MLW deep. A portion of the spoil
material from the excavation project would be used as backfill for the canal filling with
the remainder spread in the applicant's yards. A 20' long x 14' uncovered boat lift
would also be installed at the end of Mr. Bercegeay's existing dock. Waters at the
project site have been classified as SA ORW and are open to the harvesting shellfish.
10. ANTICIPATED IMPACTS: The project as proposed will result in the filling in of
approx. 720 ft.2 of a man-made canal at its upper end. An additional 80 ft.2 of canal
would be filled by riprap placed on the waterward side of the proposed bulkhead. It is
estimated that these activities would result in approx. 13 cubic yards of material being
placed below the mean high water (MHW) line and another approx. 80 cubic yards of
material used to bring the grade of filled area level with the applicants yard. The
applicants are also proposing to excavate approx. 480 ft.2 of area in the remaining
portion of the canal and approx. 4,125 ft.2 of area in Bogue Sound. All excavation
would be accomplished by the use of a dragline with the approx. 355 cubic yds. of
sandy mud material being removed and either placed in the applicants yards or used as
backfill material for the canal filling. Increases in short term turbidity levels can be
expected during the excavation portion of this project. The installation of the bulkhead
prior to canal backfilling could minimize sedimentation and turbidity impacts to Bogue
Sound. A 20' long x 14' wide uncovered boat lift would be placed at the end of the
pier on Mr. Bercegeay's property. This would result in shading approximately 280 sq.
ft of Public Trust Area.

for Department of the Army authorization and a State Water Quality
Certification to construct and backfill a bulkhead, fill a portion of an
existing man-made canal, maintenance excavate a canal and basin, and install a
new boat lift, adjacent to Bogue Sound, in the Koonce Landing/ocean community,
in Carteret County, North Carolina. Your receipt of this letter verifies your
acceptance of a valid request for certification in accordance with Section
325.2(b)(ii) of our administrative regulations.
We are considering authorizing the proposed activity pursuant to Section
404 of the Clean Water Act, and we have determined that a water quality
certification is required under the provisions of Section 401 of the same law.
A Department of the Army permit will not be granted until the certification
has been obtained or waived.
In accordance with our administrative regulations, in most cases, 60 days
after receipt of a request for certification is a reasonable time for State
action. Therefore, if you have not acted on the request, or asked for an
extension of time, by October 6, 1995, the District Engineer will deem that
waiver has occurred.

9. NARRATIVE DESCRIPTION: Messrs. Glenwood Garner & Leslie Bercegeay own
adjoining properties located off NC Hwy 24 and on SR 1215 near the community of
Ocean, Carteret County. Mr. Garner's property is approximately 260' deep x 100'
and Mr. Bercegeay property is 260' deep x 115'. Both properties border Bogue
Sound. A single family residence has been built on each of the properties with a small
drainage ditch separating the two properties. In the early 70's the two owners
received Dredge and Fill Permit #425 to excavate a canal into their properties and a
boat basin area in Bogue Sound. The canal and the basin were excavated to a depth of
-4' mean low water (MLW) deep and the canal sides were bulkheaded. A pier and
boat ramp have been constructed on each property. The existing ditch discharges into
the head of the canal via an 18" concrete culvert pipe. The canal and basin areas have
been maintained excavated several times over the last twenty years.
The applicants now wish to bulkhead and till in the head of the existing canal. An
approximately 45' long x 16' wide area x .5' NILW deep area would be bulkhead and
tilled with an approx. 5' wide area of riprap placed waterward of the bulkhead. The
existing drainage would be maintained by installing additional 18" diameter pipe(s)
through the till and bulkhead area. The remainder of the canal, measuring
approximately 30' long x 16' wide x -1' MLW deep would be excavated by a dragline
to -4' MLW deep. The approx. 55' long x 75' wide x -2' MLW deep basin area in
Bogue Sound is proposed to be maintained to -4 NILW deep. A portion of the spoil
material from the excavation project would be used as backtill for the canal filling with
the remainder spread in the applicant's yards. A 20' long x 14' uncovered boat lift
would also be installed at the end of Mr. Bercegeay's existing dock. Waters at the
project site have been classified as SA ORW and are open to the harvesting shellfish.
10. ANTICIPATED L IPACTS: The project as proposed will result in the tilling in of
approx. 720 ft.= of a man-made canal at its upper end. An additional 80 ft. of canal
would be filled by riprap placed on the waterward side of the proposed bulkhead. It is
estimated that these activities would result in approx. 13 cubic yards of material being
placed below the mean high water (MHW) line and another approx. 80 cubic yards of
material used to bring the grade of filled area level with the applicants yard. The
applicants are also proposing to excavate approx. 480 ft.' of area in the remaining
portion of the canal and approx. 4,125 ft.2 of area in Bogue Sound. All excavation
would be accomplished by the use of a dragline with the approx. 355 cubic yds. of
sandy mud material being removed and either placed in the applicants yards or used as
backflll material for the canal filling. Increases in short term turbidity levels can be
expected during the excavation portion of this project. The installation of the bulkhead
prior to canal backfilling could minimize sedimentation and turbidity impacts to Bogue
Sound. A 20' long x 14' wide uncovered boat lift would be placed at the end of the
pier on Mr. Bercegeay's property. This would result in shading approximately 280 sq.
ft of Public Trust Area.

NOTICE OF FILING OF
APPLICATION FOR CAMA MAJOR DEVELOPMENT
PERMIT AND WATER QUALITY CERTIFICATION
The Department of Environment, Health and Natural Resources hereby gives public
notice as required by NCGS 113A-119(b) and 143-215 3(a)(1)(c) that Glenwood Garner and
Leslie Bercegeay of Carteret County, filed an application on June 30, 1995, for a permit
from the Division of Coastal Management to develop in an Area of Environmental Concern
and for certification from the Division of Environmental Management that a discharge of fill
material in project wetlands will not violate applicable water quality standards.
According to said application, the applicants are proposing to construct a bulkhead
and boat lift and maintenance excavate a portion of a canal and basin area adjacent to Bogue
Sound and SR1215, off NC Hwy. 24, near the community of Ocean, Carteret County.
A copy of the entire application and additional information may be examined (or
copies furnished upon request and payment of reproduction costs) during normal business
hours at the office of Charles Pigott, Division of Coastal Management, located in the
Division of Marine Fisheries Building, Morehead City, N.C., (919) 726-7021, and/or the
office of Rick Shiver, Division of Environmental Management, DEHNR Regional Field
Office, Wilmington, N.C., (919) 395-3900.
The Division of Environmental Management proposes to take final action on this
water quality certification on or before September 4, 1995. The issuance of the CAMA
Major Development permit and the Section 401 Certification may deviate from this projected
date depending upon the nature of the comments submitted and subsequent hearings that may
result.
All persons desiring to make comments should do so in writing to Roger N. Schecter,
Director, Division of Coastal Management, P.O. Box 27687, Raleigh, N.C., 27611, prior to
August 30, 1995 for consideration in the CAMA permit decision, and to Preston Howard,
Director, Division of Environmental Management, P.O. Box 27687, Raleigh, N.C., 27611,
prior to August 25, 1995 for consideration in the water quality certification decision. Later
comments on the CAMA application will be accepted and considered up to the time of permit
decision. Project modifications may occur based on review and comment by the public and
state and federal agencies. Notice of the permit decision in this matter will be provided upon
request.
