SUBJECT: CAMA/DREDGE & FILL Permit Application Review
Applicant: Albemarle Recreation and Leadership Training Center for Disabled Persons
Project Location: SR 1222, Bennett's Creek Mill Pond, Chowan County
Proposed Project: To construct an educational/recreational nature trail facility for
disabled persons at an existing mill pond site. Development
includes trail construction over and adjacent to freshwater wetlands
and public trust waters. The proposed trail includes one 5' x 45'
fishing pier with a 5' x 15' "T", one 5' x 20' canoe dock, and a 12
foot wide emergency-use vehicular bridge across the existing mill
pond spillway. The proposal also includes a 200' x 6' raised
walkway over freshwater wetlands, a 20' x 6' foot bridge over public
trust waters and the associated parking for the facility.

INTRODUCTION
The Albemarle Recreation and Leadership Training Center for Disabled Persons (hereafter referred to
as the Albemarle Recreation Center) is a non-profit organization which provides services and activities for
disabled individuals. The Albemarle Recreation Center currently leases 13 acres on the southern end of
Bennett's Mill Pond. Existing structures include the dam spillway across Rocky Hock Creek, Bennett's
Mill Pond and the remnants of the old mill buildings. One building remains standing. The existing dirt
road access to the site was once a County road, but has long since been abandoned except for use to access
the site from SR 1222.
The Albemarle Recreation Center proposes to use this site as a learning and recreation facility.
Trails would be constructed to be used for hiking and horseback riding. The Albemarle Recreation Center
also wishes to provide canoeing and fishing access.
SITE DESCRIPTION
Records indicate that a grist mill and mill pond were in operation as far back as 1757 on Rocky Hock
Creek. The existing spillway, and mill facilities were constructed early in the 1900's. The spill-way dam
structure is approximately 1,000 ft. northwest of the intersection of SR 1222 and Rocky Hock Creek. It is
estimated that the existing mill pond is over 100 acres. The average depth is 8 ft. at NWL.
Existing structures include the dam spillway across Rocky Hock Creek, Bennett's Mill Pond and the
remnants of the old mill buildings. One building remains standing while debris from the remains of the old
mill are stockpiled within 20 ft. of the NWL. The old mill stone is presently located on the site. The
existing dirt road access to the site was once a County road, but has long since been abandoned except for
use to access the site from SR 1222. The site also has a 12 ft. wide existing ramp structure approximately
15 ft. from the spillway.
The waters of Bennett's Mill Pond and Rocky Hock Creek are classified by the Wildlife Resources
Commission as Inland Waters. These waters are classified by the Division of Environmental Management
as CSW. The waters of Bennett's Mill Pond are considered as public trust waters by the Division of
Coastal Management and part of the Estuarine System Area of Environmental Concern.
Although the forested area around Bennett's Mill Pond is much larger, the site where the applicant
proposes work includes 13 acres of forest and hardwood swamp. Bennett's Mill Pond is surrounded by a
forested wetland over story canopy of Taxodium distichum (bald cypress), Nyssa aquatica (water tupelo)
and Acer rubrum (red maple). Under story species include the woody vine Toxicodendron radicans
(poison ivy) and the woody shrub, Rosa palustris (swamp rose).

The adjacent upland area grades off gradually to the pond. An over story of Liquidambar styraciflua
(sweet gum), 'Liriodendron tulipifera (tulip poplar), and Quercus michauxii (chestnut swamp oak) shade the
old mill and spillway area. This area is upland and is a portion of a remnant sand ridge.
PROPOSED WORK
The applicant wishes to construct an educational and recreational nature trail facility for disabled
persons. The development includes a one-half mile trail. The trail facility would include one 5 ft. wide by
45 ft. long fishing pier with a 5 ft. by 15 ft. "T"at the end. The applicant also proposes to provide, at a
different location, a canoe access area. This would be accomplished by constructing a 20 ft. long and 5 ft.
wide canoe dock adjacent to the existing boat ramp structure.
The trail would include approximately 200 ft. of raised walkway, 6 ft. in width, over and adjacent to
freshwater wetlands. Another portion of the proposed trail would use six foot wide walkway foot bridge to
cross over a small finger of the pond's public trust waters. This finger is 20 ft. wide and 2 ft. in depth.
The foot bridge would be elevated 1.0 ft. above the NWL. Approximately 300 sf. of public trust waters
are upstream from this foot bridge location.
The proposed trail will be approximately 3,000 ft in length and 6 ft. in width. This trail would
impact 18,000 sf. of upland area. The trail design is be geared toward disabled persons. In this regard, the
applicant also proposes to provide an emergency vehicular bridge over the existing spillway. This proposed
bridge would span the 60 ft. wide spillway. The vehicular bridge structure would be 12 ft. wide and 80 ft.
long and be elevated 8.0 ft. above the NWL. The proposed structure would rest on the existing spillway
walls and require no additional support piles in public trust waters or fill below the NWL. The bridge
would be used by vehicles for emergencies only. The trail would also lead across this bridge to the main
trail area.
The applicant would also construct a 40,000 sf. parking area adjacent to the canoe launching and
dock area. Parking lot would utilize the existing upland sand present on the site. Since a significant
amount of debris remains from the old mill facility, the proposed work would also include site cleanup of
the general area.
ANTICIPATED IMPACTS
The proposed development is within and adjacent to the Public Trust Waters Area of Environmental
Concern. The proposed project would impact a total of 1.388 A. The proposed raised walkway would
shade 1,200 sf. (0.03 A) of freshwater wetlands. The proposed footbridge, vehicular bridge and pier
structures would impact 1,140 sf. (0.027 A) of public trust waters. The proposed foot bridge structure
would also entrap 300 sf. of public trust waters upstream from its crossing. The trail and parking area
would impact 58,000 sf (1.331A) of upland area adjacent to the mill pond.

The vehicular bridge would not directly affect access to public trust waters as it would be constructed
across the existing spillway structure. Because of the existing spillway, small vessels using public trust
waters on the creek or mill pond would require portage to go up stream or down stream, regardless.
The ,proposed fishing pier will not interfere with navigation and as proposed, conforms with the
Conditions of 7H. 1200. The proposed canoe dock would provide mooring facilities for small boats and
canoes accessing the pond. The two piers would be used for different uses and are a significant distance
apart. The shaded area impacted by these structures would be less than 500 sf. and would not interfere with
the navigation of public trust waters.
This proposed. trail facility would provide an opportunity for the disabled to utilize public trust
resources available at Bennnett's Mill Pond.
CAMA REVIEW
No endangered species or Coastal Wetlands are currently known to exist at this proposed project site.
There are no known unique geologic remains at this site. The Division of Archives and History is aware of
this historical mill site but has not conducted an official survey.
This project is located within the Public Trust Waters Area of Environmental Concern of the
Estuarine System in North Carolina. A land-use plan consistency review by Steve Gabriel will follow
under a separate document.

APPLICATION FOR CAM A. MAJOR DEVELOPMENT
PERMIT AND WATER QUALITY CERTIFICATION
The Department of Environment, Health and Natural Resources hereby gives public
notice as required by NCGS 113A-119(b) and 143-215 3(a)(1)(c) that ALBEMARLE
RECREATION AND LEADERSHIP TRAINING CENTER FOR DISABLED PERSONS
of Chowan County, filed an application on June 9, 1995, for a permit from the Division of
Coastal Management to develop in an Area of Environmental Concern and for certification
from the Division of Environmental Management that a discharge of fill material in project
wetlands will not violate applicable water quality standards.
According to said application the applicant proposes to construct an
educational/recreational nature trail facility for disabled persons at an existing mill pond site.
Development includes trail construction over and adjacent to freshwater wetlands and public
trust waters. The proposed trail includes one 5' x 45' fishing pier with a 5' x 15' "T", one
5' x 20' canoe dock, and a 12 foot wide emergency-use vehicular bridge across the existing
mill pond spillway. The proposal also includes a 200' x 6' raised walkway over freshwater
wetlands, a 20' x 6' foot bridge over public trust waters and the associated parking for the
facility.
A copy of the entire application and additional information may be examined (or
copies furnished upon request and payment of reproduction costs) during normal business
hours at the office of Dennis Hawthorn, Division of Coastal Management, located at 1367
US 17 South, Elizabeth City, N.C., 919/264-3901, and/or the office of Deborah Sawyer,
Division of Environmental Management, DEHNR Regional Field Office, Washington, N.C.,
919/946-6481.
The Division of Environmental Management proposes to take final action on this
water quality certification on or before August 21, 1995. The issuance of the CAMA Major
Development permit and the Section 401 Certification may deviate from this projected date
depending upon the nature of the comments submitted and subsequent hearings that may
result.
All persons desiring to make comments should do so in writing to Roger N. Schecter,
Director, Division of Coastal Management, P.O. Box 27687, Raleigh, N.C., 27611, prior to
August 16, 1995 for consideration in the CAMA permit decision, and to Mr. John Dorney,
Division of Environmental Management, P.O. Box 27687, Raleigh, N.C., 27611, prior to
August 11, 1995 for consideration in the water quality certification decision. Later
comments on the CAMA application will be accepted and considered up to the time of permit
decision. Project modifications may occur based on review and comment by the public and
state and federal agencies. Notice of the permit decision in this matter will be provided upon

INTRODUCTION
The Albemarle Recreation and Leadership Training Center for Disabled Persons (hereafter referred to
as the Albemarle Recreation Center) is a non-profit organization which provides services and activities for
disabled individuals. The Albemarle Recreation Center currently leases 13 acres on the southern end of
Bennett's Mill Pond. Existing structures include the dam spillway across Rocky Hock Creek, Bennett's
Mill Pond and the remnants of the old mill buildings. One building remains standing. The existing dirt
road access to the site was once a County road, but has long since been abandoned except for use to access
the site from SR 1222.
The Albemarle Recreation Center proposes to use this site as a learning and recreation facility.
Trails would be constructed to be used for hiking and horseback riding. The Albemarle Recreation Center
also wishes to provide canoeing and fishing access.
SITE DESCRIPTION
Records indicate that a grist mill and mill pond were in operation as far back as 1757 on Rocky Hock
Creek. The existing spillway, and mill facilities were constructed early in the 1900's. The spill-way dam
structure is approximately 1,000 ft. northwest of the intersection of SR 1222 and Rocky Hock Creek. It is
estimated that the existing mill pond is over 100 acres. The average depth is 8 ft. at NWL.
Existing structures include the dam spillway across Rocky Hock Creek, Bennett's Mill Pond and the
remnants of the old mill buildings. One building remains standing while debris from the remains of the old
mill are stockpiled within 20 ft. of the NWL. The old mill stone is presently located on the site. The
existing dirt road access to the site was once a County road, but has long since been abandoned except for
use to access the site from SR 1222. The site also has a 12 ft. wide existing ramp structure approximately
15 ft. from the spillway.
The waters of Bennett's Mill Pond and Rocky Hock Creek are classified by the Wildlife Resources
Commission as Inland Waters. These waters are classified by the Division of Environmental Management
as CSW. The waters of Bennett's Mill Pond are considered as public trust waters by the Division of
Coastal Management and part of the Estuarine System Area of Environmental Concern.
Although the forested area around Bennett's Mill Pond is much larger, the site where the applicant
proposes work includes 13 acres of forest and hardwood swamp. Bennett's Mill Pond is surrounded by a
forested wetland over story canopy of Taxodium distichum (bald cypress), Nyssa aquatica (water tupelo)
and Acer rubrum (red maple). Under story species include the woody vine Toxicodendron radicans
(poison ivy) and the woody shrub, Rosa palustris (swamp rose).

The adjacent upland area grades off gradually to the pond. An over story of Liquidambar styraciua
(sweet gum),'Liriodendron tulipifera (tulip poplar), and Quercus michauxii (chestnut swamp oak) shade the
old mill and spillway area. This area is upland and is a portion of a remnant sand ridge.
PROPOSED WORK
The applicant wishes to construct an educational and recreational nature trail facility for disabled
persons. The development includes a one-half mile trail. The trail facility would include one 5 ft. wide by
45 ft. long fishing pier with a 5 ft. by 15 ft. "T"at the end. The applicant also proposes to provide, at a
different location, a canoe access area. This would be accomplished by constructing a 20 ft. long and 5 ft.
wide canoe dock adjacent to the existing boat ramp structure.
The trail would include approximately 200 ft. of raised walkway, 6 ft. in width, over and adjacent to
freshwater wetlands. Another portion of the proposed trail would use six foot wide walkway foot bridge to
cross over a small finger of the pond's public trust waters. This finger is 20 ft. wide and 2 ft. in depth.
The foot bridge would be elevated 1.0 ft. above the NWL. Approximately 300 sf. of public trust waters
are upstream from this foot bridge location.
The proposed trail will be approximately 3,000 ft in length and 6 ft. in width. This trail would
impact 18,000 sf. of upland area. The trail design is be geared toward disabled persons. In this regard, the
applicant also proposes to provide an emergency vehicular bridge over the existing spillway. This proposed
bridge would span the 60 ft. wide spillway. The vehicular bridge structure would be 12 ft. wide and 80 ft.
long and be elevated 8.0 ft. above the NWL. The proposed structure would rest on the existing spillway
walls and require no additional support piles in public trust waters or fill below the NWL. The bridge
would be used by vehicles for emergencies only. The trail would also lead across this bridge to the main
trail area.
The applicant would also construct a 40,000 sf. parking area adjacent to the canoe launching and
dock area. Parking lot would utilize the existing upland sand present on the site. Since a significant
amount of debris remains from the old mill facility, the proposed work would also include site cleanup of
the general area.
ANTICIPATED IMPACTS
The proposed development is within and adjacent to the Public Trust Waters Area of Environmental
Concern. The proposed project would impact a total of 1.388 A. The proposed raised walkway would
shade 1,200 sf. (0.03 A) of freshwater wetlands. The proposed footbridge, vehicular bridge and pier
structures would impact 1,140 sf. (0.027 A) of public trust waters. The proposed foot bridge structure
would also entrap 300 sf. of public trust waters upstream from its crossing. The trail and parking area
would impact 58,000 sf (1.331A) of upland area adjacent to the mill pond.

The vehicular bridge would not directly affect access to public trust waters as it would be constructed
across the existing spillway structure. Because of the existing spillway, small vessels using public trust
waters on the creek or mill pond would require portage to go up stream or down stream, regardless.
The,proposed fishing pier will not interfere with navigation and as proposed, conforms with the
Conditions of 7H. 1200. The proposed canoe dock would provide mooring facilities for small boats and
canoes accessing the pond. The two piers would be used for different uses and are a significant distance
apart. The shaded area impacted by these structures would be less than 500 sf. and would not interfere with
the navigation of public trust waters.
This proposed. trail facility would provide an opportunity for the disabled to utilize public trust
resources available at Bennnett's Mill Pond.
CAMA REVIEW
No endangered species or Coastal Wetlands are currently known to exist at this proposed project site.
There are no known unique geologic remains at this site. The Division of Archives and History is aware of
this historical mill site but has not conducted an official survey.
This project is located within the Public Trust Waters Area of Environmental Concern of the
Estuarine System in North Carolina. A land-use plan consistency review by Steve Gabriel will follow
under a separate document.
