Dear Mr. Long:
You have our approval to place fill material in 1112 square feet of wetlands or waters for the
purpose of residential lot fill at Lot 32, Shore Drive, Crystal Shores subdivision, as you described in
your application dated 7 July 1995. After reviewing your application, we have decided that this fill is
covered by General Water Quality Certification Number 2733. This certification allows you to use
Nationwide Permit Number 18 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401

The proposed discharge has been evaluated to determine whether the activity
complies with the terms and conditions of Nationwide Permit (NWP) #18 for
discharges impacting up to 0.10 acres of waters and wetlands of the United
States.
We have concluded that the discharge would also have greater than minimal
adverse environmental impact, including cumulative impact on the aquatic
environment.
The forested wetlands at the project site are adjacent to the regularly
flooded coastal marsh bordering the waters of Bogue Sound. The area of Bogue
Sound has been designated as ORW, which is the highest water quality rating given
by the state. These wetlands provide a number of benefits to receiving waters
that include the attenuation of storm water runoff, sediment and pollutant
removal, nutrient uptake and transformation, improvements to water quality, and
providing valuable habitat for various species of birds, mammals, and reptiles.
The individual and cumulative impacts associated with this project are
considered to have a greater than minimal impact to the aquatic environment due
to the cumulative impacts of filling and excavation of wetlands within the Bogue
Sound watershed, in particular the wetland system within Crystal Shores
Subdivision. It is our position that the natural state functions of these
wetlands, as stated above, provide important water quality and habitat benefits
to Bogue Sound that would be adversely impacted by the filling of these wetlands.
I find that NWP 418 does not apply to your present proposal as it has
greater than minimal impacts to the aquatic environment. Because only the back
corner of your lot is affected by this decision, I do not believe that the
resonable use of your lot for residential purposes would be precluded. Should
you wish to pursue Department of the Army (DOA) authorization you have the option
to apply for Department of the Army Individual Permit authorization. Should you
wish to pursue this option, the enclosed application should be completed and
submitted to this office for our review.
