You have our approval to place fill material in 200 square feet of wetlands or waters for the purpose of installing a bulkhead at 192 Sailfish Drive, Holden Beach, as you described in your application dated 14 June 1995. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2665. This certification allows you to use Nationwide Permit Number 13 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. X 10 ft.), in conjunction with the replacement of his existing bulkhead. Bonnie Steptoe Page 2 9. PROTECT DESCRIPTION The project site is located at 192 Sailfish Drive (Lot 324), Harbor Acres Subdivision, on Holden Beach, in Brunswick County, North Carolina. Harbor Acres Subdivision is oriented around a system of five finger canals, which are connected to the Atlantic Intracoastal Waterway. The lot is 50 feet wide and 160 feet in depth. There is an existing single-family residence on the property, and the waterfront shoreline is stabilized by an existing bulkhead. There is an existing pier and dock, and an old boat ramp located between and on, the applicant's lot and the adjacent lot to the east. The boat ramp has been in disuse for some time. It and the existing bulkhead are in need of repair. Waterward of the bulkhead and into the old boat ramp, there is a border of Smooth Cordgrass (Spartina alterniflora), varying in width from 8 to 12 feet. The boat ramp is approximately 10 feet wide and indents into the lots approximately 28 feet. It has a sloped earthen bottom, and some Svartina alterniflora has colonized the lower 8 feet of the boat ramp. This vegetation is not solid across the ramp, probably due to the shading effects of adjacent shrubbery and Wax Myrtles. High marsh coastal wetland species, Limonium, spp., Salicornia, spp., Borrichia frutescens, were observed interspersed over the sand/mud bottom, through the middle portion of the ramp. The bulkhead on the adjacent property (lot 323) has recently been replaced. The waters adjacent to the project area are classified SA, by the N. C. Division of Environmental Management, and they are CLOSED to the harvest of shellfish. The waters are not designated as Primary Nursery Area by the N. C. Division of Marine Fisheries. The applicant proposes to replace the existing bulkhead on the same alignment, and construct a new section of bulkhead across the mouth of the old boat ramp, connecting the two corners of the existing bulkheads. The old boat ramp would be back-filled to the elevation of the adjacent yards. The applicant has the permission of the adjacent property owner to fill in the old boat ramp. 10. ANTICIPATED PACTS The proposed project would incorporate approximately 80 square feet of Spartina alterniflora, and approximately 120 square feet of mixed species, high marsh vegetation. High marsh coastal wetland species, Limonium, spp., Salicomia, spp., Borrichia fnrtescens, were observed interspersed over the sand/mud bottom, through the middle portion of the ramp. The bulkhead on the adjacent property (lot 323) has recently been replaced. The waters adjacent to the project area are classified SA, by the N. C. Division of Environmental Management, and they are CLOSED to the harvest of shellfish. The waters are not designated as Primary Nursery Area by the N. C. Division of Marine Fisheries. The applicant proposes to replace the existing bulkhead on the same alignment, and construct a new section of bulkhead across the mouth of the old boat ramp, connecting the two comers of the existing bulkheads. The old boat ramp would be back-filled to the elevation of the adjacent yards. The applicant has the permission of the adjacent property owner to fill in the old boat ramp. 10.
