After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2665. This certification allows you to use Nationwide Permit Number 13 or its equivalent when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing. PROJECT SUMMARY: The applicant proposes to bulkhead and construct a docking facility to accommodate up to 11 boats. FIELD INVESTIGATION REPORT: Ms. Lucita Mooney/ Carteret County PAGE #2 9. NARRATIVE DESCRIPTION: The applicant's property is located at 221 Bayview Drive in the community of Harkers Island, Carteret County. The property adjoins Westmouth Bay and has been developed with a residence. A previous land owner received a Dredge and Fill Permit (#170-73) and excavated a boat basin and access channel through wetlands into Westmouth Bay. The original tract of land was subdivided with the applicant's property split from the original tract along the centerline of the access channel and boat basin. The portion of the boat basin on the applicant's property was originally bulkheaded and piers were built along the shoreline to accommodate several boats. The bulkhead and piers deteriorated over the years and after purchasing the property a few years ago, the applicant removed the bulkhead and all the piers except one small platform. The shoreline bank has continued to erode into the applicant's yard. The adjoining property owner on the eastern side of the basin (Calvin Rose Boat Dockage) has developed his property into a small marina which accommodates approx. 22 boats. A General Permit (#C13919) was recently issued to the property owner to perform maintenance excavation to a portion of the access channel leading into the basin. The spoils material from this operation was placed on Ms. Mooney's property to be used as backfill material a proposed bulkhead. Waters at the project site have been classified as SA by and are closed to the harvesting of shellfish. The closure of shellfish waters extends beyond the existing docking facilities of Calvin Rose Boat Dockage for a distance of 200'. The applicant is proposing to bulkhead the shoreline of the existing boat basin within her property boundary. The bulkhead would follow the Mean High Water (MHW) line except at one area located on the South side of the basin where erosion has cut into the bank approximately 8'. The spoils material from the recent excavation operation would be used as backfill behind the proposed new bulkhead. Also proposed is a parallel dock with 5 finger piers which would accommodate up to 11 boats. The dock would be approximately 360' long x 6' wide with the finger piers approximately 15' long x 3' wide. A 22' long x 5' wide concrete access ramp is proposed at the southwest coroner of the basin to provide wheelchair access to the proposed pier. Approximately 360' of bulkhead would be placed along the shoreline. 10. ANTICIPATED IMPACTS: The applicant proposes to bulkhead approximately 360' of shoreline in a man made basin. Approximately 285' of the bulkhead would be positioned at the MHW line. Approximately 75' of the bulkhead would be placed at a maximum distance of 8' beyond the MHW line in order to have a straight bulkhead alignment. This would result in approximately 400 sq. ft. of shallow water habitat area being filled with approx. 22 cubic yards of material being placed below the MHW line. A 360' long x 6' wide dock would be constructed parallel to the bulkhead will provide five finger piers and adjacent mooring pilings to accommodate up to 11 boats. Approximately 10,000 sq. ft. of Estuarine Waters would be shaded by the proposed docking facility. The proposed pier would be built right to the property line on the east side. This riparian property owner has waived the 15' setback requirement. The Shellfish Sanitation Section of the Division of Environmental Health has indicated that the additional slips may cause an increase in the shellfish closure area within the existing access channel. If the applicant is not claiming to be the owner of said property, then forward a copy of the deed or other instrument under which the owner claims title, plus written permission from the owner to carry out the project. An accurate work plat (including plan view and cross sectional drawings) drawn to scale in black ink on an 8 1/2 x I 1 white paper. (Refer to Coastal Resources Commission Rule 7J.0203 for a detailed description.) Please note that original drawings are preferred and only high quality copies will be accepted. Blue-line prints or other larger plats are acceptable only if 18 high quality copies are provided by applicant. (Contact the U.S. Army Corps of Engineers regarding that agency's use of larger drawings.) A site or location map is a part of plat requirements and it must be sufficiently detailed to guide agency persomiel unfamiliar with the area to the site. If the applicant is not claiming to be the owner of said property, then forward a copy of the deed or other instrument under which the owner claims title, plus written permission from the owner to carry out the project. An accurate Nvork plat (including plan view and cross sectional drawings) drawn to scale in black ink on an 8 1/2 x 11 white paper. (Refer to Coastal Resources Commission Rule 7J.0203 for a detailed description.) Please note that original drawings are preferred and only high quality copies will be accepted. Blue-line prints or other larger plats are acceptable only if 18 high quality copies are provided by applicant. (Contact the U.S. Army Corps of Engineers regarding that agency's use of larger drawings.) A site or location map is a part of plat requirements and it must be sufficiently detailed to guide agency personnel unfamiliar with the area to the site.
