Dear Mr. & Ms Schmidt:
You have our approval to place fill material in 0.087 acres of wetlands or waters for the purpose
of courtyard paving and minor landscaping at Lot 18 & 19, Section 4, St. James Plantation, as you
described in your application dated 9 May 1995. After reviewing your application, we have decided
that this fill is covered by General Water Quality Ce.-tification Number 2733. This certification allows
you to use Nationwide Permit Number 18 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or ]coal permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 30 days of the date thzt you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 1 OB of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401

I have enclosed seven copies of the Joint Application for use of
Nationwide Permit 18 on Lots 18 and 19, Section 4, St. James
Plantation on behalf of William and Virginia Schmidt. They are
building a large home that involves both lots they are purchasing
and need to "update" the permitted wetland area required.
Lot 19 was permitted for use of Nationwide Permit 18 in 1993 as
shown on the enclosed materials. However, with the Schmidt's house
plan, the fill area in wetlands is changing. The required fill
area does not extend any further into the wetland than the original
permitted area but does extend to Lot 18 now. The house will be
constructed on pilings to avoid greater impacts to wetlands. Only
an area for a paved courtyard for parking and a small landscaping
area are being requested. Of the ± 2 acres of wetlands on these
lots only .087 acres will be disturbed, effectively preserving 1.91
acres of wetland into the future. This one Nationwide 18 Permit
Request will cover any needed wetland fill for two lots rather than
one.
