CERTIFICATION
THIS CERTIFICATION is issued in conformity with the requirements of Section 401
Public Laws 92-500 and 95-217 of the United States and subject to the North Carolina Division of
Environmental Management Regulations in 15 NCAC 2H, Section .0500 to N. C. State Ports Authority
resulting in 3000 square feet of wetland impact in Carteret County pursuant to an application filed on
the 4th day of May of 1995 to construct Berth One at Morehead City Port Terminal.
The Application provides adequate assurance that the discharge of fill material into the waters
of Newport River in conjunction with the proposed development in Carteret County will not result in a
violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of
North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-
500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set
forth.
Condition(s) of Certification:
That the activity be conducted in such a manner as to prevent significant
increase in turbidity outside the area of construction or construction related
discharge (50 NTUs in streams and rivers not designated as trout waters by
DEM; 25 NTUs in all saltwater classes, and all lakes and reservoirs; 10 NTUs
in trout waters).
Violations of any condition herein set forth shall result in revocation of this Certification. This
Certification shall become null and void unless the above conditions are made conditions of the
Federal 404 and/or Coastal Area Management Act Permit. This Certification shall expire upon
expiration of the 404 or CAMA permit.
If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon
written request within sixty (60) days following receipt of this Certification. This request must be in
the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and
filed with the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. Unless
such demands are made, this Certification shall be final and binding.

APPLICATION FOR CAMA MAJOR DEVELOPMENT
PERMIT AND WATER QUALITY CERTIFICATION
The Department of Environment, Health and Natural Resources hereby gives public
notice as required by NCGS 113A-119(b) and 143-215 3(a)(1)(c) that the NC State Ports
Authority filed an application on April 3, 1995, for a permit from the Division of Coastal
Management to develop in an Area of Environmental Concern and for certification from the
Division of Environmental Management that a discharge of fill material in project wetlands
will not violate applicable water quality standards.
According to said application, the applicant is proposing to complete the construction
of Berth One at the Morehead City Port Terminal, adjacent to the Newport River, Carteret
County.
A copy of the entire application and additional information may be examined (or
copies furnished upon request and payment of reproduction costs) during normal business
hours at the office of Charles Jones, Division of Coastal Management, located in the
Division of Marine Fisheries Building, Morehead City, N.C., (919) 726-7021, and/or the
office of Rick Shiver, Division of Environmental Management, DEHNR Regional Field
Office, Wilmington, N.C., (919) 395-3900.
The Division of Environmental Management proposes to take final action on this
water quality certification on or before June 7, 1995. The issuance of the CAMA Major
Development permit and the Section 401 Certification may deviate from this projected date
depending upon the nature of the comments submitted and subsequent hearings that may
result.
All persons desiring to make comments should do so in writing to Roger N. Schecter,
Director, Division of Coastal Management, P.O. Box 27687, Raleigh, N.C., 27611, prior to
June 2, 1995 for consideration in the CAMA permit decision, and to Preston Howard,
Director, Division of Environmental Management, P.O. Box 27687, Raleigh, N.C., 27611,
prior to May 28, 1995 for consideration in the water quality certification decision. Later
comments on the CAMA application will be accepted and considered up to the time of permit
decision. Project modifications may occur based on review and comment by the public and
state and federal agencies. Notice of the permit decision in this matter will be provided upon

9, NARRATM : The NC State Ports Authority (SPA) is requesting a
permit to complete the construction of Berth One at the Morehead City Terminal as
authorized by CAMA Permit #182-88. This permit originally authorized the re-
construction, redesign and expansion of Berth 1 after it collapsed in 1987. Also,
included in the permit authorization was the excavation of approx. 5.7 acres of subtidal
area, the bulkheading and filling of approx. 2.1 acres of Newport River, the filling of
approx..12 acres of marsh, the establishment of a paved hardstand area, the extension
of an existing stormwater outfall pipe and the establishment of a mooring dolphin
facility. Mitigation was required and involved the creation of approx. 2.2 acres of
spartina alterniflora marsh on an existing dredged spoil island in Newport River and
the creation of a "hard rock habitat area" along the slope of a dredged area. Shortly
after construction began on the project, the leaseholder of the railroad trestle and tracks
initiated legal proceeding to halt the construction and excavation activities. A
compromise was ultimately reach which resulted in the area of the Newport River
being filled and excavated to be reduced in size. The excavation activities authorized
by the modified permit was completed but the bulkheading and filling of the berth area
was never completed. In fact, the bulkhead and limited backfill was placed offshore
but it was never extended perpendicular to the shore. The sheltering effect afforded by
the bulkhead has allowed approx. 1,0000 ft.2 of spartina alterniflora to become
established along the shoreline. The paved hardstand area was also eliminated in order
to comply with stormwater rules.
The NC SPA is now requesting permits to complete the bulkheading and filling of
Berth One. Plans included with the application shows that approx. 160 linear feet of
bulkhead will be extended from the existing bulkhead in a perpendicular direction to
the existing shoreline with an approx. 110' wide x 240' long area below the mean high
water line will be filled to an elevation of approx 8 to 10' NGVD. On the waterward
side of the bulkhead an approx. 80' long x 12' wide area of riprap is proposed for the
area adjacent to the natural shoreline to serve as wing wall protection. The modified
CAMA permit also included a stormwater drainage plan which was approved by the
Division of Environmental Management. This plan showed the construction of a 20'
wide gravel roadway around the perimeter of the berth with a rock swale collection
system to collect the runoff. The remaining portion of the berth was to remain as a
grassy area. The recent proposal also includes a gravel roadway, a rock swale
collection system and a grassy area but changes the location of the discharge point.
Instead of having the discharge pipe through the new bulkhead it will be located along
the natural shoreline. A new 30" pipe is proposed to discharge the stormwater at a
point below the mean low water line. The mitigation area has been completed and the
applicant has include information concerning this in the application package.
IL AIMCIEPAUP • The project as proposed will result in the completion of
a previously authorized bulkhead with approx. 26,400 ft2 of Newport River bottom
area being filled with approx. 3,600 cubic yards of fill material. Approx. 3,0000 ft.2
of coastal wetlands would also be filled. Additionally, approx 960 ft2 of River bottom
will be filled with approx. 150 cu. yds. of rock riprap for the purpose of wingwall
protection. The applicant has developed a stormwater plan which include a new 30"
stormwater discharge pipe which will discharge in an area along the natural shoreline
at a point below the MLW line. The applicant will have to receive permission from
the Division of Environmental Management to construct this discharge system.
Mitigation has already been provided for this project.

Summary of Results of Marsh Mitigation
Research at the State Ports Authority

• Approximately 2.25 acres of S ap rtina alterniflora marsh and a transition
zone of Soartina patens were restored on a dredged material disposal
site.
• Plant growth in the restored area is equivalent to adjacent natural
marshes.
• Applications of phosphorus fertilizer increased growth of Spartina
a terniflora at the site but there was no growth response to nitrogen.
• Incorporating labile organic material (wheat straw, alfalfa, Spartina)
into the substrate produced anoxic conditions, which resulted in
mortality of plants.
• The labile organic amendments increased sulfides in porewater and reduced
redox potential.
• Incorporating refractory organic material (peat) did not result in anoxic
conditions in the substrate and had no effect on plant growth.
• Sulfides in porewater and redox potential were not affected by
incorporating peat.
• Surface application of labile organic material did not result in redox
conditions intense enough to affect plant growth.

9. NARRATIVE DESCRIPTION, The NC State Ports Authority (SPA) is requesting a
permit to complete the construction of Berth One at the Morehead City Terminal as
authorized by CAMA Permit #182-88. This permit originally authorized the re-
construction, redesign and expansion of Berth 1 after it collapsed in 1987. Also,
included in the permit authorization was the excavation of approx. 5.7 acres of subtidal
area, the bulkheading and filling of approx. 2.1 acres of Newport River, the filling of
approx..12 acres of marsh, the establishment of a paved hardstand area, the extension
of an existing stormwater outfall pipe and the establishment of a mooring dolphin
facility. Mitigation was required and involved the creation of approx. 2.2 acres of
spartina alterniflora marsh on an existing dredged spoil island in Newport River and
the creation of a "hard rock habitat area" along the slope of a dredged area. Shortly
after construction began on the project, the leaseholder of the railroad trestle and tracks
initiated legal proceeding to halt the construction and excavation activities. A
compromise was ultimately reach which resulted in the area of the Newport River
being filled and excavated to be reduced in size. The excavation activities authorized
by the modified permit was completed but the bulkheading and filling of the berth area
was never completed. In fact, the bulkhead and limited backf1l was placed offshore
but it was never extended perpendicular to the shore. The sheltering effect afforded by
the bulkhead has allowed approx. 1,0000 ft.2 of spartina alterniflora to become
established along the shoreline. The paved hardstand area was also eliminated in order
to comply with stormwater rules.
The NC SPA is now requesting permits to complete the bulkheading and filling of
Berth One. Plans included with the application shows that approx. 160 linear feet of
bulkhead will be extended from the existing bulkhead in a perpendicular direction to
the existing shoreline with an approx. 110' wide x 240' long area below the mean high
water line will be filled to an elevation of approx 8 to 10' NGVD. On the waterward
side of the bulkhead an approx. 80' long x 12' wide area of riprap is proposed for the
area adjacent to the natural shoreline to serve as wing wall protection. The modified
CAMA permit also included a stormwater drainage plan which was approved by the
Division of Environmental Management. This plan showed the construction of a 20'
wide gravel roadway around the perimeter of the berth with a rock swale collection
system to collect the runoff. The remaining portion of the berth was to remain as a
grassy area. The recent proposal also includes a gravel roadway, a rock swale
collection system and a grassy area but changes the location of the discharge point.
Instead of having the discharge pipe through the new bulkhead it will be located along
the natural shoreline. A new 30" pipe is proposed to discharge the stormwater at a
point below the mean low water line. The mitigation area has been completed and the
applicant has include information concerning this in the application package.
10. ANTICIPATED EWPACTS: The project as proposed will result in the completion of
a previously authorized bulkhead with approx. 26,400 ft2 of Newport River bottom
area being filled with approx. 3,600 cubic yards of fill material. Approx. 3,0000 ft.2
of coastal wetlands would also be filled. Additionally, approx 960 ft2 of River bottom
will be filled with approx. 150 cu. yds. of rock riprap for the purpose of wingwall
protection. The applicant has developed a stormwater plan which include a new 30"
stormwater discharge pipe which will discharge in an area along the natural shoreline
at a point below the MLW line. The applicant will have to receive permission from
the Division of Environmental Management to construct this discharge system.
Mitigation has already been provided for this project.

Summary of Results of Marsh Mitigation
Research at the State Ports Authority

Steve Broome
• Approximately 2.25 acres of S artina alterniflora marsh and a transition
zone of Spartina atens were restored on a dredged material disposal
site.
• Plant growth in the restored area is equivalent to adjacent natural
marshes.
• Applications of phosphorus fertilizer increased growth of Spartina
alterniflora at the site but there was no growth response to nitrogen.
• Incorporating labile organic material (wheat straw, alfalfa, Spartina)
into the substrate produced anoxic conditions, which resulted in
mortality of plants.
• The labile organic amendments increased sulfides in porewater and reduced
redox potential.
• Incorporating refractory organic material (peat) did not result in anoxic
conditions in the substrate and had no effect on plant growth.
• Sulfides in porewater and redox potential were not affected by
incorporating peat.
• Surface application of labile organic material did not result in redox
conditions intense enough to affect plant growth.

Dear Mr. Dorney:
Enclosed is the application of the North Carolina State Ports Authority
for Department of the Army (DA) authorization and a State Water Quality
Certification to construct and backf ill a bulkhead and install a riprap
wingwall to complete Berth One on the Newport River, Morehead City Terminal,
Carteret County, North Carolina. Your receipt of this letter verifies your
acceptance of a valid request for certification in accordance with Section
325.2(b)(ii) of our administrative regulations.
We are considering authorizing the proposed activity pursuant to Section
404 of the Clean Water Act, and we have determined that a water quality
certification is required under the provisions of Section 401 of the same law.
A Department of the Army permit will not be granted until the certification
has been obtained or waived.
In accordance with our administrative regulations, in most cases, 60 days
after receipt of a request for certification is a reasonable time for State
action. Therefore, if you have not acted on the request, or asked for an
extension of time, by July 3, 1995, the District Engineer will deem that
waiver has occurred.

A copy of the deed (with state application only) or other
instrument under which the applicant claims title to the
affected property. If the applicant is not claiming to be
the owner of said property, then forward a copy of the
deed or other instrument under which the owner claims
title, plus written permission from the owner to cant' out
the project.
An accurate work plat (including plan view and cross
sectional drawings) drawn to scale in black ink on an 8
1/2 x 11 white paper. (Refer to Coastal Resources
Commission Rule 7J.0203 for a detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Bluc-line
prints or other larger plats are acceptable only if 18 high
quality copies are provided by applicant. (Contact the
U.S. Army Corps of Engineers regarding that agency's
use of larger drawings.) A site or location map is a part
of plat requirements and it must be sufficiently detailed
to guide agency personnel unfamiliar with the area to the
site. Include county road (SR) numbers, landmarks, and
the like.
A stormwater management plan, if applicable, that
may have been developed in consultation with the
Division of Environmental Management.
A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners. These
