You have our approval to place fill material in 1.06 acres of wetlands or waters for the purpose
of sewer lines and road crossing at Quail Ridge subdivision, as you described in your application dated
28 March 1995. After reviewing your application, we have decided that this fill is covered by General
Water Quality Certification Numbers 2664, 2732 and 2671. This certification allows you to use
Nationwide Permit Numbers 12, 14 and 26 when they are issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification.
Wetland fill is not approved for lots - all lots with jurisdictional wetland must have deed restrictions
(examples attached) to prevent future wetland fill. In addition, you should get any other federal, state
or local permits before you go ahead with your project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicator},
hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401

sewage system for future development, tie existing streets and sewage collection systems of
surrounding tracts together in conformance with Morehead City thoroughfare plan and
City desire to provide sewage service to portions of surrounding tracts that can only be
served by a gravity sewer collection system traversing the subject tract.

present owner all occurred prior to Section 404 of the Clean Water Act. The existing roads
that now dead end at the tract perimeter must be tied into & constructed in conformance
with the Morehead City thoroughfare plan and horizontal/vertical street alinement
standards. Both sewage collection systems & potable water distribution systems are also
required in the proposed street R/W s. Within the severe constraints imposed by local
regulations, the street layout has been designed to minimize the extent of wetland impact
and still provide reasonable parcel interior access & block geometry for development
purposes

Dear Mr. Styron:
The Wilmington Regional Office received the Stormwater Submittal for Quail Ridge Subdivision
on May 17, 1994, with final information on September 1, 1994. Staff review of the plans and
specifications, including the statement of intent to deed restrict the allowable built-upon area for each of
the 127 lots and the park areas as shown on the approved plan per the attached letter, has determined that
the project as proposed will comply with the Stormwater Regulations set forth in Title 15A NCAC
2H. 1003(a)(2), (3), and the Third Directive dated November 15, 1989. Runoff from the curb and gutter
streets will be treated in 100' long grassed swales.
Any modification of the plans submitted to and approved by this Office or further development of
this site regardless of the fact that the modification may be less than 1 acre, will require an additional
Stormwater Submittal/Modification and approval prior to initiation of construction. Modifications include
but are not limited to; project name changes, transfer of ownership, redesign of built-upon surfaces,
addition of built-upon surfaces, redesign or further subdivision of the project area as shown on the
approved plans.
This Certification shall be effective from the date of issuance until rescinded. The project shall be
constructed and maintained in accordance with the plans and specifications approved by the Wilmington
Regional Office. This Certification does not supersede any other permit or approval. The developer is
responsible for obtaining any and all permits and approvals necessary for the development of this project.
This could include the Division of Coastal Management under CAMA requirements, the Division of
Environmental Management under Wetland 401 Water Quality Certification and/or a Dredge and Fill
Permit and/or a Sewer Extension/Collection Permit, U.S. Army Corps of Engineers 404 Wetland Permit,
NPDIS stormwater permit if disturbing five acres or more, local County or Town Agency permits under
their local ordinances, or others that may be required.

Deed restrictions, including the allowable built-upon area per lot, must be recorded with the Office
of the Register of Deeds. A copy of the recorded deed restrictions, including deed book number and page,
must be forwarded to this Office within 30 days of the date of the recording. Failure to record and/or
submit the deed restrictions to this Office is considered a violation of this Certification.
An Engineer/Designer/Owner Certification (copy attached) must be received at the time the
recorded Deed Restrictions are submitted. The Certification will verify to this Office that the stormwater
controls, general layout of the project and the amount of impervious area are in substantial compliance with
the approved Stormwater Plan.

SUBJECT: Review of application for Section 401 Water Quality Certification, Mr. Ralph
Styron, Morehead City, Carteret County. DEM ID 95336.
Staff biologists with the Wildlife Resources Commission have completed a review of the
project with regard to associated impacts on wildlife and fishery resources in the area. A site visit
was made on April 25, 1995. Our comments are provided in accordance with provisions of the
Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C 661-667d), Section
401(b) of the Clean Water Act of 1977 (as amended), and the North Carolina General Statutes
(G.S. 113-131 et seq.).
The applicant proposes to construct streets and extend sewage/water lines from
surrounding tracts. The purpose of the proposed work is to provide street access and a
sewage/water system for future development. The design minimizes wetland impacts from road
construction, but results in the wetland being dissected into numerous lots. This design will result
in individual landowners obtaining Nationwide permits to fill the wetlands. The accumulative
effect will be the loss of the entire wetland tract within this initial phase of development. The 1.0-
acre "404" wetland located in the initial phase of development contains a defined stream channel
and is the drainage corridor for approximately 9.0 acres of wetlands east of the initial
development site. This entire wetland system contributes to the headwaters of Peletier Creek, a
tributary to Bogue Sound. This contiguous 10-acre wetland together with smaller pockets of
wetlands makes up 15 acres of the 51-acre tract.
Wetlands such as those found on this site provide functions that benefit the public as well
as fish and wildlife. Wetlands retain and purify stormwater before the water reaches quality
watersheds and nursery areas such as Bogue Sound and provide habitat for numerous species of
amphibians, reptiles, birds, and mammals. Wetlands also contribute large quantities of organic
carbon, that is the base of the food chain for many aquatic ecosystems.

As proposed, this project is inconsistent with our Policies and Guidelines for
Conservation of Wetlands and Aquatic Habitats. It is the policy of this agency to oppose
projects which "displace, damage, or modify wetland values and functions." We also believe that
this project is inconsistent with the Environmental Protection Agency's Section 404(b)(1)
guidelines in that the project does not constitute a water dependent activity. Due to these factors,
we request that 401 Water Quality Certification not be issued.

Dear Mr. Styron:
Please reference your application dated March 27, 1995, in which you
requested Department of the Army (DA) authorization to discharge fill material
into 1.06 acre of jurisdictional wetlands located above the headwaters of
Peletier Creek. The proposed fill will be used for sewer lines, roads, and
lot fill all related to the construction of Quail Ridge Subdivision, off
Friendly Lane, near Morehead City, Carteret County, North Carolina.
For the purposes of the Corps of Engineers' Regulatory Program, Title 33,
Code of Federal Regulations (CFR), Part 330.6, published in the Federal
Register on November 22, 1991, lists nationwide permits. Authorization was
provided, pursuant to Section 404 of the Clean Water Act, for discharges of
dredged or fill material into headwaters and isolated waters by Nationwide
Permit No. 26.
Your work is authorized by this nationwide permit provided it is
accomplished in strict accordance with your submitted plans, the enclosed
conditions and provided you receive a Section 401 water quality certification
from the North Carolina Division of Environmental Management (NCDEM) and, in
the coastal area, a consistency determination from the North Carolina Division
of Coastal Management (NCDCM). You should contact Mr. John Dorney, telephone
(919) 733-1786, regarding water quality certification, and Mr. Steve Benton,
telephone (919) 733-2293, regarding consistency determination. This
nationwide permit does not relieve you of the responsibility to obtain other
required State or local approval.
This verification will be valid until the permit is modified, reissued or
revoked, which will occur prior to January 21, 1997. It is incumbent upon you
to remain informed of changes to the nationwide permits, which will be
announced by public notice when they occur. If you commence, or are under
contract to commence, this activity before the date the nationwide permit is
modified or revoked, you will have twelve months from the date of the
modification or revocation to complete the activity under the present terms
and conditions of this nationwide permit.
