Box 541 Atlantic Beach, N.C. 28512 Dear Mr. Styron: F!L E You have our approval to place fill material in 1.06 acres of wetlands or waters for the purpose of sewer lines and road crossing at Quail Ridge subdivision, as you described in your application dated 28 March 1995. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Numbers 2664, 2732 and 2671. This certification allows you to use Nationwide Permit Numbers 12, 14 and 26 when they are issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. Wetland fill is not approved for lots - all lots with jurisdictional wetland must have deed restrictions (examples attached) to prevent future wetland fill. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicator}, hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. Staff review of the plans and specifications, including the statement of intent to deed restrict the allowable built-upon area for each of the 127 lots and the park areas as shown on the approved plan per the attached letter, has determined that the project as proposed will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H. 1003(a)(2), (3), and the Third Directive dated November 15, 1989. Runoff from the curb and gutter streets will be treated in 100' long grassed swales. Any modification of the plans submitted to and approved by this Office or further development of this site regardless of the fact that the modification may be less than 1 acre, will require an additional Stormwater Submittal/Modification and approval prior to initiation of construction. Modifications include but are not limited to; project name changes, transfer of ownership, redesign of built-upon surfaces, addition of built-upon surfaces, redesign or further subdivision of the project area as shown on the approved plans. This Certification shall be effective from the date of issuance until rescinded. The project shall be constructed and maintained in accordance with the plans and specifications approved by the Wilmington Regional Office. Hamilton Assistant Director DATE: May 2, 1995 SUBJECT: Review of application for Section 401 Water Quality Certification, Mr. Ralph Styron, Morehead City, Carteret County. DEM ID 95336. Staff biologists with the Wildlife Resources Commission have completed a review of the project with regard to associated impacts on wildlife and fishery resources in the area. A site visit was made on April 25, 1995. Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C 661-667d), Section 401(b) of the Clean Water Act of 1977 (as amended), and the North Carolina General Statutes (G.S. 113-131 et seq.). The applicant proposes to construct streets and extend sewage/water lines from surrounding tracts. The purpose of the proposed work is to provide street access and a sewage/water system for future development. The design minimizes wetland impacts from road construction, but results in the wetland being dissected into numerous lots. This design will result in individual landowners obtaining Nationwide permits to fill the wetlands. The accumulative effect will be the loss of the entire wetland tract within this initial phase of development. The 1.0- acre "404" wetland located in the initial phase of development contains a defined stream channel and is the drainage corridor for approximately 9.0 acres of wetlands east of the initial development site. This entire wetland system contributes to the headwaters of Peletier Creek, a tributary to Bogue Sound. This contiguous 10-acre wetland together with smaller pockets of wetlands makes up 15 acres of the 51-acre tract. Wetlands such as those found on this site provide functions that benefit the public as well as fish and wildlife. Wetlands retain and purify stormwater before the water reaches quality watersheds and nursery areas such as Bogue Sound and provide habitat for numerous species of amphibians, reptiles, birds, and mammals. Wetlands also contribute large quantities of organic carbon, that is the base of the food chain for many aquatic ecosystems. 1 .. Ralph Styron 2 May 2, 1995 As proposed, this project is inconsistent with our Policies and Guidelines for Conservation of Wetlands and Aquatic Habitats. It is the policy of this agency to oppose projects which "displace, damage, or modify wetland values and functions." We also believe that this project is inconsistent with the Environmental Protection Agency's Section 404(b)(1) guidelines in that the project does not constitute a water dependent activity. Due to these factors, we request that 401 Water Quality Certification not be issued. We appreciate the opportunity to provide input into this permit review. Your work is authorized by this nationwide permit provided it is accomplished in strict accordance with your submitted plans, the enclosed conditions and provided you receive a Section 401 water quality certification from the North Carolina Division of Environmental Management (NCDEM) and, in the coastal area, a consistency determination from the North Carolina Division of Coastal Management (NCDCM).
