After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2733. This certification allows you to use Nationwide Permit Number 18 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter, 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. As noted in Exhibit 2, EMAS, Inc. has already received a NWP 26 for the proposed project activities which initially proposed about 1/4 acre of fill. Because the City of Asheville has a flood-safe requirement for any structure built in a designated 100 year flood plain zone, EMAS will be required to place 5' deep anchored concrete footers to be in compliance with the code. This, will involve building an elevated boardwalk and infrastructure which will not impede the flow of wildlife or water. Design specifications are given in the report enclosed herewith. Respectfully submitted, BEAVER LAKE WETLANDS PROJECT: ELISHA MITCHELL AUDUBON SOCIETY 1.00 Overview This supplement amends the previously submitted Wetlands Delineation Report to the Asheville Office of the Army Corps of Engineers dated November 30, 1993 for the Beaver Lake Wetlands Sanctuary. The enclosed data provide the requested and necessary design specifications in order to determine the amount and acreage of fill for the proposed elevated boardwalk within the 4.00 acre project site. Correspondence with Mr. David Baker indicates that the project area qualifies for a NWP 18, as <0.10 acre of fill is projected for project activities. His determination indicates the project area location is below headwater areas of Beaverdam Creek, with a flow pattern exceeding 5 cubic feet per second under normal flow conditions. 2.00 Design Specifications for the Proposed Elevated Boardwalk 1) The elevated boardwalk and related infrastructure of lookouts, blinds, etc., will be 1,625 lineal feet in length; the actual boardwalk will be 5' wide. The support footers nor any part of the proposed infrastructure will impede the flow of water or wildlife. 2) Support posts will be placed every 10' (OC) and will be metal anchored to concrete footers as per engineering requirements of the City of Asheville. Thus, 330 support posts and footers will be required. The footers will be 1' X 1' X 5' deep (_ 5 cubic feet of fill per footer. Any excavated material will be transported to uplands. 3) The infrastructure of lookouts, blinds, and all platform interpretive structures, etc., will require 60 additional. support posts and footers. 4) Calculations for acreage to be filled is as follows: 390 footers X 1 square foot = 390 sq.ft. = 0.0089 acre. 5) Calculations for cubic yards is as follows: 390 footers X 5 cubic feet (1 square foot X 5' deep) = 1950 cubic feet or 72.2 cubic yards (1950/27). Based on the above design specifications, the project activities qualify for a NWP 18 with the requirement of Predischarge Notification (PDN) to the COE before any excavation and fill for footers is initiated. UATV : 9-2-92 F:' _ C_.... 430 On 9-2-97 ? visited the Beaver lake Park site to determine if hydric soils were present.. The area adjacent to *Merrimon Ave. has been filled with 2 to 4 feet of soil and other material. The filled area (Udorthent) runs from the steak house to the bridge, south to north; approximately 150 feet deep. The area immediately behind the fill drops abruptly to the natural surface. The vegetation observed supports the hydric qualifications. The first soil observation had about 12 inches of overwash material. The soil profile underneath is very similar to the Hatboro soil series, surface was to thin for the series. Hatboro is a very deep and poorly drained soil. The textures of the surface and subsoil are loam and silt loam. The Hatboro series is a hydric soil. The second soil observation is a typical example of Arkaqua soil series. This soil is very deep and somewhat poorly drained. The textures of 1-he surface any subsoil are loam and s ilt loan. The substrata changes to sand loam and loamy sand at 45 inches. The Arkaqua soil series does net classify as a hydric soil but certainly can have hydric inclusions. The water table in the Arkaqua soil was noted at 40 inches, but we did not check the stabilized water table level. The site exhibits the soil, vegetative, hydrologic characteristics to be defined as a hydric area. For your information I've included a series-description and interpretative record for the Hatboro, Arkaqua and Iotla soils. The Iotla soil is very similar to Arkaqua (coarse-loamy verses fine-loamy particle size family) and may be an aggressive competitor.
