Everhart, PhD Southeastern Permit Coordinator Habitat Conservation Program Date: June 27, 2006 RE: Sunset Station, LLC -Shoreline at Sunset, Brunswick Co. 401/404 Application DWQ # 20060913, USACE Action ID# 20060821 Biologists with the North Carolina Wildlife Resources Commission (NCWRC) have reviewed the subject application for impacts to wildlife and fishery resources. Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et. seq.), and Sections 401 and 404 of the Clean Water Act (as amended). The project is located east of the intersection of NC 179 and East Shoreline Dr., in Sunset Beach. The property consists of approximately 5.8 acres including approximately .006 acres of forested wetlands and a perennial stream that is an un-named tributary of Long Creek Pond in the Lumber River Basin. Waters in this area are classified SA by the Division of Water Quality (NCDWQ). The applicants propose to impact approximately 0.006 acre of wetlands through filling to construct access, parking, and one of four structures. In addition, 2991inear ft and .OS acre of stream will be impacted. The applicants propose to mitigate for wetland impacts by buy-in to the NC EEP for .006 acre of riparian wetland and 2991inear ft of warm stream. We have the following concerns/recommendations: We recommend a 100 ft native forested buffer is maintained or created on each side of any on-site perennial streams. The NC EEP acceptance letter indicates .002 acre of riparian wetland rather than the .006 acre proposed. We recommend abuy-in of not less than 3.3:1 for both riparian wetland and linear feet of stream impacts. We recommend that a thorough T&E Species survey be conducted. We have no objection to the project provided our recommendations are included as permit conditions.
