Dear Mr. Warren:
You have our approval to place fill material less than 0.1 acres of wetlands or waters for the
purpose of house and driveway construction at lot 62, Bluewater Banks subdivision, as you described
in your application dated 9 February 1995. After reviewing your application, we have decided that this
fill is covered by General Water Quality Certification Number 2733. This certification allows you to
use Nationwide Permit Number 18 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. Fill
shall be restricted to areas near the house and driveway with the house siting located as close to the
eastern setback as possible to minimize wetland fill. In addition, you should get any other federal,
state or local permits before you go ahead with your project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401

RECOMMENDED CONDITIONS OR PERMIT RESTRICTIONS: That wetland fill be
restricted solely to the house footprint and driveway and that the project be done in such a
manner so as to not cause turbidity outside the immediate construction area to exceed 25 NTU.
The proposed house should be moved over as far toward the minimum building setback on the
western side of the property, utilizing more upland area. The driveway should also be relocated
further to the western side of the property, thereby reducing wetland fill as much as possible.

PROJECT SUMMARY: The applicant is proposing to fill a 404 wetland area in order to construct a
house and driveway at lot #62 in the Bluewater Banks Subdivision.

9. NARRATIVE DESCRIPTION: The applicant is the agent for a property owner who
owns an approx. 23, 848 ft2 lot (#62) in the Bluewater Banks Subdivision located on
Bay Drive and off NC Highway 24, between Gales and Board Creek, in Carteret
County. The property is located on the north side of Bay Drive but is within the 575'
wide Estuarine Shoreline Area of Environmental Concern (AEC) adjacent to the
Outstanding Resource Waters of Bogue Sound. A Major CAMA Permit (56-89) was
issued to the original developer of Bluewater Banks Subdivision which authorized the
construction of a community boat ramp and pier system into Bogue Sound as amenities
to the 68 lot subdivision. The designation of this area of Bogue Sound as Outstanding
Resource Waters occurred after the CAMA permit was issued.
The applicant is requesting a permit to fill an approx. 3,575 ft2 area of 404 wetlands
which exist on the west side of lot #62. The wetland area consist of wax myrtle,
loblolly pine, sweet bay, holly, red maple, etc.. The remaining portion of the lot has
been identified as high ground and is vegetated primarily by pines. Once the lot has
been cleared and filled, a residence with associated driveway and septic tank will be
placed upon the property. The applicant has indicated that built upon surfaces will
amount to approx. 2,829 ft2 or 11.9% lot coverage. The adjacent properties to the east
and west have been developed with single-family residences. The property borders a
man made pond on the north.
10. ANTICIPATED IMPACTS: The project as proposed will result in the filling of
approx. 3,575 ft2 of 404 wetlands within the Estuarine Shoreline AEC of Bogue Sound
(ORW). A proposed residence and associated drive will create approx. 2,829 ft2 of
built upon surfaces of the lot which represent approx. 11.9% of the total lot. The
applicant has applied to the US Army Corps of Engineers for a Nationwide Permit and
to the NC Division of Environmental Management for a 401 Water Quality
Certification for authorizations to fill this wetland area.

A copy of the deed (with state application only) or
other instrument under which the applicant claims title to
the affected property. If the applicant is not claiming to
be the owner of said property, then forward a copy of
the deed or other instrument under which the owner
claims title, plus written permission from the owner to
carry out the project.
An accurate work plat (including plan view and
cross sectional drawings) drawn to scale in black ink on
an 8 1/2 by 11 white sheet. (Refer to Coastal Resources
Commission Rule 710203 for a detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if 24 high
quality copies are provided by applicant. (Contact the US
Army Corps Of Engineers regarding that agency's use of
larger drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to guide
agency personnel unfamiliar with the area to the site.
