After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2665. This certification allows you to use Nationwide Permit Number 13 or its equivalent when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. PROJECT SUMMARY: The applicant is proposing to perform maintenance excavation within an existing canal and to construct docks, a boat ramp and a replacement bulkhead at and adjacent to the Showboat Motel located on Morehead Avenue, in the Town of Atlantic Beach. FIELD INVESTIGATION REPORT: SHOWBOAT MOTEL PAGE #2 9. NARRATIVE DESCRIPTION: The applicant owns an approximately 1 acre tract of land located on the east side of Morehead Avenue in the Town of Atlantic Beach. The property is situated at the intersection of Bogue Sound and a man-made canal and is bordered on the north by the Channel Marker Restaurant and on the south by a jet-ski rental business. The property has been developed into a two story, 44 room motel known as The Showboat. Except for an approx. 85' wide x 120' long grassed lawn area located on the southernmost portion of the property, the entire site is covered with impervious surfaces. The property has been bulkheaded but no piers have ever been constructed into the adjacent water body. The bulkhead is in need of major repairs but is structurally intact. The shoreline along the canal upstream from this property has been intensity developed over the years with an assortment of different land uses. The western shoreline of the canal (the area adjacent to Morehead Avenue) is primarily commercial with a large number of marina and docking facilities and other commercial businesses having been constructed in the area over the years. The shoreline on the western side of the canal has been developed as residential and a number of piers have been constructed into the canal's waterway. The minimum width of the canal in front of the applicant's property has been established as 165' by a registered land surveyor. Water depths in the area range from -.2' to -6.5' mean low water (MLW) deep. The waters of the canal and the area of Bogue Sound in front of the applicants property have been classified as SA and are closed to the harvesting of shellfish. There are scattered amounts of oysters located in the area adjacent to the bulkhead. The applicant is requesting a permit to perform maintenance excavation in Bogue Sound and in the existing canal and to construct a replacement bulkhead, a boat ramp and a series of docks and platforms. Plans included with the application show that an approximately 350' long x up to 70' wide area is proposed to be excavated to -5.7' MLW deep. The excavation is proposed to be accomplished by the use of a dragline with the spoils being hauled off site. A 452 linear foot wooden bulkhead is proposed to be positioned an average of 2' waterward of the existing structure. Waterward of the new bulkhead, a 6' wide parallel dock is proposed except at the northern end. At this location, the dock will be enlarged to an approx. 55' long x up to 28' platform. A series of finger piers and associated mooring pilings will extend perpendicular from the pier into the canal. The mooring pilings would be located approx. 55' waterward of the existing mean high water line. The applicant is also proposing to construct an approx. 36' long x 6' wide "fishing" pier which would have a 40' long x 8' wide "L' shaped platform at its waterward end. Along the southern portion of the applicant's property, an approx. 14' wide x 30' long boat ramp is proposed. The proposed boat ramp would extend a maximum distance of 15' below the mean high water line. Two 40' long x 4' wide docks would be located on either side of the ramp to provide for the temporary loading and unloading of boats using the facility. The applicant has indicated that the docking facility has been designed to accommodate only 10 boats. FIELD INVESTIGATION REPORT: SHOWBOAT MOTEL PAGE #3 10. ANTICIPATED EWFACTS: The project as proposed will result in the maintenance excavation of approx. 14,000 ft.2 of bottom area with approx 1,300 cubic yds. of primarily sandy material being removed. Included in the excavation area are scattered amounts of oysters which could easily be relocated to a suitable area near by. A portion of the excavated material will be used for backfill behind the proposed bulkhead with the rest being hauled away. The bulkhead placement will require approx. 1,000 ft.2 of shallow water bottom area being filled with approx. 100 cubic yds of material being placed below the mean high water (MHW) line. The remaining spoil material is proposed to be hauled off the site. The proposed boat ramp will cause approx. 210 sq.2 of bottom area below the MHW line to be filled with approx. 3 cubic yds of concrete material. Approx 210 sq.2 of highground would also be sloped, graded and filled with concrete. The proposed docks, platforms and boat mooring areas will encompass a "footprint" of approx. 16,000 ft.2. The mooring pilings and fishing pier will extend out into the waters of the canal and Bogue Sound for a distance of approx. 55' to 68' beyond the existing MHW line. This would result in some of the pilings being located one-third the width of the canal and would increase the congestion of boats maneuvering in the area. (A residential pier is located directly across the canal and extends into the canal for approx. one-third its width.) Large boats docking in the slips could compound the situation since the vessels could extend beyond the mooring pilings. The mooring pilings would, however, be in line with an adjacent marina facility located approx. 125' upstream of this property and boat congestion already exists in upstream areas. The applicant has indicated that the docking facility is designed for only 10 boats. Because of the large slips being proposed (approx. 19' wide x 40' long), it can be assumed that motel guests with trailerable boats will not dock within the dedicated mooring spaces. Temporary docking spaces could be provided adjacent to the parallel dock along the northern portion of the property. The applicant has also indicated that the proposed platform on the northern property line is to allow for the perception of a, "straight" shoreline. It is not anticipated that the addition of these docking facilities will result in any additional closures of adjacent open shellfishing waters. The mooring pilings would, however, be in line with an adjacent marina facility located approx. 125' upstream of this property and boat congestion already exists in upstream areas.
