Your application for a Water Quality Certification under Section 401 of the Federal Clean
Water Act was received by the Division on 26 January 1995. The activity for which the
Certification is sought is to fill 2.35 acres of the open water and adjacent wetlands of Town
Creek for future marine development. A Water Quality Certification is a determination by
the Division that the activity for which the federal permit or license is sought is not expected
to result in a violation of state water quality standards for the waters of the state.
After an on-site inspection of your property, my staff has determined that existing uses
are present in the wetlands for which you have requested a certification. These uses include
aquatic life use notably fish and shell fish use. As provided by 15A NCAC 2B .0109, the
404(b)(1) Guidelines are used as guidance in determining if a proposed project will remove
the existing uses of a wetland. In accordance with these guidelines the Division has
determined that the subject project is not water dependent and that you have not demonstrated
that practicable alternatives to the proposed project cannot be constructed in an upland area.
Therefore I am hereby notifying you that the subject project would result in a violation of
15A NCAC 2B .0201(b). Therefore, in accordance with 15A NCAC 2H .0504(e), I have
determined that the 401 Water Quality Certification for this project shall be denied.

The Division of Environmental Management, Water Quality Section has reviewed your plans
for the discharge of fill material into 2.35 acres of waters and/or wetlands located at Turner Street and
Town Creek in Carteret County for future development. Based on this review, we have identified
significant uses which would be removed by this project. These uses are aquatic life use notably fish
and shellfish use. Furthermore, insufficient evidence is present in our files to conclude that your
project must be built as planned in waters and/or wetlands. Therefore, we are moving toward denial
of your 401 Certification as required by 15A NCAC 2B.0109. Until we receive additional
information, we are requesting (by copy of this letter) that the U.S. Army Corps of Engineers and/or
the N.C. Division of Coastal Management place your project on administrative hold.
Please provide us with information supporting your position that your project must be
constructed as planned and that you have no practicable alternative to placing fill in these waters
and/or wetlands. Specifically can you construct your development on nearby uplands or prior
converted farmland? Any documentation with site specific plans to justify this fill of open water such
as maps and narrative that you can supply to address alternative designs for your project may be
helpful in our review of your 401 Certification. Please respond within two weeks of the date of this
letter by sending a copy of this information to me and one copy to our Mr. Jim Gregson at the
Wilmington Regional Office at 127 Cardinal Drive, Extension, Wilmington, N.C. 28405-3845. I can

9. NARRATIVE DESCRIPTION: The applicant has obtained permission from a
riparian property owner to apply for state and federal permits to fill 2.35 acres of
Town Creek. This property owner received an easement to fill this area from the
Department of Administration in 1965 but never started the project. The easement is
written so that it remains in full force and effect until such time as the filling operation
is completed.
The specific location of the project site is immediately adjacent to Turner Street and
just south of the intersection of Turner Street and the West Beaufort Road. The
northern extend of the site is located just south of a series of culverts under Turner St.
which serves as the only upstream drainage outlet for Town Creek. A portion of the
right-of-way of Turner Street within the project area has eroded away and is now
located below the mean high water (mhw) line. Along the northern end, the road
shoulder has been stabilized with varying amounts and types of rip rap materials. The
southern portion of the right-of-way is not stabilized and consists of upland grasses, cat
briars and wetland vegetation consisting of spartina patens, borrichia frutescens (sea
ox-eye), spartina alterniflora, etc. The easement area is located entirely below the
mean high water (mhw) line and includes an approx 0 to 40' border of spartina
alterniflora marsh which runs parallel to Turner Street. Varying amounts of debris
have accumulated in the wetlands and shoreline areas ranging from large wooden
pilings and timbers to plastic debris. Waterward of the vegetated wetlands, a fairly
wide (approx. 100' wide) intertidal area exists. A portion of this intertidal area
consists of an oyster rock and large amounts of live and dead oyster shells exist
throughout the project area. The whole area is also littered with broken glass and
bottles. Directly waterward of the mean low water (mlw) line, the dredged edge of a
federally authorized Harbor of Refuge is located. The waters of Town Creek have
been classified as "SC" waters and are closed to the harvesting of shellfish. Besides
oysters, some portions of Town Creek have been noted for substantial quantities of
clams but it is not known whether any exist at this location. A number of large
marinas have been permitted in Town Creek downstream of this location and nearby
land uses are residential, commercial, public and transportation related (airport and
roadways). The Town of Beaufort has received permits over the years to maintain
several drainage ditches which empty into the upper ends of Town Creek above the
project site. The Town has recently submitted an application request to maintain 5 of
these drainage ditches.
The applicant is requesting a permit to rip rap and fill the easement area in Town
Creek which was approved by the Department of Administration in 1965. The area to
be filled measures 790' long adjacent and parallel to the road right-of-way and 732'
long in Town Creek. The width of the fill below the mean high water line is approx.
130'. The majority of the area to be filled is intertidal except at the western end where
the federal harbor of refuge is located. Water depths are up to -6.9' mlw within this
area. The filling activities will eliminate approx 8, 225 ft.2 of spartina alterniflora
which fringes the shoreline and approx. 500 ft.2 of wetland areas above the mhw line.
The applicant is proposing to construct an approx 20' wide (base width) rip rap
retaining structure on the perimeter of the easement area to contain the fill material.
All together, approx 2.6 acres will be filled by the proposed activities. The applicant
has indicated that no immediate plans for the development of the property exist and has
therefor not included any "upland" information except for showing a grassed swale
which would be provide adjacent to the highway right of way. The terminal end of the
swale would be in an existing ditch located outside of the project area. The Town of
Beaufort has zoned the adjacent land area as R-8 which allows for the construction of
single family dwellings on a minimum lot size of 8,000 ft. 2. It is reasonable to
assume that the applicant would request a rezoning to allow for non-residential uses.
10. ANTICIPATED IMPACTS: The project as proposed will result in the filling of
approx. 2.35 acres of intertidal and subtidal habitat of Town Creek for a non water
dependent use. Included in this figure is approx. 8,225 ft.2 of spartina alterniflora
vegetation. Wetland areas above the mhw line (approx. 500 ft. 2) would also be
impacted by the filling operation. Approx. 7,600 cu yards of fill material would be
placed below the mhw line and confined behind a rip rap structure and approx. 18, 800
cu. yards of material would be used to increase the elevation of the site to at least the
height of the adjacent roadway. The site would be graded so that runoff would be
directed to a grassed swale ditch which parallels the roadway and terminate in an
existing ditch. The project would destroy a portion of an oyster rock and scattered
amounts of live oysters growing along the shoreline area. It is not know whether any
clams would be impacted. A small portion of a federally authorized harbor of refugee
would also be filled. The filling of the area immediately adjacent to the culverts under
Turner Street could impact the existing drainage channel which has been "cut" into
Town Creek by causing the drainage pattern to be re-routed north. This could further
impact adjacent vegetated wetland areas. Without additional measures being
undertaken, turbidity levels in Town Creek would be significantly higher during the
filling operation and could adversely effect adjacent estuarine resources. The future
use of the project area is not known but the area is currently under a residential zoning
district. Depending upon the use, future upland development could impact a number of
different resources depending on the type and intensity of use. One potential impact
could be to the flight approach4ay of the Michael J. Smith Field Airport which is
located just north of the project.

instrument under which the applicant claims title to the
affected property. If the applicant is not claiming to be
the owner of said property, then forward a copy of the

U.S. Army Corps of Engineers regarding that agency's
use of larger drawings.) A site or-location map is a part
of plat requirements and it must be sufficiently detailed
to guide agency personnel unfamiliar with the area to the

Dear Mr. Wright:
The purpose of this letter is to supply additional information
as requested in your letter to the undersigned dated February 9,
1995. As you are aware from the documents submitted with the
application, I am the agent for Ruth Walker, the owner of an
easement from the State of North Carolina dated September 2, 1965,
as recorded in Book 264, Page 268, Carteret County Registry. This
easement covers the 2.35 acre tract in question and specifically
authorizes Ruth Walker to fill in the navigable waters adjoining
land owned by Ruth Walker.
The area in question is polluted and is closed to
shellfishing. In 1965 Ruth Walker and the Department of
Transportation entered into an agreement which permitted Ruth
Walker to encroach upon the right of way for Turner Street in order
to fill in the perimeter of the subject property with dirt. The
plan at that time was to dike the perimeter of the 2.35 acre tract
with dirt and to then backfill using the spoils from the dredging
of the Town Creek Harbor of Refuge. Obviously, the diking and fill
were never accomplished and the current application using rip-rap
will minimize the impact on adjoining waters and wetlands. The use
of rip-rap would greatly reduce the amount of soil and dirt
discharged into adjacent waters and would stabilize the shoreline.
With regard to paragraph A of your letter, the easement to
fill issued in 1965 speaks for itself. There is no upland
alternatives to the proposed work as the proposed work simply
proposes to fill the easement area in accordance with the 1965
easement. The use of rip-rap will be the least damaging to the
water or the wetland areas.

With reference to paragraph B, the 1965 agreement with the
Department of Transportation allowing Ruth Walker to encroach in
order to dike the perimeter of the 2.35 acre tract also provides
that the Department of Transportation would be given an additional
20 feet of right of way on the 2.35 acre side of Turner Street upon
completion of the fill. The use of closely compacted stone and
riprap will minimize the amount of fill which could escape into
adjoining waters and minimize the adverse impact. Any additional
construction techniques or requirements as imposed by any permit
issued by the U. S. Army Corps of Engineers or the office of
Coastal Management would be complied with.
With regard to paragraph C and in mitigation of the
unavoidable loss of waters or wetlands, Ruth Walker owns a 225 acre
tract of marsh and uplands in the North River. Ruth Walker would
be willing to transfer title to 75 of these acres to the State of
North Carolina as mitigation. The North River tract is not
polluted or closed to shellfishing as compared to the 2.35 acre
tract on Turner Street.

The Department of Environment, Health and Natural Resources hereby gives public
notice as required by NCGS 113A-119(b) and 143-215 3(a)(1)(c) that Wallace Garner of
Carteret County, filed an application on January 6, 1995, for a permit from the Division of
Coastal Management to develop in an Area of Environmental Concern and for certification
from the Division of Environmental Management that a discharge of fill material in project
wetlands will not violate applicable water quality standards.
According to said application, the applicant is proposing to fill 2.35 acres of Town
Creek for future development at a site adjacent to Turner Street, in the Town of Beaufort,
Carteret County.
A copy of the entire application and additional information may be examined (or
copies furnished upon request and payment of reproduction costs) during normal business
hours at the office of Charles Jones, Division of Coastal Management, located in the
Division of Marine Fisheries Building, Morehead City, N.C., (919) 726-7021, and/or the
office of Rick Shiver, Division of Environmental Management, DEHNR Regional Field

The Division of Environmental Management proposes to take final action on this
water quality certification on or before March 1, 1995. The issuance of the CAMA Major
Development permit and the Section 401 Certification may deviate from this projected date
depending upon the nature of the comments submitted and subsequent hearings that may
result.

9. NARRATIVE DESCRIPTION: The applicant has obtained permission from a
riparian property owner to apply for state and federal permits to fill 2.35 acres of
Town Creek. This property owner received an easement to fill this area from the
Department of Administration in 1965 but never started the project. The easement is
written so that it remains in full force and effect until such time as the filling operation
is completed.
The specific location of the project site is immediately adjacent to Turner Street and
just south of the intersection of Turner Street and the West Beaufort Road. The
northern extend of the site is located just south of a series of culverts under Turner St.
which serves as the only upstream drainage outlet for Town Creek. A portion of the
right-of-way of Turner Street within the project area has eroded away and is now
located below the mean high water (mhw) line. Along the northern end, the road
shoulder has been stabilized with varying amounts and types of rip rap materials. The
southern portion of the right-of-way is not stabilized and consists of upland grasses, cat
briars and wetland vegetation consisting of spartina patens, bonichia frutescens (sea
ox-eye), spartina alterniora, etc. The easement area is located entirely below the
mean high water (mhw) line and includes an approx 0 to 40' border of spartina
alterntflora marsh which runs parallel to Turner Street. Varying amounts of debris
have accumulated in the wetlands and shoreline areas ranging from large wooden
pilings and timbers to plastic debris. Waterward of the vegetated wetlands, a fairly
wide (approx. 100' wide) intertidal area exists. A portion of this intertidal area
consists of an oyster rock and large amounts of live and dead oyster shells exist
throughout the project area. The whole area is also littered with broken glass and
bottles. Directly waterward of the mean low water (mlw) line, the dredged edge of a
federally authorized Harbor of Refuge is located. The waters of Town Creek have
been classified as "SC" waters and are closed to the harvesting of shellfish. Besides
oysters, some portions of Town Creek have been noted for substantial quantities of
clams but it is not known whether any exist at this location. A number of large
marinas have been permitted in Town Creek downstream of this location and nearby
land uses are residential, commercial, public and transportation related (airport and
roadways). The Town of Beaufort has received permits over the years to maintain
several drainage ditches which empty into the upper ends of Town Creek above the
project site. The Town has recently submitted an application request to maintain 5 of
these drainage ditches.
The applicant is requesting a permit to rip rap and fill the easement area in Town
Creek which was approved by the Department of Administration in 1965. The area to
be filled measures 790' long adjacent and parallel to the road right-of-way and 732'
long in Town Creek. The width of the fill below the mean high water line is approx.
130'. The majority of the area to be filled is intertidal except at the western end where
the federal harbor of refuge is located. Water depths are up to -6.9' mlw within this
area. The filling activities will eliminate approx 8, 225 ft.2 of spartina altemiflora
which fringes the shoreline and approx. 500 ft.2 of wetland areas above the mhw line.
The applicant is proposing to construct an approx 20' wide (base width) rip rap
retaining structure on the perimeter of the easement area to contain the fill material.
All together, approx 2.6 acres will be filled by the proposed activities. The applicant
has indicated that no immediate plans for the development of the property exist and has
therefor not included any "upland" information except for showing a grassed swale
which would be provide adjacent to the highway right of way. The terminal end of the
swale would be in an existing ditch located outside of the project area. The Town of
Beaufort has zoned the adjacent land area as R-8 which allows for the construction of
single family dwellings on a minimum lot size of 8,000 ft. 2. It is reasonable to
assume that the applicant would request a rezoning to allow for non-residential uses.
10. ANTICIPATED V"ACTS: The project as proposed will result in the filling of
approx. 2.35 acres of intertidal and subtidal habitat of Town Creek for a non water
dependent use. Included in this figure is approx. 8,225 ft.2 of spartina altem flora
vegetation. Wetland areas above the mhw line (approx. 500 ft.2) would also be
impacted by the filling operation. Approx. 7,600 cu yards of fill material would be
placed below the mhw line and confined behind a rip rap structure and approx. 18, 800
cu. yards of material would be used to increase the elevation of the site to at least the
height of the adjacent roadway. The site would be graded so that runoff would be
directed to a grassed Swale ditch which parallels the roadway and terminate in an
existing ditch. The project would destroy a portion of an oyster rock and scattered
amounts of live oysters growing along the shoreline area. It is not know whether any
clams would be impacted. A small portion of a federally authorized harbor of refugee
would also be filled. The filling of the area immediately adjacent to the culverts under
Turner Street could impact the existing drainage channel which has been "cut" into
Town Creek by causing the drainage pattern to be re-routed north. This could further
impact adjacent vegetated wetland areas. Without additional measures being
undertaken, turbidity levels in Town Creek would be significantly higher during the
filling operation and could adversely effect adjacent estuarine resources. The future
use of the project area is not known but the area is currently under a residential zoning
district. Depending upon the use, future upland development could impact a number of
different resources depending on the type and intensity of use. One potential impact
could be to the flight approach-;Way of the Michael J. Smith Field Airport which is
located just north of the project.

An accurate work plat (including plan view and cross
sectional drawings) drawn to scale in black ink on an 8
1/2 x 11 white paper. (Refer to Coastal Resources
Commission Rule 7J.0203 for a detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if 18 high
quality copies are provided by applicant. (Contact the
U.S. Army Corps of Engineers regarding that agency's
use of larger drawings.) A site or-location map is a part
of plat requirements and it must be sufficiently detailed
to guide agency personnel unfamiliar with the area to the
site. Include county road (SR) numbers, landmarks, and
the like.
A stormwater management plan, if applicable, that
may have been developed in consultation with the
Division of Environmental Management.
A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners. These
individuals have 30 days in which to submit comments
on the proposed project to the Division of Coastal
