After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2745. This certification allows you to use Nationwide Permit Number 4 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that-you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. As discussed with you some time ago, we would like to use those headgates to make fish attractants in Lookout Shoals Reservoir. Their use as ballasts for fish trees will significantly reduce equipment rental costs, demolition time and generation of solid waste while allowing us to enhance the fishery. We have consulted with Chris Goudreau of the NC Wildlife Resources Commission regarding the location and placement of the three 20' x 20' x 3' concrete headgates. The headgates will be removed by divers, floated to the location shown in the attached sketches and then placed flat on the bottom. Fish trees will be constructed and attached in accordance with instructions from NCWRC. We would like verification that this project meets the requirements of Nationwide Permit #4 - Fish and Wildlife Harvesting, Enhancement, and Attraction Devices and Activities. Work is expected to begin in March of this year on the first headgate, with the remaining two to follow over the course of the next year. Attached are copies of the location drawings and a copy of the approval letter from the Wildlife Resources Commission. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). I have reviewed the map you enclosed with your April 4, 1994 letter showing the proposed location for the fish attractors. I am familiar with the proposed project and the habitat values of the project area. A site visit was conducted on June 21, 1993 with DPC representatives and Mr. Steve Chapin of the Corps of Engineers. I think that the highlighted area will be suitable for this work. I understand that the headgates will be positioned flat on the bottom, and anchors will be provided for attachment of fish attractors. The NCWRC does not object to the project as proposed. This ramp will be used only by Duke Power Company to perform maintenance to the intake structure at the hydro station. Maintenance in the immediate future will involve replacement of the headgates and creation of fish attractants as discussed with Chris Goudreau of the North Carolina Wildlife Resources Commission. (A permit application for the construction of the fish attractants will follow). The launch ramp will be constructed of rock and stone immediately upstream of the dam as shown in the attached drawings. Approximately 1370 cubic yards of material will be used in order to reach a 5 foot depth at the end of the ramp. This is the minimum possible launch depth for the barge. Due to the isolated location of the ramp little environmental impact is anticipated. Work is expected to begin immediately upon approval. Attached are copies of the associated drawings.
