Salisbury St. Raleigh, North Carolina 27604-1188 Dear Sirs: IFTWA 5'F E 3 EHNR January 6, 1995 Caldwell County DEM Project # 95007 FILE CON w You have our approval to place fill material in 0.022 acres of waters for the purpose of repairing an existing boat ramp at Gunpowder Boating Access Area on Lake Hickory, as you described in your application dated 20 December 1994. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2674. This certification allows you to use General Permit Number 030 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. Army Corps of Engineers Regulatory Branch Room 75, Grove Arcade Building Asheville, North Carolina 28801 SUBJECT: Application for General Permit 30 to repair an existing boat ramp at the Gunpowder Boating Access Area on Lake Hickory, Caldwell County Dear Mr. Chapin: The North Carolina Wildlife Resources Commission (NCWRC) is requesting a 404 permit from the U. S. Army Corps of Engineers for the above referenced project. By copy of this letter we are applying to the North Carolina Division of Environmental Management, Water Quality Section, for 401 certification. The Gunpowder Boating Access Area on Lake Hickory is jointly maintained by Duke Power Company (DPC) and the NCWRC. We plan to repair a 14' wide x 6" deep x 70' long concrete launch ramp by pouring new concrete on top of the existing ramp. The lower portion of the ramp will be poured into a form on high ground and allowed to cure before being pushed into the lake. The remainder of the ramp will be poured in place while the lake is drawn down. The portion of the ramp below ordinary high water will be 980 square feet in area or 18 cubic yards in volume. This letter also serves to meet the concurrence requirements necessary in certain trout counties. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). The site consists of an open water portion of the reservoir, which is controlled by DPC. Under normal operations, the annual water level fluctuation of Lake Hickory is 4 feet in elevation. Based on our information on the range of trout in the project area, we do not believe this project will impact waters supporting trout. No wetlands or habitats likely to support any endangered, threatened, or special concern species will be impacted.
