APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS

Dear Mr. Rickenbacker.
You have our approval to place fill material in 1.0 acres of wetlands or waters for the purpose of
constructing a road and parallel drainage ditches at SR 1304 near US 17, as you described in your
application dated 12 August 1995. After reviewing your application, we have decided that this fill is
covered by General Water Quality Certification Number 2671. This certification allows you to use
Nationwide Permit Number 26 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. The
ditch constructed perpendicular to the road shall be plugged with riprap or excavated material at
intervals no more than 200 feet for a length of at least 10 feet. In addition, you should get any other
federal, state or local permits before you go ahead with your project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401

Please find enclosed survey of ditches along side road and
map showing delineation of drainage ditches and drainage
patterns. As shown by the 1" = 400' there is approximately
10.4 acres of cleared land of which 4.1 acres was planted to
coastal bermudagrass and 6.3 acres of cropland. The natural
run that the cleared land drains through (wetland/woodland)
that leads to the constructed ditch that Mr. Rickenbacker
has an acreage of 10.5 acres.
The survey level work shows rod reading. The higher the
number the lower the elevation is, such as 8.0 is 2 feet
lower than 6.0 rod reading. As shown on survey the
northernly side of the road could drain to SR 1304 with a
fiat grade ditch. The southernly side of the road, the
ditch at the pipe in the road is 1.2 feet below the
elevation of the road ditch. This would be difficult to
drain to the state highway.

P Dear Mr. Rickenbcker:
I have completed the delineation of wetland on your farm. I
calculate 5.9 acres of wetland effected by the new ditches.
The map that is enclosed shows the areas that is effected by
the yellow highlight and red hash marks. The single red
lines are the wetland boundaries. The map also shows the
new ditches in blue and the road. An existing field ditch
on the north eastern side of your tract had affected the
hydrology on that side. The ellipse equation was used to
show this effect. With a three feet deep ditch in a Pantego
soil the effects would be 77 feet on either side of the
ditch. With a 4 feet deep ditch the effects will be out to
106 feet and a 5 feet deep ditch will be 140 feet on either
side of the ditch.
You will need to contact the US Fish and Wildlife Service on
endangered species and the State Historical Preservation
officer in regards to any historic properties.

As we discussed recently on the phone, please find enclosed a copy of 15A NCAC
2B.0109 which is the regulation I referred to in my 11 September 1995 letter, I have also
enclosed. a rough sketch which outlines a possible solution to the problems that your after-the-
fact permit application has raised for the 401 Water Quality Certification. The work could
involve a new pond constructed upslope of the unpaved road and restoration (filling in) of the
ditches above and below the pond to restore the wetland.

The Division of Environmental Management, Water Quality Section has reviewed your plans for the
discharge of fill material into 5.9 acres of waters and/or wetlands located at SR 1304, 1.1 miles north of U.S. 17
near Thomasboro Crossroads in Brunswick County for after-the-fact approval of a road and ditches to fill and
drain at total 5.9 acres of wetlands. Based on this review, we have identified significant uses which would be
removed by this project. These uses are water storage, pollutant removal via filtration and wildlife habitat.
Furthermore, insufficient evidence is present in our files to conclude that your project must be built as planned in
waters and/or wetlands. Therefore, we are moving toward denial of your 401 Certification as required by 15A
NCAC 2B.0109. As a reminder, unless a 401 Certification is obtained for this project, the 404 permit from the
U.S. Army Corps of Engineers is not valid.
Please provide us with information supporting your position that your project must be constructed as
planned and that you have no practicable alternative to placing fill in these waters and/or wetlands. Specifically
can you construct your development without installing the ditches thru the wetlands? As we discussed on the
telephone, the ditches remove the filtration use of the wetland. Measures to fill in and restore the ditch will
likely be required. Any documentation such as maps and narrative that you can supply to address alternative
designs for your project may be helpful in our review of your 401 Certification. Please respond within two
weeks of the date of this letter by sending a copy of this information to me and one copy to our Mr. Jim
Gregson at the Wilmington Regional Office at 127 Cardinal Drive Extension, Wilmington N.C. 28405-3845. 1

SUBJECT: Dr. and Mrs. Harry I.. Rickenbacker 401 Water Quality Certification for filling
and draining wetlands to improve access to property, near Thomasboro
Crossroads„ Brunswick County, North Carolina. DEM IA: 95736.
Staff biologists with the Wildlife Resources Commission have reviewed the subject
permit application. A site visit was made on August 8, 1995. Our comments are provided in
accordance with provisions of the Fish and Wildlife Coordination Act (49 Stat. 401, as amended;
16 U.S.C. 661 et. seq.).
The applicants have applied for what appears to be an atier-thc4hot Water Quality
Certif ication to drain and frill wetlands for development of an access road to a future home site,
agricultural lands and a cemetery. At the time of our site visit, ditches had already been dug and
the road constructed. A total of 5.9 acres of wooded wetlands including red maple, sweet gum,
sweet bay, swamp chestnut oak, gape and grcenbrier have been impaoted, mostly by drainage.
Site wetlands appear to have provided quality habitat for raccoon, mink, opossum and a variety
of songbirds. These wetlands also formed the headwaters of a Coweaw Swamp tributary,
retained and filtered stormwater runoff, and thereby protected downstream water quality.
So far as we can determine, the applicants have made no attempt to avoid, minimize or'
mitigate advcrtc impacts to wetlands. Therefore, we strongly recommend that certification be
conditioned to require at least partial restoration of lost wetland values and functions.

ReMradon should involve, as a minimum, backf illing or plugging the 2 lateral ditches that run
perpendicular to the access road. This will restore sonic of the site's original hydrology.
