EHNR August 2, 1995 Bladen County DEM Project # 95684 APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS Mr. Jimmy Vinson Brown's of the Carolinas 105 East College Street Warsaw, N.C. 28398 Dear Mr. Vinson: FILE Ctli , You have our approval to place fill material in 0.73 acres of wetlands or waters for the purpose of constructing a grain warehouse facility near NC 211 and SR 1179, as you described in your application dated 14 June 1995. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2671. This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. Applicant shall handle stormwater from this site by constructing a wet detention pond or by other means. Additional written DEM approval is needed before construction begins. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Environmental Management under Section 401 of the Clean Water Act. If you have any questions, please telephone John Dorney at 919-733-1786. The proposed project site is located off Hwy 211 and S.R. 1179, near the town of Bladenboro, Bladen County, North Carolina. The purpose of the proposed fill in wetlands is to facilitate the construction of a grain warehouse railway facility. The majority of the facility will be located in uplands, however, there are some isolated wetland pockets which must be impacted in order for the proposed facility to be developed. The applicant has considered other alternatives to placement of fill material within wetlands to accomplish their project goal, however, the proposed plan is the only practicable alternative available. Considering the proximity of the existing Seaboard Coastline Railway, and the availability of utilizing the existing rail for service, other alternatives considered were not practicable, considerably more expensive to the applicant, and involved even greater wetland impacts. The project has been designed to avoid and minimize potential adverse impacts to other wetland areas, and additional measures will be undertaken to maintain the work in strict conformance with all permit conditions pursuant to Nationwide Permit No. 26. ?V Please contact me at your convenience should you have any questions or comments regarding this request. erely, Mr. Gary A.
