You have our approval to place fill material in approximately 0.07 acre of wetlands or waters for
the purpose of installing a boat access on the Black River at approximately 1.3 miles north of the
junction of Hwy 210 and Hwy 1550, as you described in your application dated 31 May 1995. After
reviewing your application, we have decided that this fill is covered by General Water Quality
Certification Number 2733. This certification allows you to use Nationwide Permit Number 18 when it
is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401

Please reference DEM Project #95553. Y have received a
copy of the approval of 401 Water Quality Certification, dated
rune 79 1995. I am concerned that this application may warrant
a review due to the applicant's miscommunication of his
intentions.
In early June I had placed Mr. Peay's permit application on
indefinite hold, pending a wetland delineation. At this time I
have completed the delineation, had a meeting with the applicant
to discuss the Corps regulatory requirements, and continue to
withhold authorization pursuant to Nationwide Permit No. 18.
The wetlands which I observed on. Mr. Peay's property are
vegetated by bottom land hardwood forest. During site visits in
late rune and mid-July, I observed that the majority of the
wetlands were flooded.
Through recent conversations with Mr. Peay, I have learned
that his intention was to request authorization to excavate a 20'
by 1201 boat basin through wetlands which lie between the river
channel and high ground uplands, using natural topographic
relief to provide a boat ramp into the basin. It did, in fact, seem
that Mr. Peay's Joint Notification Form (PDN) requested
authorization for 0.02 acres of fill in wetlands to create a boat
access, rather than excavation.

It is my estimate that the proposed project would actually
require a nunimum excavation of 3,000 fl.' (0.068 acre) of 404
wetlands. Excavation of a boat basin would have a minimal
drainage effect on the wetland habitat because flooding would
not be prevented, nor would the water table be lowered.
I am prepared to issue Mr. Peay authorization to excavate
up to 0.10 acre of wetlands for his project if you will certify that
the project can also receive 401 certification in light of the
information I have provided. Please contact me with your
response, or if I may provide some additional information..
