of cons?ucting fish ponds at Hwy 17 near Thomasboro Crossroads, as you described in your
applica on dated 17 May 1995. After reviewing your application, we have decided that this fill is
covered by General Water Quality Certification Number 2671. This certi5caton allows you to use
N ation,p?ide Permit Number 26 when it is issued by the Corps of Engiaeers.
Th:s approval is only valid for the purpose and design that you described in your application. If
you chmge your project, you must notify us and you may be required to sew us a new application.
For this approval to be valid, you must follow the conditions listed in the at ached certification. In
additior; you should get any other federal, state or local permits before you co ahead with your
project.
If sou do not accept any of the conditions of this certification, ycru naay ask for an ad judicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27511-744.7. This certification and
its cond_tions are final and binding unless you ask for a hearinla.

SUBJECT: 401 Water Quality Certification Review for Mr. Charles Prichard's Proposed
Construction of a Warmwater Fish Pond in 404 Wetlands Adjacent to Little Caw-
Caw Swamp, near Thomasboro Crossroads, Brunswick County, North Carolina,
DEM ID: No. 95519.
Staff biologists with the North Carolina Wildlife Resources Commission (NCWRC) have
completed a review of the proposed project and evaluated possible impacts on fisheries, wildlife,
and wetland resources in the project area. An on-site investigation was made on June 13, 1995.
Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination
Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.), Section 401-b of the Clean Water Act of
1977 (as amended), and North Carolina General Statutes (G. S. 113-131 et seq.).
Mr. Charles Prichard is requesting permit authorization to place fill material in 404
wetlands adjacent to Little Caw-Caw Swamp for construction of a warmwater fish pond.
Placement of the fill material and excavation associated with the project will result in the
unavoidable loss of 3.79 ac of 404 bottomland hardwood wetlands. The pond will be used
primarily for commercial and recreational fishing purposes.
The project area consists primarily of farm land, interspersed with hardwood uplands and
404 jurisdictional wetlands. These wetlands provide numerous functions which benefit the
public as well as fish and wildlife. These functions include retention and purification of
stormwater runoff and provision of valuable habitat for numerous species of fish and wildlife.
These wetlands play a major role in the overall biological productivity of adjacent waters.
Due to the direct, unmitigated loss of wildlife habitat and stormwater retention capacity
associated with these wetlands, we find the proposal inconsistent with our Policies and
Guidelines for Conservation of Wetlands and Aquatic Habitat. It is the policy of this agency to

oppose projects which "displace, damage, or modify wetland values and functions". Therefore,
we request that a 401 Water Quality Certification not be issued for this project.

Dear John;
Enclosed is a Nationwide 26 Permit request by Charles Prichard of
Fleetwood, N.C. for 3.79 acres of wetland impact. Aquacultural
activities are planned for the proposed pond to provide cultured
fish for restocking in ponds in nearby areas of Brunswick County.
Total pond size will not exceed five acres including berm areas.
Total waterbody size will be 4.6 acres. A pond of 4.5 to 5 acres
is needed to justify the expence of setting up this type of
aquacultural operation. Anything smaller cannot economically
justify the expence of pond construction, well installation, and
personnel needed to maintain the operation. Mr. Prichard plans to
maintain 5000-6000 fish within this pond while growing from
fingerling to adult size before transferring to other ponds.

12. Description of proposed work (Attach PLANS-8 1/2" X 11" drawings only): Applicant proposes to impact
3.79 acres of wetlands. The proposed pond area will include 3.4 acres of excavation with .39 acres of berm area
to be created around the pond edge for pond maintenance and aauaculteral activities. Total proposed pond area
will be 5.0 acres (including berms) which includes removing .76 acres of existing uBRlands and incorporating two
exil ing small pond areas totaling .45 acres. Pond depth will average 10-12 feet deep to rep vent emergent aquatic
vegetation from becoming established and to contain a d= enough water column to prevent total pond
impacts. The entire site has had all loblolly pines removed for timber. Some hardwoods remain on-site, however it

12. Description of proposed work (Attach PLANS-8 1/2" X 11" drawings only): Applicant proposes to impact
3.79 acres of wetlands. The proposed pond area will include 3.4 acres of excavation with .39 acres of berm area
to be created around the and edge for pond maintenance and aguaculteral activities. Total proposed pond area
will be 5.0 acres (including berms) which includes removing .76 acres of existing uplands and incorporating two
existing small pond areas totaling .45 acres. Pond depth ? ?_ , ? crape 10-12 feet &Mto rep vent emergent aquatic
vegetation frombecoming established and to contain a d& enough water column to rea vent total and
temperatures from becoming too high in summer months. Water supply will consist of well water provided from
an well. A restrictive covenant will be R laced on the remaining 2.31 acres of wetlands to prevent future
impacts. The entire site has had all loblolly ip nes removed for timber. Some hardwoods remain on-site, however it
13. Purpose of proposed work: To rovide a 5.0 acre pond area including berms for the purpose of rowing out
5000-6000 fish to s=ly to local op nds in the Brunswick Coun area. The cultured fish will be freshwater
species including Larucmouth ass crappie, and catfish. Many of these fish are alrcady stocked in a pond the
needs thinning to rep vent die-off from overcrowding.
14. State reasons why the applicant believes that this activity must be carried out in wetlands. Also, note
measures taken to minimize wetland impacts. Existing wetland conditions on-site prohibit construction of a
pond of this size without excavation in wetland areas. Total tract acreage includes 8.1 acres of which 6.55 acres
are 404 wetlands. The 1.55 acres of existing _uplands are oddly shaped and present a challenge so for as use ili
is concerned for future housing or other uses regairing more than .2 - .3 acres. These 404 wetlands are found
above the headwaters point for this part of the Little Caw-Caw which has been channelized by timber companies
20+ years aggo. affecting the hydrology in many areas includingthis site).

RE: Nationwide Permit Application/3.79 Acres To Build Pond
Off of Highway 17 Near Thomasboro Crossroads/Brunswick County
Dear Mr. Pritchard:
The North Carolina Division of Coastal Management has reviewed the above-referenced application for a
Nationwide Permit dated May 19, 1995 pursuant to Section 307 of the Coastal Zone Management Act of 1972 as
amended. Based upon our review, we have determined that the proposed activity is consistent with the North
Carolina Coastal Management Program provided the following conditions are met:
1. The activity described in the above-referenced application qualifies to receive one of the Nation-
wide Permits described in 33 CFR Part 330 with the exception of Numbers 17, 21, 24, and 34
which were found inconsistent with the North Carolina Coastal Management Program.
2. A 401 Water Quality Certification is received, where required, from the North Carolina Division
of Environmental Management.
This letter does not relieve you of the responsibility to insure that all other State authorization and/or permit
