After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2668. This certification allows you to use Nationwide Permit Number 16 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. The edges of the proposed basin shall be rounded off to improve circulation. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. Attached RECONIlVIENDED CONDITIONS OR PERNIIT RESTRICTIONS: The applicant has submitted along with the application package an assessment of predicted dissolved oxygen (DO) concentrations in the proposed marina basin using the NCDEM Two Segment Marina Model. DO modeling is recommended by the Regional Office when two segment marina designs are proposed for marinas located away from inlets. The model predicted average summer DO concentrations in the basin to be 5.00 mg/1 using a ambient SOD of 2.6 and a tidal amplitude of 3.5 ft.. I ran the model using the full 4.2 ft. of tidal amplitude at the site with the same SOD values. The model predicted a basin DO concentration of 5.19 mg/1. Based on the models predictions, average summer DOs in the proposed basin should meet the State DO standard of 5.0 mg/1..However, flushing in the proposed basin could be further enhanced by rounding off the corners more to minimize stagnant areas and flaring the entrance channel more where it connects to the basin. Southport and Supply, in Brunswick County. The proposed project also includes a 100 slot dry-stack facility, a ships store with food service facilities, a lodging facility, a retail shops complex, a full service restaurant, a yacht club, and 89 multi-family residential units. 9, PRU MT DE,aCRmOI?I The project site is located adjacent to the Atlantic Intracoastal Waterway, within the existing St. James Plantation development, off NC Hwy 211, between Southport and Supply, in Brunswick County. The St. James Plantation Development includes over 7,000 acres, of which approximately one-fifth are developed. A St. James Plantation development plan submitted with this application, shows residential development oriented around three golf courses, one of which is complete. Currently, there is no CAMA Major Permit for the St. James Plantation development and their future development strategy is unknown. The applicant proposes to purchase a 35.9 acre tract, located adjacent to the AIWW, approximately one (1) mile west of BEavcr Dam Creel. The property's irregular shape. includes 1450 linear feet along the AIWW, and averages approximately 1200 feet in depth. The topography its relatively flat, ranging in elevation from 7 to 12 feet MSL. The property is wooded, predominately with Pond Pine, Red Maple, and Sweet Cum, with an understory of honeysuckle, wild cherry, wax myrtle, and yaupozn. Palmetto was also observed in the understory. There is a remnant dredge spoils disposal area, delineated by the old perimeter dike, in the southwest corner of the property. There are signs of recent excavation within the spoil area, indicating that the area has apparently served as a borrow site for fill material that has been used in the adjacent St. James Plantation. There are two large ditches that enter the property, one from the west, and one from the east. The consultants' for the applicant state, that the ditches are old USACOR ditches, from, when the area was utilized by the Corps for spoil disposal, This may be the case for portions of the eastern ditch, however, 1989 aerial photography shows extensive ditch and pond construction in conjunction with the St. James Plantation golf course. The eastern ditch has also been improved and maintained in recent years. The ditches are 8-10 feet deep, with 3:1 side slopes, vegetatively stabilized with Love Crass, creating a ditch top width of 40-60 feet. The western ditch terminates in a sediment pond, with piped overflow to the eastern ditch. At this intersection, the ditch turns south and terminates at an earthen dam and culvert, approximately 125 feet landward of the AIWW. Water flows through' the culvert into a lower ditch, which is tidal, and discharges to the waterway. The Brunswick County Soil Survey lists the following soil series in the project area: Newhan fine sand (dredged), Tomahawk loamy, fine sand, and Murville mucky, fine sand. Much of the area adjacent to the AIWW appears to be remnant dredge spoils from the construction of the waterway in the 1930's. There is a narrow, discontinuous coastal wetland fringe along the shoreline of the project area. This border is almost exclusively Smooth Cordgrass Martina gkQ0 o growing in patches, on the peat bank substrate, varying from several feet to. 45 feet in width. There are delineated °404 type" wetlands, primarily Phragmites and Eastern Baccharus, adjacent to the coastal wetlands, along the base of the steep embankment that transitions the shoreline to highground elevation. This embankment is 7-12 feet high, and over 20 feet high in the area of the old spoil area perimeter dikes. There are two small areas of "404 type" wetlands landward of the shoreline in the southeast corner of the property, and extensive wooded swamp wetlands west of the project site. There were slight differences between the USACQE approved wetland line and'the preliminary wetland delineation data used during project design. Addendum #1 illustrates the approved wetland delineation, and the applicants note that buildings B,C,K, and N would be moved sufficiently landward to accommodate the wetland line. The waters are OPEN to the harvest of shellfish. The waters are not designated as Primary Nursery Area, by the NC Division of Marine Fisheries. The applicant proposes to construct an inland maxim basin, in approximately the center of the 35.9 acre track The basin would be 610 feet long and 450 feet wide. It would be connected to the AIWW by an entrance channel, 500 feet long and 80 feet wide. The bottom of the marina basin would be constructed on a slight incline, from north to south, at a depth of -8 feet MLW to -10 feet MLW. The entrance channel depth would increase from -10 feet to -12 feet MLW, at it's intersection with the AIWW channel.The perimeter of the basin and entrance channel would be stabilized by a concrete sheet pile bulkhead. Since construction of the proposed basin would incorporate portions of the existing ditches and sediment basin, two new sediment ponds would be constructed just outside the property boundaries to receive water from the drainage ditches. The ponds would discharge through risers into an underground pipe/culvert, installed through the project site and bulkhead, and discharge into the basin. The applicant proposes to complete the majority of the excavation with mechanical equipment, while maintaining an. earthen plug between the construction and the waterway. Excavated material would be stockpiled adjacent to the basin, and then, after de-watering, used, as fill material around the project site. A hydraulic dredge would be used to dig the marina entrance channel, as well as, furnish the basin excavation after the removal of the earthen plug. Dredge spoils material from the hydraulic excavation would be pumped to an area in St. James Plantation just west of the project site. This area has been previously used for dredge spoil disposal, however, dikes and water control structures would have to be reconstructed and installed. A spoil area for future maintenance of the basin has been designated in the northwest portion of the property. The marina basin would service 188 wet slips. The slips would be arranged along a floating dock around the perimeter of the basin and along three docking piers extending into the basin from it's northern side. The slip arrangement would include finger piers and mooring pilings. The maxima would service boats up to 45 feet in length. A dry stack facility is planned adjacent to the southwest corner of the marina. The facility would accommodate an additional 100 boats. The eastern side of the property would consist almost entirely of asphalt parking area for the marina and drystack facility. The marina office and ship's store would be located adjacent to the northwest corder of the marina basin, and include bathrooms for the patrons, as well as, some type of food service. Fuel service would be provided at three locations in the marina, fuel docks at the dry stack and ship's store, and at the end of the eastern-most dock in the basin. Two areas of above ground fuel storage tanks, totaling 36,000 gallons, are planned for the western side of the property. Sewage pump-out facilities would be provided at the dry stack facility and the ship's store. Adjacent to the ship's store, along the northern side of the basin, a retail complex and a lodging facility ate planned. Wastewater designs indicate that the marina facilities would include; 60,000 square feet of available retail space, a 100 seat restaurant, a 60 room lon/motel, and a yacht club (100 members). Parking for this commercial area would be located adjacent on the northern perimeter of the property. To complete the development plan, 89 multi.-family 3- bedroom, residential units are proposed to be located around the southern and eastern perimeter of the property. Wastewater disposal (totaling 49,240 GPD) for the Marina Village project would be provided by St. James Plantation, which operates a wastewater package treatment plant, with subsurface, LPP disposal. The system was permitted by the N. C. Division of Health Services, and the applicant states that there is available capacity. St. James Plantation would also provide potable water to the Marina Village project, as well as, construct and extend roads to access the project. Another 5.12 acres of soil disturbance would be created during the construction and use of the spoil disposal area, west of the project site, as well as, an undetermined amount of ground disturbance during the construction and extension of roads and utWties from the adjacent St. James Plantation development. Construction of the marina entrance charmel would consume approximately 2345 square feet vegetated wetlands, 160 square feet of alter6Mm and 2185 square feet of Phragmites. An additional 8,000 square feet of shallow bottom in the ATWW would be excavated, connecting the, marina entrance channel to the waterway channel. The proposed project also includes a 100 slot dry-stack facility, a ships store with food service facilities, a lodging facility, a retail shops complex, a full service restaurant, a yacht club, and 89 multi-family residential units. 9. PROJECT DESCRIPTION The project site is located adjacent to the Atlantic Intracoastal Waterway, within the existing St. James Plantation development, off NC Hwy 211, between Southport and Supply, in Brunswick County. The St. James Plantation Development includes over 7,000 acres, of which approximately one-fifth are developed. A St. James Plantation development plan submitted with this application, shows residential development oriented around three golf courses, one of which is complete. Currently, there is no CAMA Major Permit for the St. James Plantation development and their future development strategy is unknown. The applicant proposes to purchase a 35.9 acre tract, located adjacent to the AIWW, approximately one (1) mile west of Beaver Dam Creek. The property's irregular shape. includes 1450 linear feet along the AIWW_, and averages approximately 1200 feet in depth. The topography is relatively flat, ranging in elevation from 7 to 12 feet MSL. The property is wooded, predominately with Pond Pine, Red Maple, and Sweet Gum, with an understory of honeysuckle, wild cherry, wax myrtle, and yaupon. Palmetto was also observed in the understory. There is a remnant dredge spoils disposal area, delineated by the old perimeter dike, in the southwest corner of the property. There are signs of recent excavation within the spoil area, indicating that the area has apparently served as a borrow site for fill material that has been used in the adjacent St. James Plantation. There are two large ditches that enter the property, one from the west, and one from the east. The consultants for the applicant state, that the ditches are old USACOE ditches, from when the area was utilized by the Corps for spoil disposal. This may be the case for portions of the eastern ditch, however, 1989 aerial photography shows extensive ditch and pond construction in conjunction with the St. James Plantation golf course. The eastern ditch has also been improved and maintained in recent years. The ditches are 8-10 feet deep, with 3:1 side slopes, vegetatively stabilized with Love Grass, creating a ditch top width of 40-60 feet. The western ditch terminates in a sediment pond, with piped overflow to the eastern ditch. At this intersection, the ditch turns south and terminates at an earthen dam and culvert, approximately 125 feet landward of the AIWW. Water flows through the culvert into a lower ditch, which is tidal, and discharges to the waterway. The Brunswick County Soil Survey lists the following soil series in the project area: Newhan fine sand (dredged), Tomahawk loamy, fine sand, and Murville mucky, fine sand. Much of the area adjacent to the AIWW appears to be remnant dredge spoils from the construction of the waterway in the 1930's. There is a narrow, discontinuous coastal wetland fringe along the shoreline of the project area. This border is almost exclusively Smooth Cordgrass (Spartina alterniflora) growing in patches, on the peat bank substrate, varying from several feet to. 45 feet in width. There are delineated "404 type" wetlands, primarily Phragmites and Eastern Bacchams, adjacent to the coastal wetlands, along the base of the steep embankment that transitions the shoreline to highground elevation. This embankment is 7-12 feet high, and over 20 feet high in the area of the old spoil area perimeter dikes. There are two small areas of "404 type" wetlands landward of the shoreline in the southeast corner of the property, and extensive wooded swamp wetlands west of the project site. There were slight differences between the USACOE approved wetland line and* the preliminary wetland delineation data used during project design. Addendum #1 illustrates the approved wetland delineation, and the applicants note that buildings B,C,K, and N would be moved sufficiently landward to accommodate the wetland line. The waters of the Atlantic Intracoastal Waterway, in the project area, are classified SA, by the NC Brunswick Harbor Marina Village Page '3 Division of Environmental Management. The waters are OPEN to the harvest of shellfish. The waters are not designated as Primary Nursery Area, by the NC Division of Marine Fisheries. The applicant proposes to construct an inland marina basin, in approximately the center of the 35.9 acre tract. The basin would be 610 feet long and 450 feet wide. It would be connected to the AIWW by an entrance channel, 500 feet long and 80 feet wide. The bottom of the marina basin would be constructed on a slight incline, from north to south, at a depth of -8 feet MLW to -10 feet MLW. The entrance channel depth would increase from -10 feet to -12 feet MLW, at it's intersection with the AIWW channel.The perimeter of the basin and entrance channel would be stabilized by a concrete sheet pile bulkhead. Since construction of the proposed basin would incorporate portions of the existing ditches and sediment basin, two new sediment ponds would be constructed just outside the property boundaries to receive water from the drainage ditches. The ponds would discharge through risers into an underground pipe/culvert, installed through the project site and bulkhead, and discharge into the basin. The applicant proposes to complete the majority of the excavation with mechanical equipment, while maintaining an. earthen plug between the construction and the waterway. Excavated material would be stockpiled adjacent to the basin, and then, after de-watering, used. as fill material around the project site. A hydraulic dredge would be used to dig the marina entrance channel, as well as, finish the basin excavation after the removal of the earthen plug. Dredge spoils material from the hydraulic excavation would be pumped to an area in St. James Plantation just west of the project site. This area has been previously used for dredge spoil disposal, however, dikes and water control structures would have to be reconstructed and installed. A spoil area for future maintenance of the basin has been designated in the northwest portion of the property. The marina basin would service 188 wet slips. The slips would be arranged along a floating dock around the perimeter of the basin and along three docking piers extending into the basin from it's northern side. The slip arrangement would include finger piers and mooring pilings. The marina would service boats up to 45 feet in length. A dry stack facility is planned adjacent to the southwest corner of the marina. The facility would accommodate an additional 100 boats. The eastern side of the property would consist almost entirely of asphalt parking area for the marina and drystack facility. The marina office and ship's store would be located adjacent to the northwest comer of the marina basin, and include bathrooms for the patrons, as well as, some type of food service. Fuel service would be provided at three locations in the marina, fuel docks at the dry stack and ship's store, and at the end of the eastem-most dock in the basin. Two areas of above ground fuel storage tanks, totaling 36,000 gallons, are planned for the western side of the property. Sewage pump-out facilities would be provided at the dry stack facility and the ship's store. Adjacent to the ship's store, along the northern side of the basin, a retail complex and a lodging facility are planned. Wastewater designs indicate that the marina facilities would include; 60,000 square feet of available retail space, a 100 seat restaurant, a 60 room Inn/motel, and a yacht club (100 members). Parking for this commercial area would be located adjacent on the northern perimeter of the property. To complete the development plan, 89 multi-family 3- bedroom, residential units are proposed to be located around the southern and eastern perimeter of the property. Wastewater disposal (totaling 49,240 GPD) for the Marina Village project would be provided by St. James Plantation, which operates a wastewater package treatment plant, with subsurface, LPP disposal. The system was permitted by the N. C. Division of Health Services, and the applicant states that there is available capacity. St. James Plantation would also provide potable water to the Marina Village project, as well as, construct and extend roads to access the project. Brunswick Harbor Marina Village Pag6 4 10. ANTICIPATED IMPACTS The proposed project would disturb 32 of the 35.9 acres of the project site, either by excavation of the marina basin or filling and grading associated with construction. Another 5.12 acres of soil disturbance would be created during the construction and use of the spoil disposal area, west of the project site, as well as, an undetermined amount of ground disturbance during the construction and extension of roads and utilities from the adjacent St. James Plantation development. Construction of the marina entrance channel would consume approximately 2345 square feet vegetated wetlands, 160 square feet of Spartina alterniflora and 2185 square feet of Phragmites. An additional 8,000 square feet of shallow bottom in the AIWW would be excavated, connecting the marina entrance channel to the waterway channel.
