Dear Sir and Madam:
Please reference the Cashiers Canoe Club Development, LLC, (Cashiers Canoe
Club) application for a Department of Army permit requesting authorization to impact
waters of the U.S. under Section 404 of the Clean Water Act (CWA). The proposed
impacts are associated with the Cashiers Lake Dredge and Development Project in
Cashiers, Jackson County, North Carolina.
In response to the United States Army Corps of Engineers, Wilmington District
(Corps), public notice for the above noted permit application, you previously submitted
written comments to our Asheville Regulatory Field Office. In your comments, you
expressed concerns about the effects the project will have on the environment. We
have made your comments part of the record for this application and will give them full
consideration along with all other comments received. Additionally, the Corps has
communicated with the applicant regarding all submitted comments.
Also, you requested the Corps to hold a public hearing for this application. We have
reviewed your request for a public hearing. There is sufficient information available to
fully evaluate the proposed regulated activities under the Corps' authority of the CWA
-and a public hearing would not provide additional information that is not already
available. Therefore, in accordance with federal regulations at 33 CFR 327.4, the Corps
has determined that a public hearing will not be held for this permit application.
It is noted that Cashiers Canoe Club applied to the North Carolina Division of Water
Resources (DWR) for a 401 Water Quality Certification, pursuant to Section 401 of the
CWA and Title 15A NCAC 02H .0500. On July 29, 2019, DWR issued a notice of public
hearing for this water quality certification request. The public hearing is to be held on
Thursday, September 5, 2019, at the Albert Carlton -Cashiers Community Library, 249
Frank Allen Road, Cashiers, North Carolina. Sign -in and speaker registration will begin
