This letter confirms the initial Interagency Review Team's (IRT) evaluation and
comments received during the June 20, 2019 Public Notice of your prospectus detailing
the addition of the wetland and stream mitigation site, known as the Juniper Tract, to the
Lower Cape Fear Umbrella Mitigation Bank (Bank). The proposed addition is an
approximately 782 -acre tract containing a 765 -acre main parcel and a 17 -acre adjacent
tract. The properties are located on the south side of Mill Creek Road SE, on the north
side of Danford Road, adjacent to Harris Swamp, Bolivia Branch, Hickman Branch, and
Mill Creek, east of Bolivia, Brunswick County, North Carolina. Also, please reference
the August 14, 2019 onsite meeting with your agents Messrs. Christian Preziosi and
Corey Novak of Land Management Group, Inc., along with IRT members Mr. Mac Haupt
of the North Carolina Division of Water Resources and Mr. Travis Wilson of the North
Carolina Wildlife Resource Commission, Ms. Erin Davis of North Carolina Division of
Water Resources, Mr. Todd Tugwell of The U.S. Army Corps of Engineers, and Ms. Kim
Browning of The U.S. Army Corps of Engineers.
Pursuant to 33 CFR Part 332.8(d)(5) Compensatory Mitigation For Losses of Aquatic
Resources, our office is providing our initial evaluation as to the potential of your
proposed Bank modification, or site addition, for providing appropriate compensatory
mitigation for activities authorized by Department of the Army (DA) permits.
Based on our review, coordination with the IRT, and the onsite inspection, it is our
position that the potential of the additional Bank site is contingent on several factors and
the need for additional information. As discussed onsite, these contingencies and/or
concerns are as follows:

1) Please provide additional information on the size of the drainage areas for each
stream restoration segment proposed.
2) The prospectus states that financial assurances will be 30% of construction
costs, which is not sufficient, please review Kimberly Browning's email dated
August 15, 2019 for additional information and requirements regarding financial
assurances.
3) Please identify reference wetlands to monitor, which you indicated you have on-
site.
4) Please identify reference headwater stream systems with similar soils and
drainage areas.
5) As discussed on-site, new Jurisdictional Determination is needed.
6) The enhancement areas where vegetation is not planned to be modified are
proposed at a 2:1 ratio, which may be too high given the current function of these
areas. The proposed 2:1 ratio may be more appropriate for areas where
vegetation will be enhanced.
7) There are concerns about whether the upper -ends of the zero -order tributaries
will develop stream characteristics. These proposed systems may be need to
start closer to the first order tributaries. This was discussed on-site and Christian
Preziosi indicated they would likely propose revised starting points for at least
two of the zero -order stream systems.
8) During the site visit, questions were raised regarding the proposed performance
standards and mapped soil types, clarification is needed to make sure they have
been proposing in accordance with the SAW 2016 guidance. Additionally, please
make sure the 2016 success criteria for zero -order systems area incorporated
into the proposal.
9) Please clarify the areas where vegetation restoration work is proposed.
10) Please integrate the 2016 tree vigor performance standards into the proposal.
11) Please provide additional information and analysis to address concerns about
potential future development outside and around the bank area (e.g. road
widening), and how you propose to address these concerns.
12) Please provide additional details about which roads on-site will be kept intact
and to what extent.
13) Please provide NC WAM forms for each wetland community type on-site.

should be considered and incorporated in your bank planning and development of the
