Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application:* On February 25, 2019, the North Carolina Superior Court for Bladen County entered a Consent Order (CO) among The Chemours Company FC, LLC (Chemours) and the State of NC and Cape Fear River Watch to address discharges of perfluoroalkyl and polyfluoroalkyl substances (PFAS) at the Chemours Fayetteville Works (the Site). Among other things, the CO requires Chemours to develop a remedial plan for reducing PFAS loading from Old Outfall 002 stream to the Cape Fear River. According to the Consent Order, by September 30, 2020, Chemours shall implement such measures to reduce PFAS loading from Old Outfall 002 to the Cape Fear River that will achieve results that are 99% effective in controlling indicator parameters [GenX and PFMOAA]. To meet this PFAS reduction, Chemours will construct an instream structure in Old Outfall 002 stream and a water treatment facility. The instream structure would create a small impoundment, and the water in this impoundment would be pumped to the new treatment facility, processed/treated, and the treated water would be released to the Cape Fear River. 4b. Explain the purpose of the proposed project:* Chemours will construct a water treatment facility and an instream structure in the Old Outfall 002 stream. The instream structure would create a small impoundment, and the water in this impoundment would be pumped to the newtreatment facility and eventually discharged back into the Cape Fear River. The instream structure would include a small weir that is armored with rip -rap upstream and downstream of the weir to prevent erosion in the stream channel during stormwater flooding and during backwater flooding from the Cape Fear River. Discharges below the ordinary high water mark (OHWM) will primarily be from rip -rap to protect the stream banks and the stream substrate (upstream and downstream) as water crosses the weir during stormwater events. During construction, a new haul road/access road will be constructed to the weir, and a water treatment facility Will be constructed in the uplands north of Old Outfall 002 stream. Temporary impacts would include construction of a temporary coffer dam and a small instream excavation upstream from the coffer dam to allow bypass pumping during construction of the instream weir. 4i. Describe the overall project in detail, including indirect impacts and the type of equipment to be used:* The primary discharge belowthe OHWM Will be both temporary and permanent during construction of the instream weir. The fill material will primarily be from rip -rap (592 cu yds above OHWM and 656 cu yds belowOHWM) to protect the stream banks and the stream substrate (upstream and downstream of the weir) as water crosses the weir during stormwater events or infrequently when Cape Fear River backwater crosses the weir. The concrete weir would add fill belowthe OHWM (130 cu yds above OHWM and 75 cu yds below OHWM). Although soil will not be added belowthe OHWM, there will be soil excavated from the area with 592 cu yds of soil + 3,170 cu yds of soil for roadway excavation (3,762 total cu yds of soil) above OHWM and 741 cu yds below OHWM. The soil will be excavated to create an access roadway to the weir and to grade, slope, and stabilize the stream channel and stream banks to prevent erosion, potential bank sloughing, and to reduce the potential for head cutting through the area. 4j. The weir is being constructed with concrete to minimize the footprint of the weir (i.e., an earthen berm and rip -rap would have had a much greater footprint and impact. 2.
