Preston Howard, Jr., P.E., Director RIPWAA?EHNR August 11, 1994 Wayne County DEM Project # 94737 APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS Mr. Ed Kosarek North Carolina Natural Gas 2205 Hwy 117-Bypass North Goldsboro, N.C. 27530 FILE Copy Dear Mr. Kosarek: You have our approval to place fill material in 0.05 acres of wetlands or waters for the purpose of drilling beneath Neuse River for gas pipeline exploration at Neuse River near SR 1007 and SR 1224, as you described in your application dated 5 August 1994. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2725. This certification allows you to use Nationwide Permit Number 6 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. Drilling fluid shall be properly disposed of i an upland site. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Environmental Management under Section 401 of the Clean Water Act. If you have any questions, please telephone John Dorney at 919-733-1786. This project involves drilling geotechnical borings within the river channel for a gas pipeline to be placed under the Neuse River. Information desired by our client is the total depth of sediment cover over hardened bedrock for the purposes of bidding and installation information. Please find attached to this letter, seven copies of the certification package with the necessary attachments including the site plan, proposed boring locations and a cross section of the proposed boring methodology. We have contacted the State Historic Preservation Office of the North Carolina Division of Archives and History by phone on August 4, 1994 and were directed to note in our cover letter that we have made the notification and should it be necessary, they would accept copies of the 401 certification and drawings for review and comment.
