APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS

Dear Mr. Adams:
You have our approval to place fill material in 0.53 acres of wetlands or waters for
the purpose of residential development at SR 2044 (St. Andrews project), as you described
in your application dated 22 May, 1994. After reviewing your application, we have decided
that this fill is covered by General Water Quality Certification Numbers 2664, 2735, and
2671. These certifications allow you to use Nationwide Permit Numbers 12, 14, and 26
when they are issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your
application. If you change your project, you must notify us and you may be required to
send us a new application. For this approval to be valid, you must follow the conditions
listed in the attached certification. An additional condition is that dead restrictions shall
be placed on all lots with jurisdictional wetlands to prevent additional fill (see attached).
In addition, you should get any other federal, state or local permits before you go ahead
with your project.
If you do not accept any of the conditions of this certification, you may ask for an
adjudicatory hearing. You must act within 30 days of the date that you receive this letter.
To ask for a hearing, send a written petition which conforms to Chapter 150B of the
North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box
27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and
binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under
Section 401 of the Clean Water Act. If you have any questions, please telephone John

The purpose of this letter is to request Nationwide Permits 12,14 and 26, and a
Section 401 Water Quality Certification for the project to be known as St.
Andrews. The project is located near Wake Forest, NC (Wake County) and is
bordered by SR 2044 Ligon Mill Road on the western boundary as shown on the
enclosed plans and vicinity map.
The Corps approved approximate wetland delineation is shown on the attached
map. The delineations of impact areas have been approved by Mr. Eric
Alsmeyer of the U.S. Army Corps of Engineers.
Fill in the wetlands will be required to construct roads and utility lines.
It will be necessary to fill.07 acres (see map) of jurisdictional wetlands above
headwaters for placement of some of the proposed driveways utilizing
Nationwide 26. An additional.18 acres (see map) will be filled for major road
crossings under Nationwide Permit 14. Road crossings are perpendicular to
wetland alignments, in order to minimize impacts. Utility line impacts total .28
acres.
To expedite the permitting process and to make "life easier" on everyone
involved, the following individuals/agencies have been provided with a
complete copy of this entire application package: U.S. Fish and Wildlife Service,
National Marine Fisheries, N.C. Cultural Resources, Karl Schaffer (DEM) and
David Franklin
(Wilmington Corps).
