After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2671. This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. You originally issued SAW26-90- 14, in December 1989 for 2.26 acres. Therefore authorized work must have been completed prior to January 13, 1993. Due to the "slow" real estate market in 1991 dim 1992 most projects have moved more slowly than expected. All previously authorized work has been completed except for a small amount in the Oaks Section of the project. Previous wetland delineations on-site had expired also. The current Corps approved wetland delineation of the Oaks is shown on the attached map. Figure 1 indicates the "old" wetland delineation while Figure 2 indicates the current delineation. The small wetland pocket originally authorized for impacts appears to have "mysteriously" moved from its original location nearby. This is noted for curiosity sake only, since the size and type of wedand has not changed. A completed Permit application form is attached as per current rules. Please note that die address of the permittee is different than on the original application because you now require die owners name not the consultant but the same group (Crosland Land Company) still own the undeveloped portion of the site. Fill in some of the Waters of the U.S. on-site will be required to utilize the property for a residential development including lots, roadways, etc. (See attached blueprint). There are no proposed changes in permitted square footage from the original permit. The attached blueprint indicates all impact sizes and locations as currently proposed in die undeveloped section. The areas and acreage to be impacted in the Oaks Section are shown on blueprints by Priest Craven Associates. We would like to note that the previous impacts were "1989 manual" delienations and probably show greater wedand acreage impacts than would occur under current rules. However, since the work has been complete there is no way to prove this. Please note that partial impacts in this area have occurred due to installation of a sewer line. It will be necessary to fill .25 acres (see map) of Jurisdictional Waters of the U.S. above headwaters for placement of the proposed Soil/Site Evaluation ¦ Mapping and Physical Analysis ¦ Wetlands Mapping and Mitigation ¦ Environmental Audits On-Site Waste Treatment Systei. , evaluation and Design facilities in the Oaks Section.
