Florida Ave. Suite 200 Tampa, FL 33613 Dear Mr. Camp: FILE COPY You have our approval to place fill material in 0.31 acres of wetlands or waters for the purpose of road crossing at SR 1733, SR 1716, SR 1625, and SR 1528 as you described in your application dated 9 May, 1994. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2732. This certification allows you to use Nationwide Permit Number 14 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. The project is located near Carpenter, NC (Wake/Chatham Counties) and is bordered by S.R. 1733, 1716, 1625 and 1628 as shown on the enclosed plans and vicinity maps. Wetlands were flagged and numbered in the field and located using GPS*. These delineations have been approved by Mr. Eric Alsmeyer of the US. Army Corps of Engineers. Mr. Alsmeyer and Mr. Ron Ferrel of DEM have previously visited parts of this project on several occasions over the last few years Fill in the wetlands will be required to utilize the property for golf course development, primary roads, and irrigation lakes (see attached map). Available uplands have been utilized as much as possible so that high quality wedands have been preserved. Road plans were moved and golf holes redesigned to minimize or avoid wedand impacts. Trees within.34 acre of wedand on hole #I8 will be hand cleared to avoid regulated impacts. It will be necessary to impact 1.30 acres (see map) of jurisdictional wetlands above headwaters for placement of the proposed facilities utilizing Nationwide 26. An additional .31 acre (see map) will be filled for road crossings under Nationwide Permit 14. Not all of the Nationwide 26 impact areas require filling of wetlands, .50 acre will be mechanically cleared and grassed, .50 acre will be filled, and the remaining .30 acre will be submerged (see map). 2.66 acres of stream channels are to impounded but are not considered adverse impacts. Similarly a.12 acre pond in the floodplain of Morris Branch will be submerged but was not included in the impact acreage. The main reason these are not considered impacts is that the streams (even the large ones) are dry in the summer and fall and therefore existing aquatic life is minimal. Vegetated and/or seasonally flooded (vernal pools) wetlands within the proposed lake areas are included as impacts since their functions would change due to lake construction. In addition to minimizing impacts to high quality wetlands, wedand and aquatic habitat will also be created, as the plans include the creation of two irrigation lakes totaling approximately 35 acres. 8.7 acres of open water currently exist on the Amberly project area in the form of eight farm ponds. Sod/Site Evaluation ¦ Mapping and Physical Analysis ¦ Wetlands Mapping and Mitigation ¦ Environmental Audits On-Site Waste Treatment Systems, Evaluation and Design However none of these ponds will be impacted during the phases of development addressed by this application. Only the golf course and major road construction impacts have been addressed in this application. Detailed plans for the residential pods surrounding the course have not been prepared at this time so impacts in these areas cannot be computed at this time. However the client realizes that these must be addressed prior to construction. It is anticipated that these areas can be developed with only minimal wedand impacts mainly due to internal roadways. I05 Raleigh, NC 276I5-6846 The purpose of this letter is to request Nationwide Permits 14, 26, and a Section 401 Water Quality Certification for the golf course, irrigation ponds, and primary roads phase of the project to be known as Amberly ( ± 110 acres). The project is located near Carpenter, NC (Wake/Chatham Counties) and is bordered by S.R. 1733, 1716, 1625 and 1628 as shown on the enclosed plans and vicinity maps. Wedands were flagged and numbered in the field and located using GPS*. These delineations have been approved by Mr. Eric Alsmeyer of the U.S. Army Corps of Engineers. Mr. Alsmeyer and Mr. Ron Ferrel of DEM have previously visited parts of this project on several occasions over the last few years Fill in the wetlands will be required to utilize the property for golf course development, primary roads, and irrigation lakes (see attached map). Available uplands have been utilized as much as possible so that high quality wetlands have been preserved. Road plans were moved and golf holes redesigned to minimize or avoid wedand impacts. Trees within .34 acre of wedand on hole #I8 will be hand cleared to avoid regulated impacts. It will be necessary to impact 1.30 acres (see map) of jurisdictional wetlands above headwaters for placement of the proposed facilities utilizing Nationwide 26. An additional .3I acre (see map) will be filled for road crossings under Nationwide Permit 14. Not all of the Nationwide 26 impact areas require filling of wetlands, .50 acre will be mechanically cleared and grassed, .50 acre will be filled, and the remaining.30 acre will be submerged (see map). 2.66 acres of stream channels are to impounded but are not considered adverse impacts. Similarly a .I2 acre pond in the floodplain of Morns Branch will be submerged but was not included in the impact acreage. The main reason these are not considered impacts is that the streams (even the large ones) are dry in the summer and fall and therefore existing aquatic life is minimal. Vegetated and/or seasonally flooded (vernal pools) wetlands within the proposed lake areas are included as impacts since their functions would change due to lake construction. In addition to nnnimizing impacts to high quality wetlands, wedand and aquatic habitat will also be created, as the plans include the creation of two irrigation lakes totaling approximately 35 acres. 8.7 acres of open water currently exist on the Amberly project area in the form of eight farm ponds. Soil/Site Evaluation ¦ Mapping and Physical Analysis ¦ Wetlands Mapping and Mitigation ¦ Environmental Audits On-Site Wass, Treatment Systems, Evaluation and Design However none of these ponds will be impacted during the phases of development addressed by this application. Only the golf course and major road construction impacts have been addressed in this application. Detailed plans for the residential pods surrounding the course have not been prepared at this time so impacts in these areas cannot be computed at this time. However the client realizes that these must be addressed prior to construction. It is anticipated that these areas can be developed with only minimal wetland impacts mainly due to internal roadways.
