Sorry for the confusion! I did not realize at the time which email I responded too. The extension was meant for both,
however I should have the responses pulled together at the beginning of next week. At this time you currently have all
of the information submitted. I will only be submitting any revisions or additional sheets based on David's comments
and the site visit, not an entire new package.

Hello Dee,
I'm trying to sort through all the emails regarding the Bridge St Basin & Phase 12 Dan River Outfall. They seem to be
somewhat mixed in with emails regarding the Junction Basin and Smith River siphon project and I want to be sure I have
everything in order. In this email you requested an extension to respond to David's request but I wasn't positive if your
request was for only the Junction Basin project as cited in the Subject line or for both projects since we did the JD for
both at the same time.
I received the formal 401 application for the Bridge St Basin & Phase 12 project as required and I don't want to spend
time on a detailed review if there is new/updated information to be submitted in response to our site visit and David's
request below, but I wanted to be sure that was the case and I wasn't delaying my review unnecessarily.

Hope you had a great 4th! I am following up regarding the rest of the comments that you provided as well as items that
were noted during the site visit with Sue and George. We are working on a response and would like to submit all of the
items at once rather than providing a piece meal submittal. Due to the additional wetlands survey and crossings that
need to be added would you be in agreement with us providing a complete response to you closer to the end of this
month?

This information does alleviate my concerns stated in my comment # 3 related to restricting or impeding the passage of
normal or high flows; this is primarily due to the 4 vertical feet of difference between the bottom of the channel and the
bottom of the sewer pipe. Thanks!

I have attached a separate drawing in reference to comment no. 3 below put together to assist with your review and site
visit tomorrow. This drawing is only showing the side of Kings Hwy with the aerial and includes the bottom of the ditch
in the profile. I have also included the referenced sequence sheet for the aerial crossing. We are eliminating the existing
aerial crossing closer to the Smith River and the proposed aerial crossing elevation is dictated entirely by the upstream
and downstream sewer.

Thank you for your PCN and attached information, dated and received 5/23/2019, for the above referenced project. I
have reviewed the information and need clarification before proceeding with verifying the use of Nationwide Permit 12
(Blockedhttp://saw-reg.usace.army.miI/NWP2017/2017NWP12.pdf <http://saw-
reg.usace.army.mil/NWP2017/2017NWP12.pdf> ). Please submit the requested information below (via e-mail is fine)
within 30 days of receipt of this Notification, otherwise we may deny verification of the use of the Nationwide Permit or
consider your application withdrawn and close the file:
1. Your PCN included impacts to streams and wetlands, however these and other potential jurisdictional boundaries
have not been verified by the USACE. A field verification site visit has been scheduled with Mr. George Lankford (agent)
on 6/26/2019 to verify the locations of potential waters of the US. Please note that revisions to the PCN and plans may
be necessary depending on the results of the field verification;
2. Plan Sheets 14-C1 and 15-C4 indicates that rip rap will be placed at stream crossings 14-S1 and 15-S2. If this rip rap
is to be placed below the ordinary high water mark of these streams, then we would consider the impacts permanent
rather than temporary. Although we would not typically consider these impacts to be a permanent loss of waters, we
need to ensure that any rip rap placed in the stream bed would not be placed above the existing stream bed grade.
Further, the impacts would need to be changed from temporary to permanent on the PCN;
3. Further, Plan Sheet 15-C4 indicates that stream crossing 15-S2 would be an aerial crossing, however the profile
view does not show enough detail to indicate whether or not the sewer line will be placed high enough to pass high
flows and therefore not disrupt the flow and circulation of waters of the US. Please indicate the clearance between the
bottom of the pipe and the stream bed at this location. Per NWP Permit 12 General Condition 9, please explain how this
crossing is constructed to withstand expected high flows, as well as how the activity meets the condition that it must not
restrict or impede the passage of normal or high flows, given that the primary purpose of the activity is not to impound
water or manage high flows.
4. Plan Sheet 14-C1 and others reference "DWG No. D9" in relation to the proposed stream crossing. However, this
drawing was not included in the PCN and attachments. Please provide any relevant detail sections and specifications,
including stream impact restoration and stabilization details, seeding specifications, pump around methodology, etc;
5. Given the proximity of known occurrences of Roanoke logperch and James spinymussel, as well as potentially
suitable habitat for the smooth coneflower within the project area, consultation is required with the USFWS pursuant to
Section 7 of the Endangered Species Act. It is our understanding that surveys for these species in coordination with
USFWS are ongoing, and the results of these surveys will be reported to the Corps and USFWS for further evaluation
during the consultation process. Please note that the Corps cannot verify the use of a NWP until Section 7 consultation is
complete.
