It will be necessary to impact about 5929 square feet (see map) of jurisdictional
wetlands for road crossings, utility lines, storm drains and lot impacts at the
Silver Creek Subdivision (see map). While some of the impacts meet the criteria
for Nationwide Permits 12 or 14, they can all be included in a Nationwide 26 as
no additional jurisdictional impacts are anticipated for this project. Previous
numbers used to track this project are DEM Project # 94067 and Action ID #
9501090. The previous wetland impacts totaled 0.10 acres for road crossings.
The proposed wetland impacts total 0.14 acres. The existing General Water
Quality Certification No. 2671 (correspondence dated February 3, 1994) already
covers impacts up to 0.33 acres under Nationwide 26.
The small amount of impact make it presumably not necessary to notify NC
Dept of Cultural Resources, National Marine Fisheries, or US Fish and Wildlife
Service. However, it is customary for S&EC to notify the Corps and DEM of our
intent to utilize a Nationwide Permit as a professional courtesy.
A copy of this notice has been sent to the Chief of the Regulatory Branch
(Wilmington Corps).

Upon review of your request for 401 Water Quality Certification
to place fill material in 0.33 acres of wetlands or waters which are
tributary to Kit Creek for road crossings located at Silver Creek
subdivision in Wake County as described in your submittal dated 21
January 1994, we have determined that the proposed fill can be covered
by General Water Quality Certification No. 2671. A copy of the
General Certification is attached. This Certification may be used in
qualifying for coverage under Corps of Engineers' Nationwide Permit
No. 26.
If this Certification is unacceptable to you, you have the right
to an adjudicatory hearing upon written request within thirty (30)
days following receipt of this Certification. This request must be in
the form of a written petition conforming to Chapter 150B of the North
Carolina General Statutes and filed with the Office of Administrative
Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. Unless such
demands are made, this Certification shall be final and binding.

The purpose of this letter is to inform you of our intention to
utilize a General 401 Water Quality Certification for the project
to be known as the Gallop property (Silver Creek Subdivision).
The property is located north of N.C. Hwy. 54 at the end of
Fairbanks Road. The only jurisdictional areas on-site are
channels which qualify as Waters of the U.S. and a small pond with
some associated vegetated wetlands. The jurisdictional areas are
along unnamed tributaries to Crabtree Creek.
Delineations in areas to be impacted were reviewed by Mr. Eric
Alsmeyer of the U.S. Army Corps of Engineers. Due to the small
size of the jurisdictional areas we do not believe it is necessary
to survey the proposed impact area in detail because it would be
an unjust cost for our client. Mr. Alsmeyer agreed with this
conclusion and authorized the work on-site. (See enclosed
Nationwide Permit Verification).
Fill in less than 1/3 acre of Waters of the U.S. on-site will be
required to utilize the property for a residential development,
specifically four road crossings over channels with no vegetated
wetlands. (See attached blueprint for approximate location.
The waters to be filled are contained within channels bounded by
uplands but still technically qualify as jurisdictional Waters of
the U.S. No other impacts to jurisdictional areas are currently
proposed.

We realize that our client is not required to notify you for fills
less than 1/3 acre above headwaters but we have chosen to do so
for the record and as a professional courtesy.
