4a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application:*
The project site consists of Long Creek which is a perennial stream and five perennial tributaries of Long Creek, including Dixon Branch. All of these streams are currently unstable and
incised. They are all situated within an urban environment and have been influenced by surrounding residential and commercial developments. Some of these influences include:
increased stormwater inputs, increased impervious surfaces, altered riparian buffers due to utility corridors, and increased invasive species. These influences have decreased the
stability of the streams causing increased erosion and an overall decrease in water quality and wildlife habitat for the watershed. The proposed project includes stream restoration of
Long Creek and Dixon Branch as well as portions of the unnamed tributaries along with installation of boardwalk and paved greenway. The greenway will be accessible from adjacent
neighborhoods and commercial centers.

The proposed Long Creek stream restoration project is a part of the Mecklenburg County Land Use & Environmental Services Agency (LUESA) initiative to improve water quality within
the county through improvement of degraded streams. The restoration efforts would stabilize Long Creek and several of its tributaries resulting in habitat enhancement within the
streams. The goals of the project are to improve in -stream habitat, enhance native riparian vegetation, and promote public awareness of water quality.
41. Describe the overall project in detail, including indirect impacts and the type of equipment to be used:*
Mecklenburg County Land Use & Environmental Services Agency (LUESA) has contracted Stantec Consulting Services, Inc. (Stantec) to provide services related to the restoration of
Long Creek and Dixon Branch near West W. T. Harris Boulevard and 1-77. Land Design has been contracted to provide services related to the design of the Long Creek Greenway to
run parallel to restored stream. Long Creek would be restored from 1-77 to approximately 1,300 feet downstream of the confluence with Dixon Branch and mould include stabilizing the
tributaries as they flow into Long Creek within this area. Dixon Branch will be restored from West W. T. Harris Boulevard to Long Creek. The restoration project would repair and stabilize
eroding stream banks and serve as a showcase project for the Mecklenburg County Parks and recreation concurrent with the Long Creek Greenway project. Proposed restoration
includes a combination of stream realignments and bank stabilization using the following construction methods: constructed riffles, log vanes, constructed runs, boulder steps, rock
steps and log steps. LandDesign has been contracted to provide services related to the design of the Long Creek Greenway which would run parallel to restored stream reaches and
would be constructed using a boardwalk and asphalt trail system. As shown on the attached plans, boardwalk wt11 be installed over the delineated wetland areas, in order to avoid
impacts to potential jurisdictional wetlands and asphalt would be used for the remaining upland areas. The greenway will utilize the floodplain culverts under Reames Rd and WWT
Harris Blvd for pedestrian access. Designs have been included with this application package to illustrate proposed impacts and avoidance areas.
A planting plan has been developed for the project to provide a natural succession following construction to the natural vegetative communities
within the project. The project was designed to preserve as many of the healthy trees as possible while avoiding and minimizing wetland impacts. Three zones have been created for the
project including: Zone 1 — Streambanks, Zone 2 —Piedmont Alluvial Forest (uplands), and Zone 3 — Wetland Forest. Following final grading, the site will be planted with native woody
shrub and tree species as per the specified zones. Streambanks (Zone 1) will be planted With native live stakes and shrubs. During construction and following final grading, the project
wd11 be seeded with a temporary seed mix to stabilize bare areas. Separate upland and wetland permanent seed mixes have been proposed.
The work will be completed predominantly via track hoes with hydraulic thumbs, front-end loaders, back hoes, and off road haul trucks.

Charlotte -Mecklenburg Storm Water Services and the County Parks Department plan on a second phase of the Long Creek restoration and greenway project. Preliminary plans are for
the greenway to continue from its current designed terminus near Dixon Branch to Primm Rd. However budget constraints could shorten the project to Beatties Ford. The stream
restoration length will depend on the condition of Long Creek and its tributaries in the area where greenway is proposed.

Similar to Long Creek Phase 1, the greenway project will avoid and minimize impacts to wetlands. The stream restoration would aim to improve aquatic life function.

The temporary stream impacts are associated with a temporary haul road that would be constructed in order haul material for the stream restoration
and greenway construction projects. The streams would be restored to pre -construction contours and the banks would be re -seeded and stabilized at
the completion of construction activities.
Approximately 124 linear feet of Stream 4 was recently realigned by the County in order to protect an exposed sewer pipe. Immediately following the
realignment the Corps project manager, David Shaeffer, was informed of the activity, the area was stabilized and the County was instructed not to do
any additional work at the site. In an email dated July 25, 2019, Mr. Shaeffer instructed Stantec that either an after the fact permit could be sought or
the stream could be restored and no additional permit would be required. Per the design plans included with this application Stream 4 is proposed to
be restored and stabilized including in -stream work.
E. Impact Justification and Mitigation t"
1. Avoidance and Minimization
1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project:
As this project is a stream restoration, stabilization and habitat enhancement project, it is impossible to completely avoid impacts to jurisdictional
waters. However, considerations were made to minimize disturbance to the extent necessary to provide appropriate functional uplift. Impacts to Long
Creek and its tributaries due to the
realignment were deemed necessary to address deficiencies in the dimension, pattern and profile of the channels. Efforts were made during design to
avoid the floodplain wetlands to the greatest extent practicable. As a result, most of the impacts to wetlands are temporary. Additionally, a boardwalk,
which would not have any fill associated with it, is proposed to be constructed as a part of the greenway.
1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques:
Typical sediment and erosion control measures will be implemented on site. Silt fence will be used to protect jurisdictional waters that will not be
impacted. Appropriately sized equipment will be utilized to prevent excessive compacting and minimize clearing. Construction scheduling and staging
will be timed to minimize the amount of time spent working in the stream channel. Pump arounds will be used to complete work in the dry to a feasible
extent for working in the creek. An Erosion and Sediment Control Plan application has been submitted.

The impacts associated with the proposed stream restoration project are intended to stabilize the streams, reduce erosion, and increase habitat within and along Long Creek and

diffuse flow plan requirement does not apply to this project.

North Carolina Natural Heritage Program occurrence data accessed - see attachment.
Stantec conducted a survey for potential suitable habitat for Michau)rs sumac, Schweinitts sunflower and smooth coneflower. Suitable habitat was not
located within the limits of disturbance for the project. The Carolina Heelsplitter is listed for Mecklenburg County but is not known to occur in the Long
Creek watershed or the adjacent watersheds. Suitable summer roosting habitat may be present in the study area for northern long-eared bat.
However, the final 4(d) rule exempts incidental take of northern long-eared bats associated with activities that occur greater than 0.25 miles from
known hibernation sites and greater than 150 feet form a known, occupied maternity roost during the pup season. Based on the natural heritage
occurrence data, these do not occur in or around the study area therefore incidental take that may result from construction is exempt under the 4(d)
rule.

found within the project area. No surveys have been completed on the site however this site has been continuously disturbed by urbanization and no
historical or cultural sites are expected to be found therefore this project would have no potential to affect historic or cultural resources.

Long Creek Greenway and Stream Restoration
A mechanized pile driver may be used to install the posts for the boardwalk. The boardwalk is located throughout
the project area and post installation will take place off and on during the 18-month anticipated construction
window.

The North Carolina Natural Heritage Program (NCNHP) appreciates the opportunity to provide information
about natural heritage resources for the project referenced above.
A query of the NCNHP database indicates that there are records for rare species, important natural
communities, natural areas, or conservation/managed areas within the proposed project boundary. These
results are presented in the attached ‘Documented Occurrences’ tables and map.
The attached ‘Potential Occurrences’ table summarizes rare species and natural communities that have been
documented within a one-mile radius of the property boundary. The proximity of these records suggests that
these natural heritage elements may potentially be present in the project area if suitable habitat exists and is
included for reference. Tables of natural areas and conservation/managed area within a one-mile radius of the
project area, if any, are also included in this report.
Please note that natural heritage element data are maintained for the purposes of conservation planning, project
review, and scientific research, and are not intended for use as the primary criteria for regulatory decisions.
Information provided by the NCNHP database may not be published without prior written notification to the
NCNHP, and the NCNHP must be credited as an information source in these publications. Maps of NCNHP
data may not be redistributed without permission.
Also please note that the NC Natural Heritage Program may follow this letter with additional correspondence if a
Dedicated Nature Preserve (DNP), Registered Heritage Area (RHA), Clean Water Management Trust Fund
(CWMTF) easement, or an occurrence of a Federally-listed species is documented near the project area.
