Based on this review, we have determined that the proposed fill is covered by General Water Quality Certification No. 2671. A copy of the General Certification is attached. This Certification is necessary for coverage under Corps of Engineers' Nationwide Permit No. 26. This action completes DEM's review under Section 401 of the Clean Water Act. Final written approval from DEM must be received for a stormwater management plan including a wet detention pond before construction begins. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. SA= the wet detention pond permanent pool surface area required to provide an expected 85% Total Suspended Solids removal. The chart is based on the amount of impervious cover as a percentage of the area draining to the pond and the depth of the permanent pool. Impervious percentages are in the left hand column of the chart and depths are given across the table from 3 feet to 6 feet in half foot increments. If needed, one can interpolate to find the SA/DA ratio that is needed in a particular case. To determine the required permanent pool size use the following steps: 1. Calculate the percent impervious cover of the site draining to the pond. amount of impervious area / total site area 2. Determine the permanent pool depth (or select a depth for comparison purposes). 3. Go to the above chart and find the number corresponding to the impervious percentage found above and the depth assumed. Authorization was provided, pursuant to Section 404 of the Clean Water Act, for discharges of dredged or fill material into headwaters and isolated waters. Your proposed work is authorized by this NWP provided it is accomplished in strict accordance with the enclosed conditions and provided you receive Section 401 water quality certification from the North Carolina Division of Environmental Management (NCDEM). The location of the referenced pond is partially located in the roadway section of Perimeter Park Drive, reference Attachment 'A'. The alignment of this road was established and approved by the Town of Morrisville in 1989. Approximately 750 lineal feet has presently been extending from Airport Boulevard. The relocation of the roadway outside of the pond area would impact the overall established roadway alignment and planned building adjacencies, i.e. the Building 1800 site plan has been approved and is presently under construction. A change in the road alignment would require a major change to this site plan. Secondly, in the planning of the first buildings within Perimeter Park West, a site plan was developed contemplating two (2) buildings of the same design to be located adjacent to each other on Lots 1 and 2 with a common rear parking area. The first of the buildings, known as 1100 Perimeter Park has been constructed and the rear parking area has been built to accommodate the second future structure, Building 1500. The second building is to be located on the eastern side of the .9 acre pond area with the front parking area programmed to be placed in the pond location. A copy of the general layout has been provided to further help for reference, Attachment 'B'. We would appreciate your further consideration of these adjacencies in your review of our request. The location of the referenced pond is partially located in the roadway section of Perimeter Park Drive, reference Attachment 'A'. The alignment of this road was established and approved by the Town of Morrisville in 1989. Approximately 750 lineal feet has presently been extending from Airport Boulevard. The relocation of the roadway outside of the pond area would impact the overall established roadway alignment and planned building adjacencies, i.e. the Building 1800 site plan has been approved and is presently under construction. A change in the road alignment would require a major change to this site plan. Secondly, in the planning of the first buildings within Perimeter Park West, a site plan was developed contemplating two (2) buildings of the same design to be located adjacent to each other on Lots 1 and 2 with a common rear parking area. The first of the buildings, known as 1100 Perimeter Park has been constructed and the rear parking area has been built to accommodate the second future structure, Building 1500. The second building is to be located on the eastern side of the .9 acre pond area with the front parking area programmed to be placed in the pond location.
