Box 1607 Wilson, N.C, 27894 fiLE COP\ Dear Mr. Benson: You have our approval to place fIll material in 1.51 acres of wetlands or waters for the purpose of residential fill at Jamestown Commons, as you described in your application dated 17 September 1993. Mter reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2671. This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers, This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification, An additional condition is that a stormwater pond must be built for this project as approved by DEM. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter, To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447, This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Environmental Management under Section 401 of the Clean Water Act. I was quite surprised to receive this letter. Based on our office meetings last fall and your site visit I was under the impression that you had no further objections to the impacts as proposed if stormwater treatment impoundments were designed for the commercial part of the project. In mid November 1993 we submitted a copy of the attached reports by Gilleece and Assoc. showing pond designs and calculations for the residential area south of White Oak Creek (Benson Tract 1) and for the Commercial/Residential area north of the Creek (Ashley Meadows) along with a copy of the Town of Cary Specifications utilized in the design as per your request. I apologize for not following up with you on this to see if it adequately addressed your concerns. Attn.: Mr. Frank Benson Post Office Box 1607 Wilson, North Carolina 2727894 Dear Mr. Benson: Reference your application of September 17, 1992, for Department of the Army authorization to discharge fill material within waters of the United States, causing the loss of a total of 1.55 acres of wetlands (0.04 for road crossings and 1.51 other) adjacent to, and above the headwaters of, White Oak Creek, for construction of the proposed Jamestown Commons residential/commercial development, west of Cary, Wake County, North Carolina. For the purposes of the U.S. Army Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits (NWP). Authorization was provided, pursuant to Section 404 of the Clean Water Act, for discharges of dredged or fill material into headwaters and isolated waters provided: a. The discharge does not cause the loss of more than 10 acres of waters of the United States; b. The permittee notifies the District Engineer if the discharge would cause the loss of waters of the United States greater than one acre in accordance with the "Notification" general condition. For discharges in special aquatic sites, including wetlands, the notification must also include a delineation of affected specific aquatic sites, including wetlands; and c. The discharge, including all attendant features, both temporary and permanent, is part of a single and complete project. Authorization, pursuant to Section 10 of the Rivers and Harbors Act of 1899 and Section 404 of the Clean Water Act, was also provided for fills for roads crossing waters of the United States (including wetlands and other special aquatic sites) provided: a, The width of the fill is limited to the minimum necessary for the actual crossing; -2- b. The fill placed in waters of the United States is limited to a filled area of no more than 1/3 acre. Furthermore, no more than a total of 200 linear feet of the fill for the roadway can occur in special aquatic sites, including wetlands; c. The crossing is culverted, bridged or otherwise designed to prevent the restriction of, and to withstand, expected highflows and the movement of aquatic organisms; d. The crossing, including all attendant features, both temporary and permanent, is part of a single and complete project for crossing of a water of the United States; and e. For fills in special aquatic sites, including wetlands, the permittee notifies the District Engineer in accordance with the "Notification" general condition. Your work is authorized by these NWP's provided it is accomplished in strict accordance with the enclosed conditions. These NWP's do not relieve you of the responsibility to obtain any required State or local approval. You should contact Mr. John Dorney of the North Carolina Division of Environmental Management at (919) 733-1786 regarding a State Water Quality Certification. This verification will be valid for 2 years from the date of this letter unless the NWP authorization is modified, reissued, or revoked. Also, this verification will remain valid for the 2 years if, during that period, the NWP authorization is reissued without modification or the activity complies with any subsequent modification of the NWP authorization. If during the 2 years, the NWP authorization expires or is suspended or revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the NWP, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the NWP will remain authorized provided the activity is completed within 12 months of the date of the NWP's expiration, modification or revocation, unless discretionary authority has been exercised on a case-by-case basis to modify, suspend, or revoke the authorization. You have visited the site on several occasions previously with Larry Sink of our firm to approve delineations and discuss permitting. The attached plans show the locations of Wetlands and Waters of the U.S. as approved by you on the property, proposed "fill" sites and the areas of Wetlands and Waters of the u.s. to be impacted at each fill site. 0.04 acres of impact will be covered under Corps Nationwide Permit 14 for road crossings and 1.51 acres of impact will be covered under Nationwide Permit 26. We would also like to utilize Nationwide Permit 12 for the utility lines in this project. Cumulative impacts are addressed in a graphic tabular form on the attached map. We felt this approach would be easier for all of us to follow and be more informative. There are several items that I would like to point out that you may want to discuss with me in further detail: Most of the impacts are along swales with non-hydric soils and very little vegetation. These are claimed as "Waters of the U.S.II because of the evidence of flow (e.g. displaced leaves and small scoured areas) which occur due to the impermeable nature of surrounding upland soils. Most all rainfall runs off into these swales instead of infiltrating into the soils. This is common in other Triassic areas but the same landscape Soil/Site Evaluation . Mapping and Physical Analysis . Wetlands Mapping and Mitigation . Environmental Audits On-Site Waste Treatment Systems, Evaluation and Design positions in acid crystalline rock areas would rarely meet wetland or Waters of the u.s. criteria. The streams with the highest values from a water quality or wildlife standpoint (White Oak Creek) were avoided by the development as much as possible. Based on our site meeting with Mr. Schafer of DEM we believe he concurs that the residential and commercial projects north of White Oak Creek, as proposed will have minimal impacts to water quality. However, Mr. Schafer was concerned about stormwater runoff. Mr Schafer's concern was the potential off site effects of runoff from this project. The proposed pond in non-wetlands in the southern residential project is designed to handle runoff from a large portion of the project so that it will partially offset the negative impacts to water quality caused by that section of the development. Floodplain areas along White Oak Creek will also serve to "filter" stormwater released from the northern development where impacts are minimal.
