Box 108 Balsam Grove, N.C. 28708 FILE Copy Dear Mr. Creese: You have our approval to place fill material in 130 square feet of wetlands or waters for the purpose of bank stabilization approximately 150 feet south of Tanassee Gap Road (SR 1324), as you described in your application dated 13 December 1994. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2665. This certification allows you to use Nationwide Permit Number 13 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. Creese Dear Mr. Donley: We represent Donald and Betty Creese and twenty two (22) other individuals who are Plaintiffs in a lawsuit involving the establishment of a right-of-way over and across certain property belonging to William and Nancy Galloway in Balsam Grove, North Carolina. The property of our clients is located on the West bank of the North fork of the French Broad River in Balsam Grove, North Carolina. The only roadway servicing this property to the State Road is a narrow, unimproved dirt roadway running parallel with and along the West bank of the North fork of the French Broad River. Last year, Mr. and Mrs. Galloway constricted the road right-of-way to such a degree that my clients were unable to get into and out of their property. We tiled a lawsuit and the Court ordered the road opened. In August of this year, heavy rains and flooding caused a portion of the embankment supporting the road to wash out and, at this time, the road itself is in danger of collapsing into the river. In order to afford my clients access to their property, it will be necessary to "shore up" the embankment. Otherwise, if the road falls into the river, they have no way of getting into and out of their property. We hope this application will receive favorable attention and, should you have any questions, please let us know as soon as possible. STATE OF NORTH CAROLINA IN THE GENERAL COURT OF JUSTICE THIS MATTER, coming on to be heard and being heard before the undersigned Judge Presiding over the October 10, 1994 term of Superior Court (Civil), pursuant to Plaintiffs' Motion for Preliminary Injunction; and the Court, upon reviewing relevant portionsi of the record and Affidavit and after receiving argument of Counsel, is of the opinion that llecause of the heavy rains and resultant flooding which occurred in Transylvania County in August, 1994, the embankment supporting and adjacent to the roadway is in danger of caving into the river, that Plaintiffs' access to their properties is in danger of being terminated by reason of a need of repair, and that Plaintiffs will suffer immediate and irreparable loss, injury or damage unless a Preliminary Injunction is granted; and Ni;' . ; e Lk" The Court therefore ORDERS as follows: Plaintiffs, their agents or employees shall have the right to go over, onto, and across the roadway in dispute and the property of the Defendants lying between the roadway and the North fork of the French Broad River for the purpose of repairing and maintaining the roadway and embankment pending trial on the merits; subject, however, to the provisions set forth below. 2. Plaintiffs at their sole cost and expense may remove and replace any and all fence posts located along the Western margin of the roadway to the extent necessary to (a) allow implementation of this Order and (b) to assure Plaintiffs safe and unimpeded use of the existing roadway for a width of 10 ft. pending completion of repair to and stabilization of the embankment between the roadway and the river and pending trial on the merits. Provided, however, should removal of any fencing become necessary to implement this Order, the parties shall first confer with the Court, by and through counsel, by telephone or Other convenient means of communication for the purpose of seeking and obtaining specific directives concerning removal and replacement of fencing. Provided, further, Plaintiffs, their agents or employees shall, insofar as may be reasonably possible, stay off of that portion of Defendant's real property lying to the west of disputed roadway. 3. Plaintiffs' shall restore at their own expense to its natural or previous state any portion of Defendants' property altered by Plaintiffs, their agents or employees as a result of entry upon, over and across and the making of repairs and stabilization to the lands and embankment of Defendants, all within a reasonable time after completion of said repairs. Plaintiffs shall give security in the amount of Fifty Thousand ($50,000.00) Dollars prior to beginning any work hereunder for the purpose of holding Defendants harmless from any loss, injury or damages which they might incur as a result of Plaintiffs' actions or which might be imposed by Federal, State or Local governmental bodies or regulatory agencies or commissions. Plaintiffs shall obtain all necessary regulatory permits and licenses prior to beginning work. , ' 1 i 4. Provided, further, if it becomes necessary for Plaintiffs to remove 'any fencing and fence posts of the Defendants for the purpose of implementing this Order, Plaintiffs shall provide, at their sole expense, alternate and appropriate fencing for the purpose of enclosing and securing any livestock located on the property of the Defendants.
