Dear Mr. Stroud:
You have our approval to place fill material in 0.16 acres of wetlands or waters for the purpose
road crossing at River Creek subdivision (SR 1567), as you described in your application dated 11
October 1994. After reviewing your application, we have decided that this fill is covered by General
Water Quality Certification Number 2732. This certification allows you to use Nationwide Permit
Number 14 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of .-administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.

Subject: Section 401 Water Quality Certification Application for
Rivercreek Subdivision, Ronnie Stroud, 107 Commerce
St., Greenville, Pitt County, North Carolina. (Project
# 94990)
Staff biologists with the Wildlife Resources Commission have
reviewed the project with regard to associated impacts on
wildlife and fishery resources in the area. An onsite
investigation was conducted on November 19, 1994. Our comments
are provided in accordance with provisions of the Fish and
Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C.
661 et seq.) and Section 401 of the Clean Water Act (as amended)
and North Carolina General Statutes (G.S. 113-131 et seq.).
The applicant is proposing to fill approximately 1.73 acres
of 1404' wetlands to provide a roadway access and construct
additional lots and roadways for a proposed subdivision. The
property consists of 109 acres of which approximately 23 acres
are 1404' wetlands. The wetlands on the project site provide
valuable wildlife habitat and serve as travel corridors for
numerous species of amphibians, reptiles, birds, and mammals.
These wetlands, which are hydraulically connected to the Tar-
Pamlico River Basin, protect and enhance water quality in this
nutrient sensitive system by filtering and buffering stormwater
runoff.
The project as proposed would immediately destroy 1.73 acres
of wetlands and another 21 acres of 1404' wetlands will be
threatened by future development. We have determined that this
project is inconsistent with our Policies and Guidelines for

Conservation of Wetlands and Aquatic Habitats. We also believe
that this project is inconsistent with the Environmental
Protection Agency's Section 404(b)(1) guidelines in that the
project does not constitute a water dependent activity. However,
we will not recommend that a 401 Water Quality Certification be
denied if deed restrictions, prohibiting perspective owners from
impacting wetlands, is required for all lots with wetlands.

Dear Messrs. Wicker and Dorney:
The purpose of this letter is to request Nationwide Permits 14 and 26, and a
Section 401 Water Quality Certification for the project to be known as Rivercreek
Subdivision. The project is located near Grimesland, NC (Pitt County) and is
bordered by NC SR 1567 on the northern and eastern boundary as shown on the
enclosed plans and Grimesland, N.C. USGS Topo Quad vicinity map.
The Corps approved wetland delineation is shown on the attached map. The
delineations of impact areas have been approved by Mr. Henry Wicker of the
U.S. Army Corps of Engineers.
Fill in the wetlands will be required to construct roads and utilize lots.
It will be necessary to fill 1.73 acres (see map) of jurisdictional wetlands above
headwaters for placement of proposed roadways and lots utilizing Nationwide
Permits 14 and 26. A total of 0.16 acres (see map) will be filled for a road
crossing under Nationwide Permit 14. The road crossing is perpendicular to
wetland alignment, in order to minimize impacts. Impacts to isolated wetland
pockets totals 0.29 (see map) acres under Nationwide Permit 26. Wetlands
totaling 1.29 acres (0.89 acres for roads and 0.40 acres for lots)(see map) will be
impacted under Nationwide Permit 26 for additional lots, and roads that can not
be permitted under Nationwide 14. Prior forestry practices denuded all
vegetation from the impact areas within the past 10 years. Resulting wetlands
are rutted and full of scrubby vegetation. N.C. DEM wetland rating sheets
average 23.5 in areas of proposed impacts (see attached forms, photos and
impact map ). No high quality cypress-gum swamp wetlands (N.C. DEM
average wetland rating 60.3) associated with the property will be impacted by
construction activities. The roadway through a high quality wetland area is an
improvement to an existing road bed, minimizing impacts to the high quality
wetland.

Dear Mr. Stroud:
Reference your application of October 20, 1994, for Department of
the Army authorization to fill approximately 0.16 acres of
wetlands in order to construct a subdivision road under
Nationwide Permit 14 and fill approximately 1.29 acres of
wetlands in order to construct other subdivision road crossings
(0.89 acres of wetlands impacts) and fill subdivision lots (0.40
acres of wetlands impacts) under Nationwide 26. The site is
located approximately 4 miles west of Washington, on S.R. 1567,
at Rivercreek Subdivision, adjacent to an unnamed tributary to
Tranters Creek, Pitt County, North Carolina.
For the purposes of the Corps of Engineers' Regulatory Program,
Title 33, Code of Federal Regulations (CFR), Part 330.6,
published in the Federal Register on November 22, 1991, lists
nationwide permits. Authorization, pursuant to Section 10 of the
Rivers and Harbors Act of 1899 and Section 404 of the Clean Water
Act, was provided for fills for roads crossing waters of the
United States (including wetlands and other special aquatic
sites) provided:
a. The width of the fill is limited to the minimum necessary for
the actual crossing;
b. The fill placed in waters of the United States is limited to
a filled area of no more than one-third acre. Furthermore, no
more than a total of 200 linear feet of the fill for the roadway
can occur in special aquatic sites, including wetlands;
c. The crossing is culverted, bridged or otherwise designed to
prevent the restriction of, and to withstand, expected highflows
and the movement of aquatic organisms;
d. The crossing, including all attendant features, both
temporary and permanent, is part of a single and complete project
for crossing of a water of the United States; and

e. For fills in special aquatic sites, including wetlands, the
permittee notifies the District Engineer in accordance with the
"Notification" general condition.
For the purposes of the Corps of Engineers' Regulatory Program,
Title 33, Code of Federal Regulations (CFR), Part 330.6,
published in the Federal Register on November 22, 1991, lists
nationwide permits. Authorization was provided, pursuant to
Section 404 of the Clean Water Act, for discharges of dredged or
fill material into headwaters and isolated waters provided:
a. the discharge does not cause the loss of more than 10 acres
of waters of the United States;
b. the permittee notifies the District Engineer if the discharge
would cause the loss of waters of the United States greater than
one acre in accordance with the "Notification" general condition.
For discharges in special aquatic sites, including wetlands, the
notification must also include a delineation of affected specific
aquatic sites, including wetlands; and
c. the discharge, including all attendant features, both
temporary and permanent, is part of a single and complete
project.
Your work is authorized by these nationwide permits provided it
is accomplished in strict accordance with the enclosed
conditions. These nationwide permits do not relieve you of the
responsibility to obtain any required State or local approval.
This verification will be valid for two years from the date of
this letter unless the nationwide authorization is modified,
reissued or revoked. Also, this verification will remain valid
for the two years if, during that period, the nationwide permit
authorization is reissued without modification or the activity
complies with any subsequent modification of the nationwide
permit authorization. If during the two years, the nationwide
permit authorization expires or is suspended or revoked, or is
modified, such that the activity would no longer comply with the
terms and conditions of the nationwide permit, activities which
have commenced (i.e., are under construction) or are under
contract to commence in reliance upon the nationwide permit will
remain authorized provided the activity is completed within
twelve months of the date of the nationwide permit's expiration,
modification or revocation, unless discretionary authority has
been exercised on a case-by-case basis to modify, suspend or
revoke the authorization.
