After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2671. This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. Additional conditions are that 1) now of water into remaining wetlands shall not be diminished, and 2) wetlands below the impact site should be preserved. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. Development into this area is required as these are no other reasonable direction available to expand the pit. This letter provided confirmation of authorization for 0.79 acre of fill impacts to the jurisdictional waters of an unnamed / above-headwaters tributary of Wolf Island Creek. The proposed impacts were in association with the planning for future stone quarry pit expansion of the Reidsville Quarry located off N.C. 87, west of Reidsville, Rockingham County, North Carolina. Reference is also made to your written request of September 2, 1994, which included a modified plan for the aforementioned project. In response to that request, on June 28, 1994, Mr. John Thomas of the Raleigh Regulatory Field office conducted an inspection to review the property for the presence of waters and wetlands subject to Department of the Army permitting authority with reference to your modified plans. The site inspection of June 28, 1994, and review of the modified site plan for the proposed Reidsville Quarry expansions revealed a complete change in the location and acreage of proposed impacts to jurisdictional wetlands and waters located above the headwaters of the referenced, unnamed tributary of Wolf Island Creek. These impacts associated with the modified plan are located up-stream of the original plan and would result in a total of 0.67 acre (instead of 0.79 acre) of impacts to water and wetlands on this stream. For the purposes of the Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CPR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits. Authorization was provided, pursuant to Section 404 of the Clean Water Act, for discharges of dredged or fill material into headwaters and isolated waters. Your proposed impacts to 0.67 acre of waters of the United States is authorized by this nationwide permit provided it is accomplished in strict accordance with the enclosed conditions and provided you receive a Section 401 water quality certification from the North Carolina Division of Environmental Management (NCDEM.) You should contact Mr. John Dorney, telephone (919) 733- 1786, regarding water quality certification. This nationwide permit does not relieve you of the responsibility to obtain other required State or local approval. This verification will be valid for two years from the date of this letter unless the nationwide authorization is modified, reissued or revoked. This verification will remain valid for the two years if, during that period, the nationwide permit authorization is reissued without modification or the activity complies with any subsequent modification. If during the two years, the nationwide permit authorization expires or is suspended or revoked, or is -2- modified, such that the activity would no longer comply with the terms and conditions of the nationwide permit, activities which have commenced or are under contract to commence, in reliance upon the nationwide permit, will remain authorized. This is provided the activity is completed within twelve months of the date of the nationwide permit's expiration, modification or revocation.
