Box 389 Bryson City, N.C. 28713 FILE COPY Dear Sirs: You have our approval to place fill material in 0.001 acres of wetlands or waters for the purpose of stream bank stabilization at Smoky Mountain County Club, as you described in your application dated 27 September 1994. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2665. This certification allows you to use Nationwide Permit Number 13 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory. hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of.Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. Also enclosed is a plan of the project showing the location of the proposed irrigation intake and standard details. In general, this project will consist of a 3.0'x 3.0' precast concrete box to be installed in the stream bank at the location shown on the plan. Sandbags will be placed in the stream during construction to minimize any impact on the stream. Rip-rap will be placed along the stream bank on either side of the intake to prevent the erosion of the bank. There will be no permanent structures within the stream bed. During a conversation with David Yow, North Carolina Wildlife Resources Commission, there was some concern about the possibility of fertilizer and/or chemical run-off being concentrated in the proposed pond and affecting the water quality in Wesser Fork. The grading plan for the proposed irrigation pond will eliminate practically all run-off from entering the pond. Furthermore, the discharge will be released into the wetland area, 500 ± feet downstream from the intake, which parallels Wesser Fork, rather than directly into the stream. This should allow any difference in water temperature to be adjusted before the water from the pond re-enters Wesser Fork. Application for NWP No. 13 is being submitted to David Baker of the U.S. Army Corps of Engineers for their approval. P.O.
