Box 1388 Lumberton, N.C. 28359 Dear Mr. Hites: You have our approval to place fill material in 0.95 acres of wetlands or waters for the purpose of sewer line construction along Little Jacob Swamp to WWTP, as you described in your application dated 6 May, 1994. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2664. This certification allows you to use Nationwide Permit Number 12 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. The interceptor will terminate at _ the City of Lumberton's secondary type wastewater treatment plant which discharges into the Lumber River. Owner's Signature Date r' MITIGATIVE MEASURES: In order to avoid significant adverse impacts as they apply to the proposed South/Southwest Interceptor project, installation will be in full compliance with General Permit No. CESAW-C081-N-000-0049 as authorized by the Department of the Army, Wilmington District, Corps of Engineers. Prior to crossing any navigable waters, including the Lumber River, an easement will be obtained from the North Carolina Department of Administration, State Property Office, pursuant to North Carolina General Statues 143-341 (4), 146-11 and 146-12. In an effort to reduce impacts to forested wetlands, the number of stream crossings and any filling will be minimal, and the construction corridor width will be restricted to a maximum of 40 feet, with a permanent easement of 20 feet for maintenance. (Only 10 feet of the permanent easement will be maintained.) Although 40 feet will be allowed, contract specifications will require that contractors keep the clear cut width to the minimum necessary and only remove the trees necessary. In order to limit the potential negative impacts of sedimentation and turbidity on spawning activities of freshwater species, including Sunfish and Largemouth Bass, all construction activities where sediment would discharge directly to a stream will be performed between July 15 and March 1. Crossings of wetlands and streams will be located at narrow areas and made perpendicular to the stream.
