Based on this review, we have determined that the proposed fill is covered by General Water Quality Certification Nos. 2665 and 2668. Copies of the General Certification is attached. These Certifications are necessary for coverage under Corps of Engineers' Nationwide Permit Nos. 13 and 16. This action completes DEM's review under Section 401 of the Clean Water Act. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. PROJECT SUMMARY: Applicant proposes maintenance dredging of the 200 slip Harbour Village Marina and minor shoreline stabilization. Harbour Village Marina, Inc. Page 2 9. PROJECT DESCRIPTION 2/22/94 The project site is approximately 34.7 acres located off of S. R. 1566 across from Topsail Island in Pender County. The existing project is the 200 slip Harbour Village Marina basin and access channel. The access channel is approximately 800' x 75'. The basin varies in width from 130' to 275', and is approximately 1280' in length. The basin and access channel are stabilized by bulkheading. The marina offices are on the north side of the basin, and the original spoil site is to the extreme north of the basin. The Pender County Land Use Plan classifies the high ground as Transition, and the wetland areas as Conservation. The waters of Topsail Sound are classified SA by the Division of Environmental Management. The area is a designated Primary Nursery area, and the Division of Marine Fisheries has closed the area to shellfishing. The shellfish closure extends beyond the marina for a total distance of 600'. The existing water depth throughout the project site averages 5' to 6'. The applicant proposes the maintenance dredging of the marina and the access channel. The proposal includes the basin for its existing length of 1280', with widths varying from 130' to 275'. The access channel is to be dredged to its existing width of 75' and length of 800'. The requested water depth is - 11' at the waterward end where the excavation joins the AIWW. The depth for the access channel grades from -10' to -9' halfway to the basin. The basin depth is proposed for -8' to the point where it squares off to the north. The remaining basin area is proposed to be dredged to a depth of -7' mlw. The total square footage of excavated area is approximately 265,000 square feet. The dredging is to be accomplished hydraulically, with the spoil to be pumped to the existing spoil area at the north end of the basin. The spoil site is approximately 610' x 300'. The existing dike is 8' high, and 55' wide at the bottom. This structure is to be maintained prior to dredging. The stilling basin has been constructed across from the marina end in the past, with the effluent pipe emptying back into the marina basin. This practice is to be followed on future projects as well. The application also requests the placement of 100 square feet of riprap at the end of the bulkhead walls on both sides. Because of the scouring around the ends of the walls, there is no vegetation at these locations. The applicant is also requesting to place 4' of riprap for a distance of 60' behind the bulkhead just north of the office. This area receives occasional flooding from the wetland area behind the marina office. Though the species on two sides of this pocket are high ground, the influence to the north causes Salicornia WR.., Juncus romerianus, and Distichlis s icata to come in on this side. The area was filled without a permit in years past, and the owner was required to remove the fill. For probably this reason, the species have not come back in, and left is an unvegetated pocket of wetlands. Because of the subsiding of this area, the bulkhead wall is being undermined from behind. The applicant proposes stabilizing the wall with the riprap placement. Lastly, the applicant proposes maintenance to the marina sign. This sign is placed in the Public Trust Area to the west of the AIWW. 10. ANTICIPATED IMPACTS The proposed maintenance dredging would cause the disturbance of approximately 265,000 square feet of bottom area . Approximately 27,000 cubic yards of material would be removed. No wetlands are in the dredge area. Turbidity increases are to be expected during dredging. The spoil placement would bring about the filling of approximately 4.2 acres of existing spoil disposal area. The riprap around the bulkhead ends would fill approximately 200 square feet of shallow bottom. The riprap behind the office would fill approximately 240 square feet of unvegetated coastal wetlands. Approximately 27,000 cubic yards of' material would be removed. No wetlands are in the dredge area. Turbidity increases are to be expected during dredging. The spoil placement would bring about the filling of approximately 4.2 acres of existing spoil disposal area. The riprap around the bulkhead ends would till approximately 200 square feet of' shallow bottom. The riprap behind the office would fill approximately 240 square feet of unvegetated coastal wetlands. All excavated materials will be confined landward of the mean high water (MHW) elevation contour within adequate dikes or other retaining structures to prevent spillover of solids into any vegetated wetlands or surrounding waters. e. The terminal end of the pipeline from the dredge into the diked retention area will be positioned at or greater than 50 feet from any part of the dike and a maximum distance from spillways to prevent dike erosion and to allow adequate settlement of suspended solids. f. A water control structure will be installed at the intake end of the effluent pipe leading from the retention area in order to ensure maximum settlement of suspended solids. g. Flow from the diked retention area will be confined by pipe, trough, or similar device to a point at or below the mean low water (MLW) elevation contour to prevent gully erosion and siltation. -2- h. No vegetated wetlands will be excavated or filled. i. Excavation in the basin will not exceed eight (8) feet below the elevation of mean low water (MLW), and excavation in the channel will not exceed eleven (11) feet, MLW. J. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. k. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit.
