Sutton Energy Complex, New Hanover County, NC Hurricane Florence Emergency Response Dear Ms. Higgins: Enclosed is a Pre -Construction Notification (PCN) application to modify an existing NWP 39 (SAW -2011-00858; DWR-2015-0998v5) associated with the Duke Energy L.V. Sutton Energy Complex located near Wilmington in New Hanover County, North Carolina. In accordance with Section 404 of the Clean Water Act (33 USC 1344), Duke Energy is requesting authorization for a modification to the Department of the Army Nationwide Permit (NWP) #39 to disturb Waters of the United States as part of the L.V. Sutton Energy Complex Hurricane Florence Response activities. This modification to NWP SAW -2011-00858 and DWR-2015-0998v5 is being requested because an engineering analysis found an additional 0.20 acres of wetland fill impact is needed to repair a scour hole area immediately adjacent to a newly constructed dam spillway. The filling of the scour hole within the wetland is required to provide stability and support to the spillway. Please find the PCN application, supporting documentation and figures attached. Total Wetland Impacts: 2h. Comments: Erosion of soil in wetlands that occurred at Breach 1 has resulted in scouring of the wetlands. The new lower surface elevation has allowed water to pool at the base of Breach 1. The scoured area, which is 0.20 acre, will be filled with sand and silt to replicate natural conditions instead of filling the void with stone. Duke Energy proposes to restore the wetland elevation in the scoured area to its condition (bottom elevation) prior to Hurricane Florence to ensure the structural integrity of the dam at permanent Breach 1 repair. The only wetland impacts will be to fill a 0.20 acre scour that occurred during Hurricane Florence. The scour will be filled with sand and silt to match the elevation of the surrounding wetlands, allow area to mimic natural conditions, and allow the area to function as a wetland. 1b. Planned construction methods for repairs are set to be completed from on top of the existing dam instead of having equipment travel through wetlands or open water. Work will be conducted in the existing footprint of the dam to prevent the need for logging or construction mats to drive on. 2. All three repairs are being permitted together, as requested by the USACE.
