Poindexter St. Elizabeth City as you described in your application dated 11 April, 1994. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2665. This certification allows you to use Nationwide Permit Number 13 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may he required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. If the applicant is not claiming to be the owner of said property, then forward a copy of the deed or other instrument under which the owner claims title, plus written permission from the owner to carry out the project. Roanoke Bible College Bio Report Page Two Roanoke Bible College is located along North Poindexter Street between Ward Street and Cypress Street. They own a 12 acre tract of land lying along the Pasquotank River between the condominiums of Continental Plaza and the empty brick warehouse of Pell Paper Company. The entire tract is within the city limits but lies outside of the city's historic district. Sited on the 12 acre tract are two dormitories and a small storage building. The majority of the 12 acre tract is in grass and used as an athletic/recreational field. The applicant proposes to remove 650 feet of an existing deteriorated bulkhead and replace it with an aluminum bulkhead. The aluminum sheathing will be placed along the same alignment as the existing bulkhead. The existing bulkhead pilings will be used for support waterward of the aluminum sheathing. Clean fill will be bought in to backfill the bulkhead where needed. The tract lies approximately 2.5 feet above the Pasquotank River. The soils are classified as a Bertie fine sandy loam and are not considered hydric. The depth of the river along the applicant's tract varies from approximately 3 feet (adjacent to Continental Plaza) to approximately 10 feet further down river. The river varies from approximately 750 to 600 feet in width in this area. A federally maintained channel lies more than 200 feet waterward of the applicant's shoreline. NC DEM classifies these waters as SC and they are part of CAMA's Public Trust Areas of Environmental Concern. Anticipated Impacts The proposed project will result in a temporary increase in water turbidity. However, eliminating the existing loss of shoreline through the deteriorated bulkhead will reduce sediment loading of the river after the project is completed. No public trust waters will be taken in by this project. There are no wetlands along this shoreline. The applicant anticipates needing up to 10 cubic yards of clean fill to backfill the project once completed. CAMA Review The proposed bulkhead would be considered a routine project were it not for it's length to Roanoke Bible College. A CAMA General Permit was issued for 500 feet of aluminum bulkhead adjacent to this site. There are no endangered or threatened species in the vicinity nor are there any unique geologic features to be concerned with. The applicant will not need an easement frorn the state for this bulkhead alignment nor will it effect the federally maintained channel. No historical or archeological significance has been associated with this site. Further comments on the consistency of this project with the Elizabeth City Land Use Plan will be forwarded under separate letterhead. Submitted by: Richard L.
