CERTIFICATION
THIS CERTIFICATION is issued in conformity with the requirements
of Section 401 Public Laws 92-500 and 95-217 of the United States and
subject to the North Carolina Division of Environmental Management
Regulations in 15 NCAC 2H, Section .0500 to Jones Island Company
resulting in 0.9 acres of wetland impact in Pamlico County pursuant to
an application filed on the 24th day of March of 1994 to renovate
existing waterfowl impoundments.
The Application provides adequate assurance that the discharge of
fill material into the waters of AIWW Creek in conjunction with the
proposed development in Pamlico County will not result in a violation
of applicable Water Quality Standards and discharge guidelines.
Therefore, the State of North Carolina certifies that this activity
will not violate Sections 301,302,303,306,307 of PL 92-500 and PL 95-
217 if conducted in accordance with the application and conditions
hereinafter set forth.
Condition(s) of Certification:
That the activity be conducted in such a manner as
to prevent significant increase in turbidity
outside the area of construction or construction
related discharge (increases such that the
turbidity in the stream is 25 NTU's or less are
not considered significant).
This Certification shall expire five years after
issuance of the 404 Permit.
Violations of any condition herein set forth shall result in
revocation of this Certification. This Certification shall become
null and void unless the above conditions are made conditions of the
Federal or Costal Area Management Act Permit.
If this Certification is unacceptable to you, you have the right
to an adjudicatory hearing upon written request within thirty (30)
days following receipt of this Certification. This request must be in
the form of a written petition conforming to Chapter 150B of the North
Carolina General Statutes and filed with the Office of Administrative
Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. Unless such
demands are made, this Certification shall be final and binding.

This correspondence responds to your letter of March 24, 1994, regarding
the Jones Island Hunt Club application to implement wildlife management
practices on Jones Island near Hobucken in Pamlico County, North Carolina.
Please consider our response as follows:
a. We have attempted to confine our most intensive management practices
within existing impoundments and we are not preparing expansion or
creation of new impounded areas. Because these impoundments already
exist and the Club does not own any impoundments in non-wetland
settings, we hope to be able to implement a moist-soil management
strategy. Moist-soil management techniques require wet area and the
ability to manipulate water levels. Once established, desirable
moist-soil plant species are mostly self-maintaining except for
periodic burning, and in some cases, discing. To the best of our
knowledge, there are no impounded uplands within the general area with
water management capabilities.
b. Because of stumps, logging slash, and other woody debris, we cannot
prepare relatively small areas for establishing desirable moist-soil
plant species. For the same reasons, we cannot effectively control
undesirable plant species such as Phragmites which shade out species
with higher wildlife food values. The ideal situation would be to
prepare the entire area within each impoundment for discing. In the
interests of trying to minimize impacts, we have established what we
believe to be minimal areas for establishing a seed base, with the
hope that planted species will spread throughout the impoundments. In
order to make impoundment North One into a more manageable unit, we
requested an extension of the center dike. The extended dike is
designed to be minimal for maintenance access. Overall, we have made
every attempt to minimize disturbances in wetlands, yet implement
sound wildlife management practices that will benefit a range of
wildlife species. In order to develop an environmentally sensitive
plan that would enhance habitat value for waterfowl and other
wildlife, the Club has worked very closely with Dennis Stewart, a
professional wildlife biologist formerly with the N. C. Wildlife
Resources Commission.

C. Recognizing that our management plan would have some impact on
wetlands, we have integrated mitigative measures in several areas.
First, the area known as South Three was identified as the highest
quality forested (mostly hardwood) habitat in the vicinity of the
impoundments. The Club has decided to allow this area to remain as
undisturbed forested habitat instead of trying to timber and impound
it. The area south of impoundments South One and South Two was
clearcut without any reforestation. Presently, the area is mostly a
shrub thicket with low to moderate habitat value. We are proposing to
eliminate competing vegetation in strips through roller chopping and
then reforesting with hardwood species such as a variety of oaks,
black gum, green ash, cypress, etc. in order to create high quality
forested habitat over time. Since submitting the application, we have
been advised that mowing the strips with a bush hog would have less
impact on wetlands. We are receptive to use of a bush hog instead of
a drum chopper if you desire such a modification. In addition, we
will plant a tree buffer zone between impoundments North One and South
One. Although we know that it cannot count as wetland mitigation, we
are implementing wildlife management practices on the upland area
adjacent to the Atlantic Intracoastal Waterway. Overall, we believe
that moist soil management within the impoundments, in conjunction
with significant habitat enhancement in degraded areas will result in
higher quality resources in the general area.
Jones Island Hunt Club consists of members who enjoy the outdoors. It is
the intent of members to enjoy hunting, fishing, birdwatching, and the
aesthetics of the area. We do not wish to do anything that would degrade
or destroy the quality of the natural resource base on Jones Island. We do
hope that we will be able to implement management practices and habitat
enhancement measures that will ensure present and future generations a
quality outdoor experience. If you have additional questions about our

JONES ISLAND COMPANY, Post Office Box 8365, Hobucken, North Carolina
28537, has applied for a Department of the Army (DA) permit TO MECHANICALLY
CLEAR APPROXIMATELY 349 ACRES OF WETLANDS, WITHIN AND ADJACENT TO, JONES
ISLAND WATERFOWL IMPOUNDMENTS, AND TO PLACE APPROXIMATELY 2,000 CUBIC YARDS OF
DREDGED MATERIAL INTO 0.9 ACRE OF WETLANDS, TO CONNECT INTERNAL DIKES WITHIN
AN EXISTING IMPOUNDMENT. THE JONES ISLAND IMPOUNDMENTS ARE ADJACENT TO THE
ATLANTIC INTERCOASTAL WATERWAY, JONES BAY, BAY RIVER, AND PAMLICO SOUND, AND
LOCATED NEAR HOBUCKEN, Pamlico County, North Carolina.
The following description of the work is taken from data provided by the
applicant and from observations made during an onsite visit by a
representative of the U.S. Army Corps of Engineers. Plans submitted with the
application show approximately 320 acres will be sheared, stumped, and
windrowed within existing impoundments. Another 25-acre impoundment will have
existing vegetation drum-chopped. A 4-acre site outside the impoundments will
have existing vegetation drum-chopped. ALL areas will be replanted to improve
wildlife habitat. A total of 5.75 acres within the impoundments will be
disked and planted as an annual activity until moist soil vegetation becomes
established and self maintaining. within impoundment North One, approximately
0.9 acre will be used as a borrow site to construct the 600-foot-long dike
extension, having a base width of 25 feet. This work will connect an internal
dike, allowing easier management of water levels and vegetation. Additional
habitat improvement work will be conducted on high ground areas outside the
impoundments. Plans showing the work are included with this public notice.
Detailed site preparation descriptions are attached to this notice.
The applicant has determined that the proposed work is consistent with the
North Carolina Coastal Zone Management Plan and has submitted this
determination to the North Carolina Division of Coastal Management (NCDCM) for
their review and concurrence. This proposal shall be reviewed for the
applicability of other actions by North Carolina agencies such as:
a. The issuance of a Water Quality Certification under Section 401 of the
Clean Water Act by the North Carolina Division of Environmental Management
(DEM).

b. The issuance of a permit to dredge and/or fill under North Carolina
General Statute 113-229 by the NCDCM.
c. The issuance of a permit under the North Carolina Coastal Area
Management Act (CAMA) by the NCDCM or their delegates.
d. The issuance of an easement to fill or otherwise occupy State-owned
submerged land under North Carolina General Statute 143-341(4), 146-6, 146-11,
and 146-12 by the North Carolina Department of Administration and the North
Carolina Council of State.
e. The approval of an Erosion and Sedimentation Control Plan by the Land
Quality Section, North Carolina Division of Land Resources, pursuant to the
State Sedimentation Pollution Control Act of 1973 (NC G.S. 113 A-50-66).
The requested DA permit will be denied if any required State or local
authorization and/or certification is denied. No DA permit will be issued
until a State coordinated viewpoint is received and reviewed by this agency.
Recipients of this notice are encouraged to furnish comments on factors of
concern represented by the above agencies directly to the respective agency,
with a copy furnished to the Corps of Engineers.
This application is being considered pursuant to Section 404 of the Clean
Water Act (33 U.S.C. 1344). Any person may request, in writing within the
comment period specified in the notice, that a public hearing be held to
consider this application. Requests for public hearing shall state, with
particularity, the reasons for holding a public hearing.
The District Engineer has consulted the latest published version of the
National Register of Historic Places for the presence or absence of registered
properties, or properties listed as being eligible for inclusion therein, and
this worksite is not registered property or property listed as being eligible
for inclusion in the Register. Consultation of the National Register
constitutes the extent of cultural resource investigations by the District
Engineer, and he is otherwise unaware of the presence of such resources.
Presently, unknown archeological, scientific, prehistorical, or historical
data may be lost or destroyed by work under the requested permit.
The District Engineer, based on available information, is not aware that
the proposed activity will affect species, or their critical habitat,
designated as endangered or threatened pursuant to the Endangered Species Act
of 1973.

The decision whether to issue a permit will be based on an evaluation of
the probable impacts, including cumulative impacts, of the proposed activity
and its intended use on the public interest. Evaluation of the probable
impacts which the proposed activity may have on the public interest requires a
careful weighing of all those factors which become relevant in each particular
case. The benefits which reasonably may be expected to accrue from the
proposal must be balanced against its reasonably foreseeable detriments. The
decision whether to authorize a proposal, and if so the conditions under which
it will be allowed to occur, are therefore determined by the outcome of the
general balancing process. That decision should reflect the national concern
for both protection and utilization of important resources. All factors which
may be relevant to the proposal must be considered including the cumulative
effects thereof. Among those are conservation, economics, aesthetics, general
environmental concerns, wetlands, cultural values, fish and wildlife values,
flood hazards and flood plain values (in accordance with Executive Order
11988), land use, navigation, shore erosion and accretion, recreation, water
supply and conservation, water quality, energy needs, safety, food and fiber
production, mineral needs, considerations of property ownership, and, in
general, the needs and welfare of the people. For activities involving the
placement of dredged or fill materials in waters of the United States, a
permit will be denied if the discharge that would be authorized by such permit
would not comply with the Environmental Protection Agencies' 404(b)(1)
guidelines. Subject to the preceding sentence and any other applicable
guidelines or criteria, a permit will be granted unless the District Engineer
determines that it would be contrary to the public interest.
The Corps of Engineers is soliciting comments from the public; Federal,
State and local agencies and officials; Indian Tribes and other interested
parties in order to consider and evaluate the impacts of this proposed
activity. Any comments received will be considered by the Corps of Engineers
to determine whether to issue, modify, condition or deny a permit for this
proposal. To make this decision, comments are used to assess impacts on
endangered species, historic properties, water quality, general environmental
effects and the other public interest factors listed above. Comments are used
in the preparation of an Environmental Assessment and/or an Environmental
Impact Statement pursuant to the National Environmental Policy Act. Comments
are also used to determine the need for a public hearing and to determine the
overall public interest of the proposed activity.
Generally, the decision whether to issue this DA permit will not be made
until the DEM (DEM) issues, denies, or waives State certification required by
Section 401 of the Clean Water Act. The DEM considers whether or not the
proposed activity will comply with Sections 301, 302, 306, and 307 of the
Clean Water Act. The application and this public notice for the DA permit
serves as application to the DEM for certification.

Additional information regarding the Clean Water Act certification may be
reviewed at the offices of the Environmental Operations Section, DEM,
Salisbury Street, Archdale Building, Raleigh, North Carolina. Copies of such
materials will be furnished to any person requesting copies upon payment of
reproduction costs.
The DEM plans to take final action in the issuance of the Clean Water Act
certification on or after April 15, 1994.
All persons desiring to make comments regarding the application for Clean
Water Act certification should do so in writing delivered to the DEM, Post
Office Box 27687, Raleigh, North Carolina 27611-7687, on or before April 11,
1994, Attention: Mr. John Dorney.

HABITAT MANAGEMENT PLAN
- FOR
JONES ISLAND COMPANY
SCOPE:
The Jones Island Company proposes to undertake a long range habitat
management plan for a portion of a 1100 acre tract located on Jones island adjacent
to Pamlico Sound between Jones Bay and the Atlantic Intercostal Waterway near
Hobucken, In Pamlico County, North Carolina. The objective of the proposed project
is to improve the habitat by regeneration of a diverse forest and moist soil plant
community that will attract and sustain a wide range of wildlife species. The site has
been clear cut by previous owners leaving stumps, slash and debris. A total of 320
acres within the existing Impoundments will be stumped, sheared and the debris
windrowed with low ground pressure equipment. Within this same area 5.75 acres
wiil be disked and planted with moist soil vegetation. An additional 29 acres will be
rolled and drum chopped to reduce competition from vines and undesirable
vegetation in order to allow regeneration of desirable moist soil vegetation and
bottornland hardwoods.
The completion of the division dikes in North One impoundment will cause the loss
of 0.9 acres of Section 404 jurisdictional wetlands. The work will not directly impact
any property subject to North Carolina Coastal Area Management Act (CAMA).
Plans showing the area of work are attached. The proposed project minimizes
impact on wetlands and will create the improved habitat for wildlife. The initial site
work will be conducted over a period of 5 years with ongoing disking and planting
within the impoundments continuing on an annual basis until the moist soil
vegetation is established and self maintaining. In order to inhibit and retard growth
of phragmites, burning end approved herbicide wicking will be utilized as necessary.
The seasonal water levels within each impoundment will be manipulated in order to
manage the moist soil conditions necessary for the desired vegetation.

SOUTH ONE
DESCRIPTION:
Existing 50 acre impoundment severely threatened with phragmites. Partofthe area
is heavily populated with stumps and logging debris that prevents proper
management of the vegetation.
OBJECTIVE:
To prepare the site for management of moist soil vegetation by clearing stumps and
debris.
ACTION:
(a) Drain impounded water through existing drainage and pumping system during
February and March.
(b) Stump, shear and windrow debris within the impoundment area using low
ground pressure equipment.
(c) Disk the 60' x 300' "X" area.
(d) Plant wild rice, smart weed, jap millet, and a variety of grasses and sedges
in accordance with "Moist Soil Management" as prescribed by the North
Carolina Wildlife Resources Commission.
(e) The draining, disking and planting will be an annual activity until moist soil
vegetation becomes established and self-maintaining.
Buming and approved herbicide wicking methods will be utilized to retard
growth of phragmites.
IMPACT:
50 acres within the Impoundment to be stumped and cleared of debris and 0.75
acres within this area to be disked and planted.
SOUTH TWO
DESCRIPTION:
The. existing 25 acre impoundment Is. heavily populated with stumps and logging
debris and supports undesirable saplings and other woody vegetation.
OBJECTIVE:
To prepare the site for management of moist soil vegetation and regeneration of tree
species with a high wildlife value. The habitat improvements will provide a diverse
plant community will attract a wide range of wildlife species, including waterfowl.
ACTION:
(a) Drain impounded water through existing drainage and pumping system during
February and March.
(b) Using low ground pressure equipment, drum chap the debris and vegetation
within the Impoundment.
(c) Check water salinity to assist in determining plant types.
(d) Plant oak, black gum, ash, cypress, live oak, water oak, willow oak, white
cedar, etc. if salinity is appropriate.
(e) Plant moist-soil vegetation by broadcasting.
IMPACT:
25 acres within the impoundment to be drum chopped.
SOUTH TWO-A
DESCRIPTION:
__This area has been timbered by previous owners as a clear cut operation. The
natural revegetation consists of pine and woody shrubs with a low to moderate
forested habitat value.
OBJECTIVE:
Improve the site by restoring a diverse forest community with a high habitat value
that will attract a wide range of wildlife species.
ACTION:
(a) Using low ground pressure equipment, drum chop undergrowth vegetation
In strips at 75 foot intervals extending from the South Two/Two-A boundary
to not closer than 100 feet from remaining timber to retain a buffer at the and
of each strip.
(b) Plant oak, black gum, ash, cypress, live oak, water oak, willow oak, white
cedar etc, on 30 foot spacing within the chopped strips..
(c) Annual chopping/mowing as required to reduce competition until hardwood
transplants become established and can compete with shrubs and vines.
IMPACT:
4 acres to be drum chopped.
SOUTH THREE
DESCRIPTION:
This 30 acre site contains the highest quality of forested wetlands In the area
adjacent to the other impoundments. It is not an isolated wetland in its current state.
OBJECTIVE:
Retain South Three as a haven for songbirds, deer, bear, and other wildlife species.
ACTION:
No mechanical equipment will operate on this site.
IMPACT:
None
NORTH ONE
DESCRIPTION:
The existing 180 acre Impoundment is heavily laden with phragmites and cattails
similar to South One. The area is heavily populated with stumps and logging debris
that prevents proper management of the vegetation. An existing dike extends south
to north through the Impoundment but does not completely divide the large area.
OBJECTIVE:
To prepare site for management of moist soil vegetation by clearing stumps and
debris. To complete the division dike to separate the area into two (2) sections that
will enable better management of water levels and the vegetation.
ACTION:
(a) Drain impounded water through existing drainage system during February
and March.
(b) Extend existing dike approximately 600 UFt by excavation from adjacent soil
and tilling to divide North One Into Section "A" and "B"
(c) Stump, shear and windrow debris within the impoundment area using low
ground pressure equipment.
(d) Disk the 100'x 600"'X" area in Section "A" and in Section "g".
(e) The draining, disking and planting will be an annual activity until moist soil
vegetation becomes established and self maintaining.
(f) Burning and approved herbicide wicking methods will be utilized to retard
growth of phragmites.
(g) Plant oak, black gum, ash, cypress, live oak, water oak, willow oak, white
cedar, etc. along the southern dike edges.
IMPACT:
180 acres within the impoundment to be stumped and geared of debris and within
this area 5 acres to be disked and planted and 0.9 acres used for excavation and
filled for extension of the dike.

HIGH GROUND SITE
DESCRIPTION:
The 110 acre high ground area Includes spoil cost up during excavation of the
Intercostal Waterway. The area includes wetland pockets and live oak "islands"
scattered throughout the site. The Section 404 wetlands have been delineated and
flagged.
OBJECTIVE:
Create on-going early succession of plant community that will provide improved
habitat for varied wildlife.
ACTION:
(a) Roll and drum chop low quality vegetated areas on high ground.
(b) Utilize prescribed burning every three (3) years on high ground areas while
protecting the live oak Islands" from fire.
IMPACT:
None; work will be more than 75 feet from areas of CAMA jurisdiction and will not
encroach Into 404 wetlands.
MAYO IMPOUNDMENTS
DESCRIPTION:
This 70 acre impoundment has been managed over 10-15 years and provides a
resting/loafing area for waterfowl, especially in the southwest corner. Phragmites
are established in the western portion of the Impoundment and some areas contain
excessive stumps and debris. The deeper water areas contain a significant fish
population.
OBJECTIVE:
Enhance site for better management of moist-soil vegetation.
ACTION:
(a) Partially drain impoundment in February and March leaving sufficient water
in the deeper areas to maintain the fish population.
(b) Selective stump, shearing and windrow brush and debris using low ground
pressure equipment.
(c) Use burning and herbicide wicking methods to retard growth of phragmites.
(d) Plant cypress trees in the southwest comer.
(e) Annually broadcast wildrice, smart weed, jap millet, and a variety of grasses
and sedges in accordance with "Moist-Soil Management" practices as
prescribed by the North Carolina Wildlife Resources Commission.
(f) Roll and chop area between state road and west dike to open area for a
greater diversity of food for a wide range of wildlife.
IMPACT:
Approximately 30 acres of the 70 acre impoundment will be stumped and cleared of
debris.

Enclosed is the application of Jones Island Company, P.O. Box 8365,
Hobucken, North Carolina 28537, for Department of the Army (DA) authorization
and a State Water Quality Certification to mechanically clear approximately
349 acres of wetlands, within and adjacent to, Jones Island Waterfowl
Impoundments, and to place approximately 2,000 cubic yards of dredged material
into 0.9 acre of wetlands, to connect internal dikes within an existing
impoundment. The Jones Island impoundments are adjacent to the Atlantic
Intracoastal Waterway, Jones Bay, Bay River, and the Pamlico Sound, and
located near Hobucken, Pamlico County, North Carolina. Your receipt of this
letter verifies your acceptance of a valid request for certification in
accordance with Section 325.2(b)(ii) of our administrative regulations.
We are considering authorizing the proposed activity pursuant to Section
404 of the Clean Water Act, and we have determined that a water quality
certification may be required under the provisions of Section 401 of the same
law. A DA permit will not be granted until the certification has been
obtained or waived.
In accordance with oAr administrative regulations, in most cases, 60 days
after receipt of a request for certification is a reasonable time for State
action. Therefore, if you have not acted on the request, or asked for an
extension of time, by May 24, 1994, the District Engineer will deem that
waiver has occurred.

A Copy of the deed (with state application only) or
other instrument under which the applicant claims
title to the affected property. If the applicant is not
claiming to be the owner of said property, then for.
ward a copy of the deed or other instrument under
which the owner claims title, plus written permis-
sion from the owner to carry out the project.
An accurate work plat (including plan view and
cross sectional drawings) drawn to scale in black
ink on 8 ;` x 11 white paper. (Refer to Coastal
Resources Commission Rule 7J.0203 for a detailed
description.)
Please note that original drawings are preferred and
only high quality copies will -be accepted. Blue-line
prints or other larger plats are acceptable only if 16
high quality copies are provided by the applicant.
(Contact the U.S. Army Corps of Engineers regard-
ing that agency's use of larger drawings.) A site or
location map is a part of plat requirements and it
must be sufficiently detailed to guide agency per-
sonnel unfamiliar with the area to the site. Include
county road (SR) numbers, landmarks, and the like.
A stormwater management plan, if applicable, that
may have been developed in consultation with the
Division of Environmental Management.
A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners. These
individuals have 30 days in which to submit com-
ments on the proposed project to the Division of
Coastal Management. The applicant must advise
the adjacent landowners of this opportunity by sen-
