Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Upland Development. 1) Unless specifically altered herein; this permit authorizes the grading and other land disturbing activities associated with the development of the above referenced property, including the relocation of the ship store and associated infrastructure, the walkway, the underground storage tanks, fuel lines and pumps, and the uncovered kayak storage racks, all as expressly and specifically set forth in the attached permit application and workplan drawings. Any additional land disturbing activities and/or construction may require a modification of this permit. Contact a Division of Coastal Management representative at (252) 264-3901 for this determination. 2) Any development or land disturbing activity that is considered non-water dependent is not authorized within 30 feet of the normal high water level unless specifically exempted by Coastal Resources Commission (CRC) regulations in place at the time of such development. This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission. date. December 31, 2012 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. ° ° Signature of Permittee Marshes Light, LLC c/o Doug Anderson Permit 412=-05 Page 2 of 5 ADDITIONAL CONDITIONS Marina Expansion 3) In order to be found consistent with 15A NCAC 071-.. .0208(b)(5)(D), and in accordance with commitments made by the permittee, slips 61-71, slips 72-84, slips 133-158 and both kayak launch platforms are not considered a part of the community marina, and shall be made available to the general public. This condition shall remain in force for the life of the permitted project. 4) In order to be found consistent with 15A NCAC 07H .0208(b)(6)(D), and in accordance with commitments made by the permittee, the originally proposed design of the +/- 323' long wave attenuator is hereby modified in a manner consistent with the design depicted on attached workplan drawings dated 8/31/09. Any and all reference in the attached workplan drawings and/or permit application forms to the originally proposed design is hereby considered null and void. 5) Prior to the occupancy of any new slips authorized under this permit, a marine pumpout sewage disposal facility shall be operable at an easily accessible location, and maintained for the life of the marina. 6) Prior to the occupancy of any new slips authorized by this permit, the permittee shall meet on-site with a representative of the Division to ensure that the required pumpout facility is in place and operabl(-,. 7) The marina shall display a sign showing the location of the on-site pumpout facility, including other appropriate waste disposal information, at the entrance and exit from the main pier. 8) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the marina. Any sewage discharge at the marina shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 9) No permanent structures shall be located within the 52-foot federal channel setback area, including support-pilings and fixed docks. 10) Unless specifically altered herein, this permit authorizes the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this marina facility without permit modification. No non-water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. 11) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 12) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 13) This permit does not authorize'the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. Marshes Eight, LLC c/o Doug Anderson ADDITIONAL CONDITIONS Permit #124-Oi Page 3 of 3 14) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in older to make it more visible during hours of darkness or inclement weather. 15) This permit authorizes a maximum of 158 formalized boat slips associated with the marina facility. RipRap Shoreline Protection 16) The alignment of the authorized riprap shall be staked by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the alignment to be restaked by DCM within a maximum of 30 days prior to the new expected start of construction. 17) The riprap material shall be free from loose dirt or any pollutant. It shall be of a size sufficient to prevent its movement from the approved alignment by wave or current action. LZjpRap for Welland Protection 18) The riprap shall be placed immediately waterward of the erosion escarpment. 19) The riprap shall be placed a maximum of five feet waterward of the erosion escarpment at any point along its alignment. 20) The riprap shall not extend more than six inches above the elevation of the adjacent wetland substrate. 21) The riprap material shall be free from loose dirt or any pollutant. It shall be of a size sufficient to prevent its movement from the approved alignment by wave or current action. 22) If the crossing of wetlands with mechanized or non-mechanized equipment is necessary, temporary construction mats shall be utilized. for the areas to be crossed. The temporary mats shall be removed immediately upon completion of the construction of the riprap structure. Sedimentation and Erosion Control 23) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 24) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.). N/larshes Lighc, LLC c/o Doug Anderson Permit #124-05 r Page 4 of 3 ADDITIONAL CONDITIONS Easement 25) An Easement from the Department of Administration's State Property Office may be required under N.C.G.S. 146-12(e). The permittee shall contact the State Property Office at 919-807-4650 prior to the initiation of construction of any structures over state-owned submerged lands to determine if such an easement will be required. Any required easements shall be obtained, and a copy provided to the Division of Coastal Management at 400 Commerce Avenue, Morehead City, NC 28551, prior to construction of any new boat slips or other docking facilities authorized under this permit. General 26) Unless specifically altered herein, any mitigative measures or environmental commitments specifically made by the applicant in the Environmental Assessment, dated January 9, 2007, for this project shall be implemented, regardless of whether or not such commitments are addressed by individual conditions of the permit and any subsequent modifications. 27) The authorized no wake signs shall conform with any and all appropriate regulations governing such stnictures, including but not limited to marking and lighting requirements of the N.C. Wildlife Resources Commission and/or the U.S. Coast Guard. 28) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said stricture or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 29) No vegetated wetlands or open water areas shall be filled, even temporarily, outside of the area indicated on the attached workplan drawings. 30) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 31) This permit shall be attached to the original of permit #125-05, which was transferred to the permitte on 10/24/06, as well as the renewal issued on 5/13/09, the minor modifications issued on 1/30/07 and 7/18/08, the amended minor modification issued on 2/6/07, and copies of all documents shall be readily available on site when Division personnel inspect the project for compliance. 32) All conditions and stipulations of the active permit remain in force under this major modification unless specifically altered herein. /Siwv{r.: ,...
