Upon review of your request for 401 Water Quality Certification
to dredge 8300 feet of channel and boat basin which are tributary to
Cow Channel for discharge of return water from and upland diked
disposal basin located at Bear Island ferry access channel in Onslow
County as described in your submittal dated 30 December 1993, we have
determined that the proposed fill can be covered by General Water
Quality Certification No. 2668. A copy of the General Certification
is attached. This Certification may be used in qualifying for
coverage under Corps of Engineers' Nationwide Permit No. 16.
If this Certification is unacceptable to you, you have the right
to an adjudicatory hearing upon written request within thirty (30)
days following receipt of this Certification. This request must be in
the form of a written petition conforming to Chapter 150B of the North
Carolina General Statutes and filed with the Office of Administrative
Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. Unless such
demands are made, this Certification shall be final and binding.

8. PROTECT SUMMARY: The applicant proposes to maintenance dredge the ferry
channel known as Cow Channel from the AIWW to Bear Island basin. An estimated
20,000 cu. yds. of sandy spoil will be pumped to a highground disposal site adjacent to
the Atlantic Intracoastal Waterway (AIV M).
9. NARRATIVE DESCRIPTION: The main entrance to Hammocks Beach State Park is
located at the end of SR1511, between the Town of Swansboro and Queens Creek, on
the AIWW of Onslow County, NC. The North Carolina Division of Parks and
Recreation proposes to maintenance dredge a segment of the access channel connecting
the mainland side of the park with the Bear Island beach strand along the Atlantic
Ocean. The proposed maintenance dredging will take place in Cow Creek Channel, an
8100' x 67' alignment beginning on the northwest end perpendicular to the AIWW.
Maintenance dredging will terminate in the boat basin (200' x 65') at the Bear Island
ferry landing on the southeast end of the alignment. The proposed work will restore
an overall water depth of -7' relative to MLW. The bottom width of the access
channel will measure 25' wide with 3 to 1 side slopes. The proposed maintenance
activities will follow the natural meander of Cow Creek avoiding the higher shoal areas
while taking advantage of the residual deep water. The referenced aerial photography
shows clearly the existing thorofare of Cow Creek Channel relative to the shallow
water. As the applicant states, the project alignment is the same designated channel
that was maintenance dredged under CAMA Permit #252-84. The dredging will be
accomplished by the hydraulic method; approximately 20,000 cu. yds. of sandy spoil
will be removed from the 12 acre project alignment that extends 1.5 miles in length.
The applicant has estimated that the spoil material will contain only 10% silt. The
spoil disposal site is located on the AIWW and is also the same site that was utilized in
the original 1984 permit request. An onsite inspection of the disposal site was made
during the field investigation of December 9, 1993. The interior of the spoil island is
"full" so that new containment dikes will have to be pushed up by dozer-type
equipment. For the most part, the original dikes and berms are stabilized and are well
vegetated with upland brush and small pines. Dense stands of saltmarsh cordgrass
along the lower toe stabilizes the outer perimeter of the spoil island. In order to
maintain the integrity of the original dikes, the new containment berms must be
positioned well inside the old perimeter.
10. ANTICIPATED IMPACTS: The applicant accommodated this review agency by
providing staff boat transportation to inspect the channel alignment and to walk the
spoil disposal island. It has been determined that the proposed maintenance dredging
will not involve any coastal wetlands or submerged aquatic vegetation. In addition, no

shellfish areas have been identified in the existing channel alignment although the
surface waters are part of the 'SA/ORW' system around Bear Island. Surrounding the
project alignment are extensive saltmarshes with tidal creeks and guts designated as
Primary Nursery Areas by the Division of Marine Fisheries. Potential impact to
juvenile fish and shrimp populations can be lessened by conducting the maintenance
dredging operation in the colder months of the year prior to April.

shows clearly the existing thorofare of Cow Creek Channel relative to the shallow
water. As the applicant states, the project alignment is the same designated channel
that was maintenance dredged under CAMA Permit #252-84. The dredging will be
accomplished by the hydraulic method; approximately 20,000 cu. yds. of sandy spoil
will be removed from the 12 acre project alignment that extends 1.5 miles in length.
The applicant has estimated that the spoil material will contain only 10% silt. The
spoil disposal site is located on the AIWW and is also the same site that was utilized in
the original 1984 permit request. An onsite inspection of the disposal site was made
during the field investigation of December 9, 1993. The interior of the spoil island is
"full" so that new containment dikes will have to be pushed up by dozer-type
equipment. For the most part, the original dikes and berms are stabilized and are well
vegetated with upland brush and small pines. Dense stands of saltmarsh cordgrass
along the lower toe stabilizes the outer perimeter of the spoil island. In order to
maintain the integrity of the original dikes, the new containment berms must be
positioned well inside the old perimeter.
10. ANTICIPATED IMPACTS: The applicant accommodated this review agency by
providing staff boat transportation to inspect the channel alignment and to walk the
spoil disposal island. It has been determined that the proposed maintenance dredging
will not involve any coastal wetlands or submerged aquatic vegetation. In addition, no

shellfish areas have been identified in the existing channel alignment although the
surface waters are part of the 'SA/ORW' system around Bear Island. Surrounding the
project alignment are extensive saltmarshes with tidal creeks and guts designated as
Primary Nursery Areas by the Division of Marine Fisheries. Potential impact to
juvenile fish and shrimp populations can be lessened by conducting the maintenance
dredging operation in the colder months of the year prior to April.
