A copy of the General Certification is attached. This Certification may be used in qualifying for coverage under Corps of Engineers, Nationwide Permit No. 18. Additional wetland fill on this lot is not permitted under this approval. This Certification replaces one issued on 25 January 1994. A bridge must be built across the wetland to carry vehicular traffic. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. RECOMMENDED CONDITIONS OR PERMIT RESTRICTIONS: The project will result in the filling of 2000 sq. ft. of a wetland area adjacent to and separated only by a small berm from the SA surface waters of Topsail Sound. This wetland area is currently receiving runoff from adjacent developed areas. This wetland area as well as the existing berm are currently preventing stormwater from entering Topsail Sound. To fill this area could possibly increase stormwater runoff into Topsail sound. Two adjacent property owners have written letters to the Division of Coastal Management in opposition to the proposed project. These adjacent property owners are concerned that filling lot 40 could possibly cause flooding on their respective lots and that the approval of such a request could set a precedent for other similar requests in this subdivision as well as other areas on Topsail Sound. It is recommended that the applicants pursue other development options, i.e., requesting a variance on the 20 ft. setback from the street in Island Oaks Subdivision, or elevate the structure over the wetland area and designate the area between the house and street for parking. PROJECT DESCRIPTION October 25, 1993 The project site is a 7536 square foot lot in Island Oaks, an existing residential subdivision. Spoil material from dredging operations has been placed on several of the sound-front lots and the area has been denuded since the aerial photographs were taken in 1984. The Corps Of Engineers has delineated 404 wetlands throughout the subdivision site. A partial map is enclosed with this permit package. Plant species on the lot include willow trees, cattails and many other wetland plants. The area of 404 wetlands is separated from Topsail Sound by a 5-6' high earthen berm which is the result of past dredging. The cattails are not considered under DCM's jurisdiction because of the physical separation the berm provides. Proposed modification to high ground areas are unknown at this time. No coastal species would be directly affected by the proposed filling of the 404 wetlands. The waters of Topsail Sound are classified as SA by the Division Of Environmental Management. These waters are open to the taking of shellfish. The area is not designated as primary nursery according to the Division of Marine Fisheries. The Surf City Land Use Plan classifies the property as Developed-Maritime Forest. At the time of this writing a house has not been designed for the lot, nor is information available as to a proposed location on the lot. Mr. Sunderland, Agent for the Flores', indicates that future development may include the residence, driveway, decks, and a dock or pier. No water-dependent structures are proposed at this time. 10. NARRATIVE DESCRIPTION DIVISICIJ 01 COASTAL L ?aa The subject property is a single family lot measuring 55 FT in width by 120 FT deep bordering Topsail Sound, containing an isolated 404 wetland of approximately .045 acres (2000 SF). The lot is owned by Francisco and Lynn Flores and is designated as Lot 40, Island Oaks Subdivision, Phase II. It is located at 110 Seagull Court, Surf City, NC and is serviced by the Surf City Municipal Water and Sewer Systems. The site may be accessed by driving south two miles on NC Route 50 from Surf City then turning right into the Island Oaks Subdivision on Sound Drive, then right on Oak Drive and left on Seagull Court to Lot 40. In April 1993, we purchased the lot after having it surveyed by Donald Thompson Surveying Company. The survey showed a small area of isolated 404 wetland on the property with adequate high ground to permit construction of our future home. Following our purchase of Lot 40, the Corps of Engineers surveyed the wetlands on the adjoining lots and flagged the wetlands on our property at that time. The area of wetlands indicated by the Corps of Engineers was approximately 31/2 times as large as that indicated by our original survey and severed the site into two unusable parcels. It became apparent that we would have to fill a significant portion of the site to enable us to build our home. Toward this objective, we scheduled a meeting on the site with Mr. Robert Stroud and Ms. Janet Russell of CAMA and Mr. Scott McLendon and Mr. Rudi Schiener of the Corps of Engineers. The on site inspection indicated that the 404 wetlands on the property are within the 75 FT AEC, but isolated from Topsail Sound by a continuous berm of dredge spoils along the bank of the canal on the western edge of the lot. The principal vegetation in the area flagged by the Corps of Engineers, are willow trees with a small, 8 FT by 15 FT, area of cattails on the southern boundary. No standing water was apparent on the site following a heavy rainfall the night before. Mr. Scott McLendon advised us that a Nationwide Permit would be required prior to placement of any fill materials, and a CAMA Major Permit would be required since the freshwater wetland occurred within the AEC. J . The bylaws of Island Oaks Subdivision require a 30FT setback from Topsail Sound and a 20FT setback from the street. Both setbacks place the house within the wetland portion of the lot. Furthermore, there is a requirement for parking within or below the structure of the house. Box 2452 Surf City, NC 28445 NARRATIVE DESCRIPTION The subject property is a single family lot measuring 55 FT in width by 120 FT deep bordering Topsail Sound, containing an isolated 404 wetland of approximately .045 acres (2000 SF). The lot is owned by Francisco and Lynn Flores and is designated as Lot 40, Island Oaks Subdivision, Phase II. It is located at 110 Seagull Court, Surf City, NC and is serviced by the Surf City Municipal Water and Sewer Systems. The site may be accessed by driving south two miles on NC Route 50 from Surf City then turning right into the Island Oaks Subdivision on Sound Drive, then right on Oak Drive and left on Seagull Court to Lot 40. In April 1993, we purchased the lot after having it surveyed by Donald Thompson Surveying Company. The survey showed a small area of isolated 404 wetland on the property with adequate high ground to permit construction of our future home. Following our purchase of Lot 40, the Corps of Engineers surveyed the wetlands on the adjoining lots and flagged the wetlands on our property at that time. The area of wetlands indicated by the Corps of Engineers was approximately 31/2 times as large as that indicated by our original survey and severed the site into two unusable parcels. It became apparent that we would have to fill a significant portion of the site to enable us to build our home. Toward this objective, we scheduled a meeting on the site with Mr. Robert Stroud and Ms. Janet Russell of CAMA and Mr. Scott McLendon and Mr. Rudi Schiener of the Corps of Engineers. The on site inspection indicated that the 404 wetlands on the property are within the 75 FT AEC, but isolated from Topsail Sound by a continuous berm of dredge spoils along the bank of the canal on the western edge of the lot. The principal vegetation in the area flagged by the Corps of Engineers, are willow trees with a small, 8 FT by 15 FT, area of cattails on the southern boundary. No standing water was apparent on the site following a heavy rainfall the night before. Mr. Scott McLendon advised us that a Nationwide Permit would be required prior to placement of any fill materials, and a CAMA Major Permit would be required since the freshwater wetland occurred within the AEC. The bylaws of Island Oaks Subdivision require a 30FT setback from Topsail Sound and a 20FT setback from the street. Both setbacks place the house within the wetland portion of the lot. Furthermore, there is a requirement for parking within or below the structure of the house. The lot is owned by Francisco and Lynn Flores and is designated as Lot 40, Island Oaks Subdivision, Phase II. It is located at 110 Seagull Court, Surf City, NC and is serviced by the Surf City Municipal Water and Sewer Systems. The site may be accessed by driving south two miles on NC Route 50 from Surf City then turning right into the Island Oaks Subdivision on Sound Drive, then right on Oak Drive and left on Seagull Court to Lot 40. In April 1993, we purchased the lot after having it surveyed by Donald Thompson Surveying Company. The survey showed a small area of isolated 404 wetland on the property with adequate high ground to permit construction of our future home. Following our purchase of Lot 40, the Corps of Engineers surveyed the wetlands on the adjoining lots and flagged the wetlands on our property at that time. The area of wetlands indicated by the Corps of Engineers was approximately 31/2 times as large as that indicated by our original survey and severed the site into two unusable parcels. It became apparent that we would have to fill a significant portion of the site to enable us to build our home. Toward this objective, we scheduled a meeting on the site with Mr. Robert Stroud and Ms. Janet Russell of CAMA and Mr. Scott McLendon and Mr. Rudi Schiener of the Corps of Engineers. The on site inspection indicated that the 404 wetlands on the property are within the 75 FT AEC, but isolated from Topsail Sound by a continuous berm of dredge spoils along the bank of the canal on the western edge of the lot. The principal vegetation in the area flagged by the Corps of Engineers, are willow trees with a small, 8 FT by 15 FT, area of cattails on the southern boundary. No standing water was apparent on the site following a heavy rainfall the night before. Mr. Scott McLendon advised us that a Nationwide Permit would be required prior to placement of any fill materials, and a CAMA Major Permit would be required since the freshwater wetland occurred within the AEC. The bylaws of Island Oaks Subdivision require a 30FT setback from Topsail Sound and a 20FT setback from the street. Both setbacks place the house within the wetland portion of the lot. Plant species on the lot include willow trees, cattails and many other wetland plants. The area of 404 wetlands is separated from Topsail Sound by a 5-6' high earthen berm which is the result of past dredging. The cattails are not considered under DCM's jurisdiction because of the physical separation the berm provides. Proposed modification to high ground areas are unknown at this time. No coastal species would be directly affected by the proposed filling of the 404 wetlands. The waters of Topsail Sound are classified as SA by the Division Of Environmental Management. As you indicated in your application, a major CAMA permit is needed for this work. Construction should not begin prior to obtaining this authorization. This verification will be valid for 2 years from the date of this letter unless the nationwide authorization is modified, reissued or revoked. Also, this verification will remain valid for the 2 years if, during that period, the NWP authorization is reissued without modification or the activity . -2- complies with any subsequent modification of the NWP authorization. If during the 2 years, the NWP authorization expires or is suspended or revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the NWP, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the NWP will remain authorized provided the activity is completed within 12 months of the date of the NWP's expiration, modification or revocation, unless discretionary authority has been exercised on a case-by-ce: e basis to modify, suspend, or revoke the authorization.
