Box 2212 Asheboro, N.C. 27203 COPY Dear Mr. and Ms. Boling: You have our approval to place fill material in 0.13 acres of wetlands or waters for the purpose of road crossing at SR 1317 along Old House Creek, as you described in your application dated 30 August 1994. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2732. This certification allows you to use Nationwide Permit Number 14 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. An additional condition is that decd restrictions shall be placed on all lots with jurisdictional wetlands to prevent future wetland fill. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which confor ns to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions arc final and binding unless you ask for a hearing. McBride, Manager j??/ Habitat Conservation Program Date: September 26, 1994 Subject: Section 401 Certification for Donald W. Lanier and Louise C. Boling, near Oriental, Pamlico County, North Carolina. (Project # 93762) Staff biologists with the Wildlife Resources Commission have reviewed the project and associated impacts on wildlife and fishery resources in the area. An onsite investigation was conducted on September 13, 1994. Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.) and Section 401 of the Clean Water Act (as amended) and North Carolina General Statutes (G.S. 113-131 et seq.). The applicant is proposing to fill 0.13 acres of 1404' wetlands to construct a DOT approved street system to access uplands for a subdivision. This subdivision would be adjacent tc the Neuse River and Old House Creek. Several of the proposed lots in this subdivision, including sections of the road to access these lots, are predominantly 11404" wetlands. Wetland areas provide valuable wildlife habitat, serve as wildlife travel corridors and provide filtration and buffering of runoff which protects water quality. It is the concern of this agency that issuance of the 401 Water Quality certification for the filling of 0.13 acres of wetlands for the road construction will eventually result in loss of substantial wetland acreage during the development of the subdivision. Also, silt and sedimentation resulting from construction activities would negatively impact the Neuse River. Therefore, we find the project inconsistent with our Policies and Guidelines for the Conservation of Wetlands and Aquatic Habitats. Lanier & Boling 2 September 26, 1994 However, we will not object to the project if covenants are included in the development plan for the subdivision which prohibit additional draining or filling of wetlands on the individual lots. Boling Post Office Box 2212 Asheboro, North Carolina 27204 Dear Mr. Lanier and Ms. Boling: Reference your application of September 3, 1993, for Department of the Army authorization to construct a road crossing, approximately 50 feet long by 60 feet wide, impacting approximately 0.07 acre of wetlands adjacent to old House Creek. The crossing would allow access to develop Summerwinds subdivision, located off S.R. 1317, near Oriental,.,R*mlico County, North Carolina. For the purposes of the Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits. Authorization, pursuant to Section 10 of the Rivers and Harbors Act of 1899 and Section 404 of the Clean Water Act, was provided for fills for roads crossing waters of the United States (including wetlands and other special aquatic sites) provided: a. The width of the fill is limited to the minimum necessary for the actual crossing; b. The fill placed in waters of the United States is limited to a filled area of no more than one-third acre. Furthermore, no more than a total of 200 linear feet of the fill for the roadway can occur in special aquatic sites, including wetlands; C. The crossing is culverted, bridged or otherwise designed to prevent the restriction of, and to withstand, expected highflows and the movement of aquatic organisms; d. The crossing, including all attendant features, both temporary and permanent, is part of a single and complete project for crossing of a water of the United States; and e. nor fills in special aquatic sites, including wetlands, the permittee notifies the District Engineer in accordance with the "Notification" general condition. o' -2- Your work is authorized by this nationwide permit provided it is accomplished in strict accordance with the enclosed conditions. This nationwide permit does not relieve you of the responsibility to obtain any required State or local approval. This verification will be valid for 2 years from the date of this letter unless the nationwide authorization is modified, reissued, or revoked. Also, this verification will remain valid for the 2 years if, during that period, the nationwide permit authorization is reissued without modification or the activity complies with any subsequent modification of the nationwide permit authorization. If during the 2 years, the nationwide permit authorization expires or is suspended or revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the nationwide permit, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the nationwide permit will remain authorized provided the activity is completed within 12 months of the date of the nationwide permit's expiration, modification or revocation, unless discretionary authority has been exercised on a case-by-case basis to modify, suspend, or revoke the authorization.
