Reference your recent application for Department of the Army authorization,
pursuant to Nationwide Permit No. 18, for your proposed placement of fill
material in approximately 0.10 acre of wetlands adjacent to Parrot Swamp, at lot
324 (302 Josie Court) in the Foxtrace subdivision, near the Hubert community in
Onslow County, North Carolina.
Based on our review of your application, we have determined that the proposed
work will result in a greater than minimal environmental impact, including
cumulative impacts, on the aquatic environment.
The wetlands within the Foxtrace subdivision are characteristic of
pocosin/palustrine scrub-shrub and forested wetlands, contiguous to Parrot Swamp,
a forested swamp, and ultimately to lower Queens Creek. Parrot Swamp is
classified by the North Carolina Division of Marine Fisheries as a primary
nursery. Queens Creek, at its junction with Parrot Swamp, is classified by the
North Carolina Division of Environmental Management as an SA Water, which is
considered to be a high quality water capable of growing and the potnetial
harvesting of shellfish (clams and oysters). The cumulative impacts to these
wetlands resulting from landscaping projects such as yours within the Foxtrace
subdivision may result in potential chemical, physical and other environmental
damages to these nursery and SA waters. Furthermore, wetlands such as these are
important for a variety of reasons in that they may be recharge areas for
groundwater supplies, they provide areas where nutrient and pollutant uptake and
transformation from surface runoff can occur, and provide valuable wildlife
habitat for various species of birds, mammals, reptiles and amphibians. It is
our position that the natural state functions of these wetlands, as stated above,
provide important benefits to Parrot Swamp and Queens Creek that would be
adversely impacted by your proposed fill activity.
Based on the above, we have confirmed that your proposal does not meet the terms
and conditions of Nationwide Permit No. 18 as it will result in greater than a
minimal, cumulative impact to the aquatic environment. Should you wish to pursue
Department of the Army (DOA) authorization, you have the option of either
applying for an individual permit or modifying your proposal to minimize impacts.
By letter dated December 3, 1993, (copy enclosed), the National Marine Fisheries
Service has concurred with our determination of these impacts, and have indicated
that their concerns would likely be unchanged should you apply for an individual
permit.

Based on our review of your application, we have determined that the
proposed work will result in a greater than minimal environmental impact,
including cumulative impacts, on the aquatic environment.
The wetlands within the Foxtrace subdivision are characteristic of
pocosin/palustrine scrub-shrub and forested wetlands, contiguous to Parrot
Swamp, a forested swamp, and ultimately to lower Queens Creek. Parrot Swamp
is classified by the North Carolina Division of Marine Fisheries as a primary
nursery. Queens Creek, at its junction with Parrot Swamp, is classified by
the North Carolina Division of Environmental Management as an SA Water, which
is considered to be a high quality water capable of growing and the potential
harvesting of shellfish (clams and oysters). The cumulative impacts to these
wetlands resulting from landscaping projects such as yours within the Foxtrace
subdivision may result in potential chemical, physical and other environmental
damages to these nursery and SA waters. Furthermore, wetlands such as these
are important for a variety of reasons in that they may be recharge areas for
groundwater supplies, they provide areas where nutrient and pollutant uptake
and transformation from surface runoff can occur, and provide valuable
wildlife habitat for various species of birds, mammals, reptiles and
amphibians. It is our position that the natural state functions of these
wetlands, as stated above, provide important benefits to Parrot Swamp and
Queens Creek that would be adversely impacted by your proposed fill activity.
Based on the above, we have confirmed that your proposal does not meet
the terms and conditions of Nationwide Permit No. 18 as it will result in
greater than a minimal, cumulative impact to the aquatic environment. Should
you wish to pursue Department of the Army (DOA) authorization, you have the
option of either applying for an individual permit or modifying your proposal

Reference your recent application for Department of the Army
authorization, pursuant to Nationwide Permit No. 18, for your proposed
placement of fill material in approximately 0.10 acre of wetlands adjacent to
Parrot Swamp, at lot 317 (311 Josie Court) in the Foxtrace subdivision, near
the Hubert community in Onslow County, North Carolina.
Based on our review of your application, we have determined that the
proposed work will result in a greater than minimal environmental impact,
including cumulative impacts, on the aquatic environment.
The wetlands within the Foxtrace subdivision are characteristic of
pocosin/palustrine scrub-shrub and forested wetlands, contiguous to Parrot
Swamp, a forested swamp, and ultimately to lower Queens Creek. Parrot Swamp
is classified by the North Carolina Division of Marine Fisheries as a primary
nursery. Queens Creek, at its junction with Parrot Swamp, is classified by
the North Carolina Division of Environmental Management as an SA Water, which
is considered to be a high quality water capable of growing and the potnetial
harvesting of shellfish (clams and oysters). The cumulative impacts to these

in the Foxtrace Subdivision at Lot 320, Phase 3, Section 3, located near
Hubert, Onslow County, North Carolina.
For the purposes of the Corps of Engineers' Regulatory Program, Title 33,
Code of Federal Regulations (CFR), Part 330.6, published in the Federal
Register on November 22, 1991, lists nationwide permits. Authorization,
pursuant to Section 10 of the Rivers and Harbors Act and Section 404 of the
Clean Water Act, was provided for discharges of dredged or fill material into
all waters of the United States provided:
a. The discharge does not exceed 25 cubic yards;
b. The discharge will not cause the loss of more than 1/10 acre of a
special aquatic site, including wetlands. For the purposes of this nationwide
permit, the acreage limitation includes the filled area plus special aquatic
sites that are adversely affected by flooding and special aquatic sites that
are drained so that they would no longer be a water of the United States as a
result of the project;
Your work is authorized by this nationwide permit provided it is
accomplished in strict accordance with the enclosed conditions and provided
you receive a Section 401 water quality certification from the North Carolina
Division of Environmental Management (NCDEM). You should contact Mr. John

In the coastal area, you should obtain a consistency determination from the
North Carolina Division of Coastal Management (NCDCM). Please contact Mr.

responsibility to obtain other required State or local approval.
This verification will be valid for 2 years from the date of this letter
unless the nationwide authorization is modified, reissued or revoked. Also,
this verification will remain valid for the 2 years if, during that period,
the nationwide permit authorization is reissued without modification or the
activity complies with any subsequent modification of the nationwide permit
authorization. If during the 2 years, the nationwide permit authorization
expires or is suspended or revoked, or is modified, such that the activity
would no longer comply with the terms and conditions of the nationwide permit,
activities which have commenced (i.e., are under construction) or are under
contract to commence in reliance upon the nationwide permit will remain

Nationwide 26 requests at Foxtrace Sections II, III
and IV total 2.57 acres including 0.9 acres already permitted at
Section II. Of this, the 1.25 acres currently requested at
Section II and III has already been cleared and graded. The
current request also includes 0.363 acres of fill in Section IV
for road crossings under NWP 26 as well as three NWP 14 requests.
In addition, under separate application (93642) Hurst Management
Association is currently requesting a 401 Certification for three
Nationwide 18 Permits at three separate lots at Foxtrace Section
III. It is my understanding that the COE may require individual
permits for this fill request. Regional Office comments on 93642
will be submitted upon the final decision by COE concerning the
appropriateness of NWP 18.
It is recommended that the developer as well as the
consultant be informed that Nationwide Permits are not valid
until the 401 Certification is issued, and that the discharge of
dredged or fill material into waters of the State without a valid
Certification is a violation of State and Federal Regulations.

It appears that some or all of the road crossings in Section
IV could be avoided. No explanation has been submitted
concerning avoidance of these impacts. It also appears that some
lots is Section IV may not be buildable without filling wetlands.
It is recommended that all proposed wetland impacts associated
with this project be resolved with one permit application. Past
portions of the project have been handled in a piecemeal manner
with multiple applications. Additionally a road and several lots
in Section IV are platted in the location of a wastewater
treatment plant currently operating under a NPDES Permit from
this Division.

Dear Mr. Hurst:
Reference your application of July 29, 1993, for Department of the Army
(DA) authorization to place fill material in 0.08 acre of wetlands adjacent
Bear Creek to landscape a residential home at your property in the Foxtrace
Subdivision at Lot No. 322, Phase 3, Section 3, located near Hubert, Onslow
County, North Carolina.
For the purposes of the U.S. Army Corps of Engineers' Regulatory Program,
Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the
Federal Register on November 22, 1991, lists nationwide permits (NWP).
Authorization, pursuant to Section 10 of the Rivers and Harbors Act and
Section 404 of the Clean Water Act, was provided for discharges of dredged or
fill material into all waters of the United States provided:
a. The discharge does not exceed 25 cubic yards;
b. The discharge will not cause the loss of more than 1/10 acre of a
special aquatic site, including wetlands. For the purposes of this NWP, the
acreage limitation includes the filled area plus special aquatic sites that
are adversely affected by flooding and special aquatic sites that are drained
so that they would no longer be a water of the United States as a result of
the project.
Your work is authorized by this NWP provided it is accomplished in strict
accordance with the enclosed conditions and provided you receive a Section 401
water quality certification from the North Carolina Division of Environmental
Management (NCDEM). You should contact Mr. John Dorney, telephone (919)
733-1786, regarding this water quality certification, In the coastal area,
you should obtain a consistency determination from the North Carolina Division
of Coastal Management (NCDCM). Please contact Mr. Steve Benton, telephone
(919) 733-2293, regarding your consistency determination. This NWP does not
relieve you of the responsibility to obtain other required State or local
- approval.

This verification will be valid for 2 years from the date of this letter
unless the nationwide authorization is modified, reissued or revoked. Also,
this verification will remain valid for the 2 years if, during that period,
the NWP authorization is reissued without modification or the activity
complies with any subsequent modification of the NWP authorization. If during
the 2 years, the NWP authorization expires or is suspended or revoked, or is
modified, such that the activity would no longer comply with the terms and
conditions of the NWP, activities which have commenced (i.e., are under
construction) or are under contract to commence in reliance upon the NWP will
remain authorized provided the activity is completed within 12 months of the
date of the NWP's expiration, modification or revocation, unless discretionary
authority has been exercised on a case-by-case basis to modify, suspend or
revoke the authorization.

consistent with the North Carolina Coastal Management Program provided the following conditions are
met:
The activities described in the above referenced applications qualifies to receive one of
the Nationwide Permits described in 33 CFR Part 330 with the exception of Numbers 17,
21, 24, and 34 which were found inconsistent with the North Carolina Coastal
Management Program.
A 401 Water Quality Certification is received, where required, from the North Carolina
Division of Environmental Management.
