Box 2439 Matthews, N.C. 28106 Dear Mr. Levine: FILE COPY You have our approval to place fill material in 0.15 acres of waters for the purpose of commercial development at McAlpines Creek development, as you described in your application dated 10 October 1994. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2671. This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing. Levine of Levine Properties, I am requesting a 401 Water Quality Certification-NWP #26 to impact ±0.15 Acres of headwaters to deve- lop this commercial/office site in southeast Charlotte. This site is near the intersection of Monroe Road, the CSX Railroad, and McAlpine Creek. The McAlpine Creek Greenway buffers the development site from McAlpine Creek. The majority of the site is an upland ridge as depicted by the topographic maps. A large portion of the site graded and is maintained as open field. The soils on the site are Mecklenburg fine sandy loam (MeB) and Monacan Soils (Mo) in the Mc- Alpine Creek floodplain. Although the site is near McAlpine Creek (channeli.zed), jurisdictional waters are limited on this site to a deeply incised bank to bank tributary and to portions of former sediment basins that have developed small wet- land areas. All areas in the proximity to McAlpine Creek with hydrophytic vegeta- tion were carefully evaluated for soil and hydrological conditions that may have qualified the areas as jurisdictional wetlands. No wetland areas adjacent to Mc- Alpine Creek were identified on the project site. The attached map does indicate a wetland slough that is potentially adjacent however it is not in the develop- ment area. The developer will require strict adherence to an approved Sediment and Erosion Control Plan to protect this wetland area from the contractors. I have informend my client that an application to the NC Division of Environmental Management will be required if the development area changes and impacts of 1/3 Acre or greater to jurisdictional waters are necessary. Also, I have made my client aware that impacts to wetlands adjacent to McAlpine Creek are not eligible for this Nationwide Permit and would be subject to the Individual Permit Process.
