Dear Mr. Mullis:
You have our approval to place fill material in several piedmont lakes for the purpose of
constructing fish attractor devices, as you described in your application dated 15 November 1994.
After reviewing your application, we have decided that this fill is covered by General Water Quality
Certification Number 2745 This certification allows you to use Nationwide Permit Number 4 when it
is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401
of the Clean Water Act. If you have any questions, please telephone John Dorney at 919-733-1786.
Sincerely,
P.eston H ard, Jr. .

Dear Sirs,
The North Carolina Wildlife Resources Commission is
requesting a 404 permit (Nationwide Permit 4) from the U. S. Army
Corps of Engineers to install various fish attractor devices in
the reservoirs listed below in the Winter of 1994-95. By copy of
this letter, we are notifying the North Carolina Division of
Environmental Management, Water Quality Section, to issue General
Water Quality Certification No. 2745 for 401 certification.
Newly installed fish attractors (cut and cable) will consist
of non-mast producing trees growing along the shoreline. With
the permission of the landowner, these trees will be cut so that
they fall into the water. Each will remain attached to its stump
by a hinge of wood and a steel cable that will be run through
holes drilled in the tree trunk and the stump. New material,
either discarded Christmas trees or non-mast producing trees cut
along the shoreline and weighted with concrete, will be added to
existing fish attractor sites in open water areas as needed to
replenish decayed material.
Cut and cable trees will be installed on the following
lakes:

High Rock
Tillery
Blewett Falls
Tuckertown

Wake, Chatham 25
Neuse Wake, Durham, Granville 25

reservoirs or small lakes controlled or owned by Duke Power
Company, Carolina Power & Light Company, Yadkin, Inc. (Aluminum
Company of America), U. S. Army Corps of Engineers, or
Mecklenburg County Parks and Recreation Department. No wetlands
or habitats likely to support any endangered, threatened, or
special concern species will be impacted. As the project
applicant, we will take all necessary precautions to ensure that
no negative environmental impacts will occur.
